WHEREAS, The City ha ntered into a tri-party agreement No. 56394
(S.P. 6201-39), Contract No. 13803, Public Works Project No. 70-M-0320A, with
the City of St. Paul, the Chicago, Milwaukee, St. Paul and Pacific Railroaid
Company, and the State of Minnesota for the engineering and construction of an
overhead grade separation of West Seventh Street over the raitroad company's
"Short Line" Tracks, and
WHEREAS, The proper City officers were authorized and directed to execute
this agreement by Council Resolution 247860� dafied March 12, 1970, and
WHEREAS, This ag�eement directs the City Council to approve the supple-
menta) agreements to this State of Minnesota Highway Agreement No. 56394, and
WHEREAS, The engineer in charge has determined that backfill material
behind the abutment of the bridge is not free draining,
BE IT RESOLVED, That the City approves Supplemental Agreeme�t No. 5
providing for the construction of the "Bridge Approach Treatment" at both ends
of Bridge No. 62066.
