WF3EREAS, The Minnesota Street Rod Associarion is sponsoring "Classic Cruisers," a street rod event; and
2 WHEREAS, the event is taking place from May 31 through September 27, 2003, from 6:00 to 10:00 p.m. every
3 Saturday evening; and
4 WHEREAS, The Minnesota Street Rod Association would like to use the public right of way located on Kellogg
5 Boulevazd between Robert and Wabasha Streets for the event; and
6 WHEREAS,TheMinnesotaStreetRodAssociationwishestohavetheCityindemnifyandholdthemharmlessfrom
7 claims related to the use of the public right of way; and
8 WHEREAS, provisions of this event serve a legitimate public puipose by bringing entertainment into the downtown
9 area; and
� 10 WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, for such
11 a purpose will facilitate and allow the City to provide such opportunities; now therefore be it
12 RESOLVED, that the City Council of the City of Saint Paul on behalf of the City of Saint Paul hereby agrees to
13 defend, indemnify and hold hazmless the Minnesota Street Rod Association from any and ali damages they may be
14 required to pay as a result of suits, claims, actions or judgments arising out of the use of the public right of way on
15 Kellogg Boulevard between W abasha and Robert Streets from May 31 through September 27, 2003; and be it finally

1 RESOLVED, that this indemnification does not include:

2 1) casualty loss or property damage to the privately owned vehicies;
3 2) any other occurrences or events that aze not part of the said event and that do not occur or take place at the event;

or
3) damages or injuries arising out of lack of security, improper crowd control or control of the participants in said
event; or
4} criminal acts of third parties; or
5) damages or injuries arising out of the negligence of inembers of the street rod associarion
9 Nothing in this indemnification shail be construed as a waiver of the municipal tort liability limits and defenses
10 set forth in Minn. Stat. Sec. 466.01 et. seq
