WIIEREAS, the Legislative Hearing Officer recommends that license application (ID # 20030000968) for a
Second Hand Dealer-Motor Vehicle License by Hossein Agbamirzai„ University Auto Sales & Service LLC,
DBA University Auto Sales, 745 Robert Street South, be approved with the following conditions:
1) The number of "for sale" vehicles, displayed indoors and outdoors sha11 not exceed (29) twenty-nine.
2) Pursuant to Saint Paul Legislarive Code 62.103(g), at least (18) eighteen off-street pazking spaces sha11 be
provided for customers and employees.
3) The anangement of the vehicle display azea, customer parking and maneuvering lanes shall be in
accordance with the approved site plan on file with LIEP (License, Inspections, Environxnental Protection).
Provide maneuvering space on the property to allow vehicles entering and exiting the site to proceed
forward. Backing from the street or on to the street is prohibited.
4) There shall be no exterior storage of parts or materiais associated with the business.
5) Cars far sale may not be pazked on the street or public right-of-way.
6) All vehicles parked outdoors must appear to be completely assembled with no major body parts missing.
7) Vehicle salvage is not permitted.
8) Vehicle parts, tires, oil or similar items will not be stored outdoors. Trash will be stared in a covered
dumpster.
9) General auto repair is not allowed.
10) Auto body repair and auto body spray painting is not allowed.
11) Customer vehicles may not be parked longer than 10 days on the premises.
12) Pursuant to Saint Paul Legislative Code 62.104(12), the existing wood fence along the south, west, and
north property line must be maintained in good condition to screen sales lot from adjacent residences.
13) Licensee must comply with all federal, state and local laws.
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license
applicarion with the recommended conditions.

dba University Avenue Sales, Hossein Agbamirzai, Owner
Hossein Agbamirzai, University Auto Sales & Service, dba University Auto Sales, has applied for a
Second Hand Dealer-Motor Vehicle License. This license is Class N; therefore, neighbors were notified.
I received one letter of objection via fas from "Concerned Neighbors." The letter did not contain a
name, telephone number, nor address. In the letter, the writer does not specifically state the concerns, but
wrote that they "would like to meet with the owners and the operators to see their plans about things like
parking, traffic, etc." Later that day, Osman Abdi called the City Council Receptionist to say that he was
the one that faaced the letter. He also said his address is 769 Livingston Avenue, and he has no telephone.
Racquel Naylor, Legislative Heazing secretary, sent Mr. Abdi a letter on May 12, 2003, informing him
that he should call her by May 19 if he is willing to attend a hearing. As of today, more than two weeks
after the letter was sent, Ms. Naylor has not talked to nor received a message from Mr. Abdi.
Nancy Homans, Legislative Aide for Councilmember Chris Coleman, says that her office has no
problems with this license application being granted. Ms. Homans suggested calling Rainbow Hirsch,
Community Organizer at the West Side Citizens Organization, to see if that organization has any
concerns.
Ms. Naylor spoke to Rauibow Hirsch last week, who said she met with the new owner. He informed her
that the business will be operated the same way it has been. Also, there will be no change in the hours of
operation and no change in the parking situation. In addition, Ms. Airsch said she has not heard from
anyone who objects to this license, and she has no problem with the license being issued.
License, Inspections, and Environmental Protection (LIEP) has recommended 13 conditions for this
license, and these conditions have been signed by the owner. Notably, a similar business has operated at
this location.
Given that a similar business has been in operation at this site for years, I do not think the change in
ownership will produce a noticeable impact on traffic or parking. The business meets parking
requirements established in the zoning code. Mr. Abdi's concems about traffic and pazking must be
balanced against the right of the applicant to operate his business; therefore, I would recommend the
Council gant the licence with the conditions recommended by LIEP.
