WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in
the Cily of Saint Paul; and
WHEREAS, §29311 provides for the granting of variances from the sound level limitations contained in
§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
unreasonable hardship on an applicant, other persons or on the community; and
WIIEREAS, The Minnesota Music Cafe, represented by Bill Larson, owner, who has been designated as the
responsible person on the application, has applied for a variance to allow live music at 499 Payne Avenue, on June
7, 2003; and

WHEREAS, applicant is seeking a variance far the hours of 6:00 p.m. to �p.m. on �une 7, 2003; and
WHEREAS, if applicant is not granted a variance it will not be able to present the live music; and
WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to The Minnesota Music
Cafe, subject to the following conditions:

The variance shall be for the hours of 6:00 p.m. to 11:59 p.m. on June 7, 2003.
All electronically powered equipment used in conjunction with the event shall not
exceed 90 dBA as measured at the closer of the sound mix or at a distance of 50 feet
from the front of the stage.

Cafe. Chapter 293.11 provides for the ganting of variances from the sommd level limita6ons contained in 293.09.

SUBJECT: Sound Level Variance
Live Outdoor Music, Minnesota Music Cafe
Attached is a sound level variance application from Bill Lazson, Owner, Minnesota Music
Cafe, 499 Payne Ave, Saint Paul, to allow a live band concert on an outdoor stage on the
parking lot at 499 Payne Avenue. A variance is requested from 6:00 pm. to 12:00
midnight on June 7, 2003.
Enclosed is the copy of the Public Hearing Notice sent to property owners within 200 feet
of 499 Payne Avenue.
Please have this item placed on the Council agenda for June 4, 2003. If you have any
