2 WHEREAS, Lowertown Bluffs, LLC desires a 20-foot temporary construction easement and
3 license, and a 20-foot permanent fire access easement and license across the following City properties in
4 Saint Paul, Minnesota: the Bruce Vento Nature Sanctuary; Kellogg Boulevard; a use-deed pazcel
5 abutting Kellogg Boulevard, all as shown on the attached map (Exhibit "A"); and

WHEREAS, in accardance with Sec. 13.01.1 of the Saint Paul City Charter, the Parks and
8 Recreation Commission reviewed said easement request and unanimously recommended approval by the
9 Saint Paul City Council, as evidenced in the Commission's Resoluuon Numbered 03-12, adopted May
10 14, 2003, a copy of which is attached hereto; and

12 WHEREAS, Lowertown Bluffs, LLC agrees to pay just compensation to the City, as
13 determined by an independent appraiser, to be deposited in the Pazkland Replacement Fund in
14 accordance with Chapter 13.01.1 of the Saint Paul Ciry Charter; now, therefore be it
15
16 RESOLVED, that the proper City officials are hereby authorized and directed to enter into said
17 easement agreements with Lowertown Bluffs, LLC, their successors and assigns; and be ' er

19 RE50LVED, that just compensauon for said easements be paid y Lowertown B u fs, LLC, its
20 successors or assigns, and deposited into the Parkland Replacement Fund and held in reserve for
21 purchase of park properties as required in Chapter 13.011 of the City Charter, and that any other costs
22 incurred by the City of Saint Paul to complete this agreement shall be fully compensated by Lowertown
23 Bluffs, its successors or assigns.

The developer requests these easements to facilitate construction and future fire access for a 70-unit housing development on properry
abutting City parkland known as the Bruce Vento Nature Sanctuary. The easements will not prevent the futnre development or use of
the puk property.

RESOLUTION 03-12
Wf�EREAS, the Saint Paul Parks and Recreation Comxnission is an appointed body established
to advise the Mayor and City Council on long-range and city-wide matters related to Pazks and
Recrearion; and
WHEREAS, Section 13.01.1 of the Saint Paul City Charter requires that the Commission review
any diversion or disposal of park properiy and present a recommendarion to the City Council; and
WHEREAS, the City of Saint Paul owns the following properties near Fourth Street and
Commercial Street in Saint Paul:
1) the Bruce Vento Nature Sanctuary (formerly owned by the BNSF Railway);
2) Kellogg Boulevard abutting the sanctuary property; and
3) a Use Deed parcel abutting Kellogg Boulevard; and
WHEREAS, the sanchxary property was designated park land when it was acquired in 2002, and
Kellogg Boulevard is designated a parkway per Chapter 145.03 of the Saint Paul Legislafive Code; and
WIIEREAS, the owner of private property abutting said City properties is requesting a 20-foot
permanent fire access easement and a 20-foot temporary construction easement across said City
properties for the purpose of construcring a residential housing development and providing fire access
upon completion of the development; and
WHEREAS, the City has reviewed the easement request and supports the conveyance of said
easements to the abutting private property owner; now, therefore be it
RESOLVED, that the Saint Paul Parks and Recrearion Commission concurs with the proposed
permanent fire access easement and temporary construcrion easement on City property on and adjacent to
the site of the future Bruce Vento Nature Sanctuary and, in accardance with City Charter Secrion
13.01.1, recommends approval by the Saint Paul City Council

I request that a Public Hearing before the Saint Paul City Council be held on June 4, 2003 to
consider a request to grant a license and temporary and permanent easements to Lowertown
Bluffs, LLC to use a 20-foot wide lane on City park property.
The purpose of the license and easements is to facilitate construction of a housing development
on the abutting Lowertown Bluffs property and provide permanent fire access after completion of
the project.
A Public Hearing for this request is required under Saint Paul City Charter Sec. 13.01.1,
"Disposal or diversion of park property."
The City pazk property is located in City Council District 7, Planning District 4.
