Dear Sir:
This is written in response to the appeal of Gerald M. Lund
to permit a three-unit building on lot of insufficient frontage
and area on property located on the north side of Mechanic Avenue
between White Bear Avenue and Van Dyke Street. This property is
further described as:
Lot 15, and the west 3 feet of Lot 16,
Block 4, Hazel Park P1at "B".
This matter was first considered by the Zoning Board on
August 6, 1970. At that meeting, the staff report noted that
an appeal by a previous owner for a three-plex on this site was
denied. A permit was issued to a different owner for a duplex on
the site without Council approval although the site did not have
the required area. Conversion of the structure to a three-plex
was without a permit. The staff concluded that the Zoning Code's
density standards are reasonable, that the requested variances are
excessive even for a duplex, and finally, that no hardship exists
or is claimed that meets the requirements of the Zoning Code. The
staff report further stated that parking for five cars would be
necessary to meet the new 1.5 ratio, and could be provided only
with some difficulty. Subsequently, the Board recommended denial.
At the August 20, 1970, meeting the staff reported that the
Council referred this matter back to the Zoning Board for further
investigation and consideration. The staff noted that its report
remained the same and that no further information or evidence had
been submitted by the appellant. Mr. Gerald Lund, the appellant,
appeared before the Board and stated that he talked to Mayor McCarty,
who said that the appeal was returned to the Zoning Board because of
the parking situation. Mr. Lund reported that at present five cars
park there and that the parking lot has crushed rock and cement
wheelstops.

In discussing the matter, the Board considered the fact that
this property has become an illegal three-plex although a previous
appeal had been denied by the Council.
Because the property has been operating illegally and because
the Board previously recommended denial of the appeal, it was moved
to again recommend denial of the appeal. The motion passed by a
4-0 vote.

A, HISTORY: The then owner of this property filed an appeal to permit the construction
a 3-plex on this property in September, 1965. The appeal was denied by the City
Council in November, 1965. An application for a permit to construct a two-family
residence was filed on 3/29/66 by a different owner, and a permit issued . The
property as described in the application for the duplex was short in frontage and
area. The City Council, in considering this appeal at their 8/27/70 hearin�;, rec 'd

B. PROPOSAL: Continue use as a 3-plex.
C. PRESENT STANDARD: The density standards are the same as existed when previous
appeal was filed. Frontage for a 3-unit building and a duplex is 50 feet. The
area required for a 3-unit building is 6,900 square feet. The required area for
a duplex is 6,000 square feet.
D. VARIANCE: The frontage of the lot ie 43 feet along the north side of Mechanic
Avenue, 7 feet (14%) short of the required 50 feet. The depth of the lot is 124
*-esulting in an area of 5,348 square feet. This is 1,552 square feet

Mre Sorenson su�ari.zed the staff report, a part of the file, notiag that a
previous awner filed an appe�l to permit construcf:ion of a 3-plex on this
property in September, 1965. The appeal was den�ed by the City Council in
Alovember, 1965. An application for a permi� to const�uct a two-family
residence was filed on March 29, 1966, by a differen� owner, and a permit
was issued. The property as described in the application for the duplex
was short in frontage and srea. The density ata�d$rds are the same as what
exiated whe�a the previous appeaL was filed. Frontage for a 3-unit building
�nd for a duplex 3.s 5a f:eet; area requi�ed $or a 3-unit building is 6,900
square feet, and for a duplex 6,000 square fee�. I� this appeal is granted
for 3 units, parking will have to be provided �or 5 cars, tn conform to the
new 1 1/2-1 parkin� amendment. The frontage azon� the north side af Mechanic
Avenue is zoned Light Industry. The site is d�veloped with a two-level
residential st�ucture. Bui1t as a duplex the �.evel. at the g:r�de of Mechanic
Avenue has the appea�ance of a duplex. The lot at the reax alley Iine is
7-9 fee� below the grade o� Mechanic Avenue and access Co the third unit is
from the alley. 1t,io 3-p�.exes and a 4-piex to t.he e�s� were constructed prior
to the Zoning CodP density standards. To the c�est �cross Mechanic Avenue 6
1/2 Iots were twice considered £or rezoning to "C" P.esidence; both petitions
were denied by the Cfty Council,
In conclusion, 2�ir. Sorensan noted thatt a previous appesl was denied �or a
3-plex on this site. A peTrmit w�s �.ssued for a duplex an the site without

Mr. Gerald Lund, the appellant, noted that �he basement c�as roughed in when
he puxah�sed the ho�e, and he finished it csi:f himself. HQ bought the ham�
from the DeLisle Reslty Companq, and w�s given tl�e indication that it could
be converted to a 3-plex.
Mr. Brawn no�ed that tha DeLisle Realty Company w�s the previous appellant,
aad th� �oard discussed the po�sibilnty of fraud i�n their anisrepreseatation
of the property to Mr. Lund. Mr, Lund xaoted tha2: the other 3-plexes in the
block were buii� i�s 1964, and that his lo� is 3 feet wider th�n the others.

In answer ta a question from Mr. Mansur, Mr. Lnnd said this apgeal was filed
following an inspection of his hom� by the city iaspector.
Noting opposition, Mre Carl Miller, 1820 Mechanic Avenue, stated he Iives
directly across the streee from the appellant, and is concerned with the
garking problem in their area. In the wintertime it is especially bad,
since Mechanic Avenue is a dead-end street. He noted that there are four
cars at the appell�nt's homa presently, and this presents a problem wh�n
snow is on the street.
Mr, McPartlin noted �hat parking for the other 3-pl�xes and the 4-plex on
Che binck is alsa fnsufficient. He can�ent�d that the ap�ellant has
undoubtedly gone to co�sid�rable expenae to �inish off the basement, and
had to pay for improvements. Ae suggested ghat si�ce the forfner owner was
�iven a buildiug permit for a duplex, the appellant might sue for fraud.
Mr. McPaxtlin moved for denial of the appeal, since the building permit was
not given for a 3-ple�. The mation was seconded by Mr. Gadler, and carried
by a 4-1 vote, wi�h �4r. Mansur voting ag�inst the matiion fvr denial.

Dear Sir:
This is written in response to the appeal of Gerald M. Lund to permit a 3-unit
building on lot o� insufficient frontage and area on property located on the north
side of Mechanic Avenue between White Bear Avenue and Van Dyke Street. This
property is further described as:
Lot 15, and the west 3 feet of Lot 16, Block 4, Hazel Park P1at "B"
This matter was considered at the August 6, 1970, Board of Zoning meeting. The
staff report noted that the then owner of this property filed an appeal to permit
the construction of a 3-plex on this property in September, 1965. The appeal was
denied by the City Council in November, 1965. An application for a permit to
construct a two-family residence was filed on March 29, 1966, by a different owner,
and a permit issued. The property as described in the application for the duplex
was short in frontage and area. The staff explained that the density standards are
the same as existed when previous appeal was filed. Frontage for a 3-unit building
and a duplex is 50 feet. The area required for a 3-unit building is 6,900 square
feet. The required area for a duplex is 6,000 square feet. It was noted that the
frontage of the lot is 43 feet along the north side of Mechanic Avenue, 7 feet (14%)
short of the required 50 feet. The depth of the lot is 124 feet, resulting in an
area of 5,348 square feet. This is 1,552 square feet (22.40%) short of the required
9,000 square feet for a 3-unit apartment in a Light Industrial zone. For a duplex
the lot is 652 square feet (10.81%) short of the required 6,000 square feet. The
site, occupied by a 3-unit, 2-story residential structure, is zoned Light Industry
and is abutted by two 3-plexes on the east and vacant property on the west. Staff
conclusions noted that a previous appeal to allow 3 units on this site was denied,
the development of the site with a duplex was without Council approval, the conversion
of the structure to a 3-plex was without a permit, the off-street parking area is
inadequate for 3 units, the City's density standards are reasonable for this site,
and the variance is excessive, even for a duplex.
Mr. Gerald Lund, the appellant, noted that the basement was roughed in when he
purchased the home, and he finished it off himself. He bought the home from a realty
company and was given the indication that it could be converted to a 3-plex. It was
then noted that the same realty company was the previous appellant and the Board noted
the possibility of fraud in the representation of the property to Mr. Lund.
Subsequently, the Board heard one person in oF ;_._ � � � ? parking

propexty in September, 1965. The appeal coas denied by the City Council in
November, 1965. Aa application for 8 p�rm�.t to constru�ct a two-family
residence was filed or� March 29, 1966, by a diff�rent owner, and a permit
was issued. The property as describ�d ir� the applicatiox► for the duplex
w�s short in fror�tage and area. The density sra�d�rds are t�ne same as what
existed when the grev3�us appeal was filed. Frontage for a 3-unit building
an� for a duplex is 50 fee�; area required far a 3-unit building is 6,900
square feet, snd for a duplex 6,OQ0 square feet. If ti�is appeal is granted
for 3 un3.ts, parkfng wi11 have to be provided for 5 cars, to conform to the

In answer to a qaestion fram Mr. Mansur, Mre Lund said this appeal was filed
foLlowing an inspection of his home by tize city inspeceor.
Noting oppositior�, Mr, Carl Mi�.ler, 1820 Mechanic Avenue, s�ated he lives
directly across the street from the apgellant, and is concerned with the
parking probletn in their area. In the wintert-�.me it is especially bad,
since Mechanic Aventae is a dead-end �treet. He noted that there are four
cars at the appellant's home presently, and this pr�senCs a problem when
snow is on the stree�.
Mrm McPartlin noted that paxking for ehe athe� 3-plexes and the 4-plex on
�he bZock is also insufficient. H.e co�r:ented �hmt tYse appel�.ant has
undoubtedly gone to considerable exge�se to iinish off the b�ssement, and
had to pay for improvem�nts. He s�a�g�st�d that since the forcn�er oweier was
given a� buildit�g permit for a duglex, the appellant migt►t sue for fraud.
Mr. McPaxtlzn� r,loved f�r �lenial of �.:he appe�l, since thti bailding per��t was
not given for a 3-plex. The motion was seconded by Mr. Gadler, and carried
by a 4-1 vote, wit�a �lr. Aiansur voting against the motion for denfal.

E. AREA ZONING: The frontage along the north side of Mechanic Avenue is zoned Light
lndustry. The area to the north of this frontage is zoned Heavy Industry, and
the area to the south is zoned "A" Residence.
F, SITE CONDITIONS: The site is developed with a two-level residential structure.
Built as a duplex the level at the grade of Mechanic Avenue has the appearance of
a duplex. The lot at the rear alley line is 7 to 9 feet below the grade of
Mechanic Avenue and access to the third unit is from the alley.
G. AREA CONDITIONS: Two 3-plexes and a 4-plex to the east were constructed prior to
the Zoning Code amendment. To the west across Mechanic Avenue 6 1/2 lots were
considered for rezoning to "C" Residence under two separate petitions. Both
petitions were denied by the City Council--the last petition this year. The
area to the north has been developed with some multi-family new buildings . To
the west is vacant land and railroad right-of-way. To the south are single-
family residences .
