Lund to permit a three-unit building on lot of insufficient frontage and area on property located on the north side of Mechanic Avenue between White Bear Avenue and Van Dyke Street. This property is further described as: Lot 15, and the west 3 feet of Lot 16, Block 4, Hazel Park P1at "B". This matter was first considered by the Zoning Board on August 6, 1970. At that meeting, the staff report noted that an appeal by a previous owner for a three-plex on this site was denied. A permit was issued to a different owner for a duplex on the site without Council approval although the site did not have the required area. Conversion of the structure to a three-plex was without a permit. The staff concluded that the Zoning Code's density standards are reasonable, that the requested variances are excessive even for a duplex, and finally, that no hardship exists or is claimed that meets the requirements of the Zoning Code. The staff report further stated that parking for five cars would be necessary to meet the new 1.5 ratio, and could be provided only with some difficulty. Subsequently, the Board recommended denial. At the August 20, 1970, meeting the staff reported that the Council referred this matter back to the Zoning Board for further investigation and consideration. The staff noted that its report remained the same and that no further information or evidence had been submitted by the appellant. Mr. Gerald Lund, the appellant, appeared before the Board and stated that he talked to Mayor McCarty, who said that the appeal was returned to the Zoning Board because of the parking situation. Mr. Brawn no�ed that tha DeLisle Realty Company w�s the previous appellant, aad th� �oard discussed the po�sibilnty of fraud i�n their anisrepreseatation of the property to Mr. Lund. Mr, Lund xaoted tha2: the other 3-plexes in the block were buii� i�s 1964, and that his lo� is 3 feet wider th�n the others. FollowiYtg a questfor fr.om Mr. Ames, the appellant replied that the appeal approval would �cco�aaodate income pronercty. �3� GERALD M, LUND (8/6/70) (Continued): In answer ta a question from Mr. Mansur, Mr. Lnnd said this apgeal was filed following an inspection of his hom� by the city iaspector. Noting opposition, Mre Carl Miller, 1820 Mechanic Avenue, stated he Iives directly across the streee from the appellant, and is concerned with the garking problem in their area. In the wintertime it is especially bad, since Mechanic Avenue is a dead-end street. He noted that there are four cars at the appell�nt's homa presently, and this presents a problem wh�n snow is on the street. Mr, McPartlin noted �hat parking for the other 3-pl�xes and the 4-plex on Che binck is alsa fnsufficient. He can�ent�d that the ap�ellant has undoubtedly gone to co�sid�rable expenae to �inish off the basement, and had to pay for improvements. Ae suggested ghat si�ce the forfner owner was �iven a buildiug permit for a duplex, the appellant might sue for fraud. Mr. McPaxtlin moved for denial of the appeal, since the building permit was not given for a 3-ple�. The mation was seconded by Mr. Gadler, and carried by a 4-1 vote, wi�h �4r. For a duplex the lot is 652 square feet (10.81%) short of the required 6,000 square feet. The site, occupied by a 3-unit, 2-story residential structure, is zoned Light Industry and is abutted by two 3-plexes on the east and vacant property on the west. Staff conclusions noted that a previous appeal to allow 3 units on this site was denied, the development of the site with a duplex was without Council approval, the conversion of the structure to a 3-plex was without a permit, the off-street parking area is inadequate for 3 units, the City's density standards are reasonable for this site, and the variance is excessive, even for a duplex. Mr. Gerald Lund, the appellant, noted that the basement was roughed in when he purchased the home, and he finished it off himself. He bought the home from a realty company and was given the indication that it could be converted to a 3-plex.
