MINUTES OF THE LEGISLATIVE HEARING ORDERS TO REMOVE/REPAIR, CONDEMNATIONS, SUMMARY ABATEMENT ORDERS, ABATEMENT ASSESSMENTS Tuesday, May 27, 2003 Room 330 City Hall, 15 West Kellogg Boulevard Marcia Moermond, Legislative Hearing Officer The hearing was called to order at 10:02 a.m. STAFF PRESENT: Bruce Engelbrekt, Real Estate; I,ouise Langberg, Reai Estate; Harold Robinson, Code Enforcement Marcia Moermond explained that she will be making recommendations for the City Council at this hearing. All of these addresses will have a public hearing in front of the City Council at a later date. Appeals of Summary Abatement Order and Vehicle Abatement Order at 1483 Rice Street; appellant: Jonathan Bramer. (Laid over From May 13, 2003) The following appeared: Allen Mudick, 1441 Rice Street; and Karen Boardman, 1441 Rice Street, both representing owner Luverne Worms. Jonathan Bremer, renter, and Diane Sato, his sister, arrived later in the hearing. Mr. Mudick stated that Jonathan Bremer has been asked to leave by June 30 since the citation was issued for the property. What is not cleaned up by June 30, will be taken care of. Harold Robinson reported the notice was mailed to Mr. Worms on Lake Avenue in White Bear Lake, and also mailed to Occupant at 1483 Rice Street. Three vehicles were in violation. Five exterior maintenance items were listed. A notation was made by the inspector that this seems to be a problem tenant because the City has been to the property 59 times since 2000. Inoperable vehicles and trash are the main complaints. Lisa Martin (Code Enforcement) noted she has made contact with someone. Ms. Moermond asked are the vehicles still there. Mr. Mudick responded yes, but the tenant has been cleaning. They have been trying to keep on the tenant. It was time for him to go so they can take care of it. (Mr. Robinson showed photographs to Ms. Moermond.) Ms. Moermond asked have they filed an unlawful detainer. Ms. Boardman responded no. The tenant aclmowledged that they asked him to move, but he has not said he would move. (Jonathan Bremer, renter, and Diane Sato, his sister, arrived.) Ms. Moermond stated the photographs clearly show the conditions mentioned on the orders for the properiy. She asked was a citation issued. Mr. Robinson responded a citation was issued on April 23 to the owner Luverne Worms. Ms. Boardman responded he just went to court on that last week. O� LEGISLATIVE HEARING MINLTTES FOR MAY 27, 2003 Page 2 Ms. Moermond stated that instead of writing a correction order, which says the City would clean it up and come into compliance, the summary abatement says to ciean it up and come into compliance or the City will clean it. It is the owner's responsibility to make sure the property is maintained and in comp]iance with City codes. She will change the deadline on the Summary Abatement Order. As for the Vehicle Abatement Order, Code Enforcement can send someone out this aftemoon. It has been along time since these orders were written. A lot of time was already bought by having an appeal filed on May 2; the original orders were written Aprii 22. Ms. Moerrnond asked does Code Enforcement have a recommendaYion. Mr. Robinson responded no. This is Lisa Martin's file, and she is the problem properry inspector assigned to problem properties in the City; therefore, this is considered a problem property. The owner does have the option of calling the police if the renter will not get rid ofthe vehicies. The police will tag the cars as being on the property without owner's permission and then tow them off the property at no expense to the owner. Mr. Robinson will look at the cus tomorrow. If they are still there, he can send a work order. The cars can be towed tomorrow. Ms. Sato stated the Dodge is licensed. Mr. Robinson responded that it looked inoperable according to Ms. Martin. If the owner can prove that it is driveable, the police won't take it. If it is currently licensed, they will not take it if it drives. Ms. Moermond will give 24 hours on the vehicles and until June 3 on the Summary Abatement Order which includes inside the garage, under the deck, and tree debris. She would like to give the City Council a good report on June 4. Mr. Bramer stated this is not referring to his tools. Mr. Robinson responded they can store usable items in the garage, but they cannot store garbage. (Mr. Bramer showed Ms. Moermond photographs.) Ms. Moermond looked at the photographs and said that it should be fine for the inspection. Ms. Moermond recommends that the compliance date on the April 22, 2003, Vehicle Abatement Order be changed to May 28, 2003, 10:00 a.m.. The compliance date for the April 22, 2003, Summary Abatement Order wili be changed to June 3, 2003. Page 3 Marcia Moermond recommends laying over to the June 23, 2003, Legisiative Hearing. (Note: at the Legislative Hearing, Ms. Moermond recommended approval of the assessment as the owner was not present; however, the owner called later and requested to be heard at another hearing.) 104 Larpenteur Avenue West Marcia Moermond stated this is an assessment for $745. Maggi Belde, representing owner Paul Testor, appeared. There was a garbage problem. Mr. Testor has mental illness. He has been on medicine since then, and the family has taken over his affairs. She is not sure how he could pay the assessment. Ms. Moermond asked was there a question of whether the garbage service was provided. Ms. Belde responded the City did the work and that is how the family figured out something was wrong. The yard is cleaned up, and Mr. Testor has regular garbage service now. Ms. Belde takes care of all his bills now. The family did not know this was happening. He does not work and is now on disability. Ms. Moermond asked does she have power-of-attorney. Ms. Belde responded she does not. Ms. Moermond asked is the City still providing service. Mr. Robinson responded there were 16 pickups there, and it was stopped by January 10, 2003. The inspector verified there was a BFI container there. There were 16 pickups prior to that. Ms. Moermond stated there are two options: I) recommend an assessment spread over five years, 2) fiting disability paperwork with Real Estate. Louise Langberg responded the amount of the assessment would have to be greater than 1% of the owner's adjusted income. In cases like this, it would be detrimental Yo spread it over five years if they were going to defer it; it would be more difficult to qualify for the deferaeent because the amount to show up on the taxes would be smaller. The assessment would not go away; instead it wouid be paid a maximum of 20 years later or when the property is sold or no longer homesteaded. Ms. Moerrnond asked does he have an income of less than $70,000 from the last tax statement. Ms. Belde responded yes. Bruce $ngelbrekt stated the assessment would have to be paid in full when it is soid. During that whole time, it is accrui�g interest. Ivls. Belde responded if she gets things in order, she may be able to pay tl�is off in two years. She wouid like to go the route of five years. Marcia Moermond recommends approval of the assessment. 775 Maryland Avenue East Page 4 Wesley Reynolds, owner, 3141 Clinton Avenue South, Minneapolis, appeared and stated the tenants moved in August. They had trash by the garage. Mr. Reynolds told them to put it inside the garage for pickup. It became a ticket because he did not get the information. He went to court in October, and he satisfied the ticket. There were no service provided by the City at that time. He hired Waste Management. They brought their containers out, and he has been paying them since October. He got a bilf from the City saying they were picking up the trash, but Waste Management is picking up the trash. Haroid Robinson reported pickup started October 16, 2002, running through February 26, 2003. There were at least 14 pickups. This is for the fourth quarter. Ms. Moermond asked when he got the garbage service. Mr. Reynolds responded September. He had to pay a$200 deposit until he went to court. His lawyer represented him. No one said the City had provided service. If he had known that, he would never have ordered Waste Management to come out, which started in October. Ms. Moermond asked did he let the City know he hired Waste Management. Mr. Reynods responded no because in court the City never said they would provide garbage service. Ms. Moermond stated there were six rechecks. She asked were there any letters mailed between September 11 and October 16. She also asked did Code Enforcement send a correction notice for garbage service. Mr. Robinson responded an order to get garbage service was sent on September 14, 2002, to the following: Wesiey Reynolds at 775 Maryland Avenue; M& S Development, 2000 County Road E, White Bear Lake; and Verba and Wesley Keynolds, 775 Maryland. No mail was returned. The original summary abatement to clean up the property and the order to provide garbage service was also sent to Occupant at 775 Maryland. Ms. Moermond stated the computer printout shows the address of 775 Maryland Avenue East. She asked did the AMANDA computer 'system say he lives there. Mr. Robinson responded yes. It says the homesteader is M& S Development and the owners are the Reynolds. Both addresses show up in the system. Ms Moermond asked did �e g�t the notice about September 14. Mr. Reynolds responded no. He just got a notice when the ticket came. Ms. Moermond asked how his name appeared for Maryland. Mr. Reynolds responded he bought the house from M& S properties. Their name came off the beginning of this year. Ms. Moermond stated the City sent nofice to the right place. Mr. Reynolds responded he paid his property tax under the address of 3141 Clinton. That is where his taxes go. He talked to the office also. He paid Waste Management to pick up the garbage, yet the City is saying they picked up the garbage. That is double jeopardy. Mr. Robinson responded that the City is not saying they picked up the garbage each time. The City is saying it provided the service because the owner has not identified having a licensed hauler. Once the owner tells the inspector there is a licensed hauler, the inspector cal]s Waste Management and confirms that. There has Yo be notification before the service can be stopped. An inspector wouid be violating ordinance by stopping the service without verification. Mr. Reynolds stated all his records were rendered to the City when he went to court because that was the only way they would not bring further action against him. When he came to court, he was told he needed to have a licensed garbage hauler. He does not have the court records with him. He does have the Waste Management records with him. (Mr. Reynolds showed Ms. Moermond a document.) Ms. Moermond looked at the document and stated she is not seeing anything here indicating when the service began. Mr. Reynoids responded he does not have that infarmation comp]etely, but he has a letter from Waste Management. (Mr. Reynolds showed another document.) Mr. Robinson responded it was written in August 27, 2002, to Wesley Reynolds at 7 75 Maryland for failure to maintain exterior proper[y areas in a clean and sanitary manner. Mr. Reynoids responded he went over to collect the rent and he got the envelope. It was old. He called Downtown and spoke to the guy, who gave'him some grace time to get this taken care o£ He does not know the name of the person he called or the office he called. Mr. Robinson stated they are bound by law to mai] io the address from Ramsey County Taxation. The last pickup was April I5. Mr. Reynolds responded his paperwork has December 26. Ms. Moermond stated Mr. Robinson is going to verify that there is garbage service at the property, and then he can discontinue the City service. The problem is all the service that has already been provided. All the City needed was a notification that there was private garbage service. The City never got that.
