PAUL �OENCIL NO. �5 � � . �, • OFFICE OF THE CITY CLERK � COUNCIL RESOLUTION ENERAL FORM PRESENTE B �� COMMISSIONE DATF � WHEREAS, Se tion 18.022 of Minnesota Statutes 1965 authorizes municipalities, incl ding the City of Saint Paul, when recommendation therefor has been received by such City from the Commissioner of Agri- culture of the State of Minnesota, to appropriate money for the con- trol of insect pests, plant diseases, bee diseases, and destructive or nuisance animals; and WHEREAS, Such letter dated October 23, 1970, addressed to the Honorable Charles P. McCarty, Mayor of Saint Paul, has been received from Mr. Robert W. Carlson, Commissioner, Minnesota Department of Agricul- ture, approving the City' s plan and program with respect to control of Dutch elm disease; and WHEREAS, Section 18.022 of Minnesota Statutes 1965 further pro- vides that in order to defray the cost of the aforementioned activities the City may levy a special tax of not to exceed two mills in any year in excess of its Charter millage limitation, but not in any event of more pthan 50¢ per capita, with an amendment which further provides that if, �' because of the prevalence of Dutch elm disease, the City of Saint Paul �'� is unable to defray the cost of control activities authorized by this -�p section of Minnesota Statutes with the limi�s set by this subdivision, � � the limits set by this subdivision are increased to 4 mills, but not in � p any event more than $1.00 per capita; now, therefore, be it 0 � t7 RESOLVED, That the Council of the City of Saint Paul hereby de- � termines that within the aforesaid Iimitation a bud�et of �188,236 as N recommended by the Commissioner of Parks and Recreation and Public `D— Buildin�s is hereby approved and adopted by the Council, and the Coun- cil hereby levies a tax in the amount of $207,810, including shrinkage in the amount of $4,074, and a reserve fund of $15,500; and be it FURTHER RESOLVED, That the County Auditor is hereby requested to spread such tax levy as a separate item in the City' s tax rate, and to report the same as a separate item in each tax settlement to the City of Saint Paul.
