Mr. Cohen moved that the filing fee be refunded for Case No. 33-70-B, 272 South Snelling Ave. by John L. Lund as per request. Seconded by Tieso. Ayes : Cohen, Grove, Sommerdorf, Tieso. Nayes: none. James Voigt arrived. 36-70-H 1242 Albemarle Florence Koenker SUBJECT: Letter dated October 24, 1969 to Florence Koenker, 1242 Albemarle from Henry J. Streich, Supervisor - Housing Code Section, Bureau of Health concerning Housing Code violations at 1242 Albemarle. - 1 - EXHIBIT "A" . 5/13/70 ', Meeting No. 31 APPEARANCES: Florence Koenker, Mrs. Walter Butler. PROCEEDINGS : Mrs. Koenker said that one adult and three children were living at 1242 Albemarle. She said the house had four bed- rooms. She explained that she disagreed with all the requirements as set forth in the subject of appeal. She said that an electrical contractor had told her that the electrical violations as itemized were nothing to be too concerned about. Mrs . Butler explained what type of Housing Code changes she would recommend, as a City Commissioner, to alleviate some of the current housing problems. Estyr Peake arrived. Gale Rehnberg arrived. Mr. Staffenson said the matter had come about on a complaint basis. Mr. Tieso advised Mrs . Koenker to properly fuse the house if not already done so. Mr. Cohen said that items numbered 1 - 7 under the heading "Interior" were no problem. Under "General Structure" he said that he con- sidered item No. 1 a serious hazard. Mrs. Koenker explained that she had received an estimate of $1,700 to repair the porch. ACTION: Mr. Cohen moved that the porch be repaired so as to make it safe within ninety days . He further moved that items numbered 2 - 8 under the heading of "General Structure" in the Subject of Appeal be complied with within one year or that a plan for compliance with said items be submitted at the end of said year. He finally moved that a waiver of items 1 - 7 under the heading of "Interior" in the Subject of Appeal be granted until such time as the property at 1242 Albemarle be sold or the ownership transferred at which time said waiver be nullified. Seconded by Voigt. THE VOTE: Ayes : Cohen, Grove, Rehnberg, Sommerdorf, Tieso, Voigt. Nayes : none. Abstentions : Peake. Motion carried six (6) to zero (0) with one (1) abstention. Goulet SUBJECT: Letter dated April 16 , 1970 to Diana F. Goulet .from Frank A. Staffenson, Supervisor - Housing Code Section, Bureau of Health, regarding Housing Code violations at 970 Prosperity. Notice of Condemnation dated April 21, 1970 Order to Vacate dated April 21, 1970 APPEARANCES: Mrs. Diana F. Goulet. PROCEEDINGS : Mrs. Goulet said that she had been trying for some time to get the city to install a sewer to her home but that she had been unable to do so. For one reason, she was not ab le to get a petition signed to request that such work be done. She said she had been unable to get a satisfactory explanation as to why the city could not hook her property up to the city sewer system. She said that the Welfare Department was willing to repair her leaky roof for her. ACTION: Mr. Cohen moved that the matter be carried over to the next regular meeting of the Board of Appeals at which time a representative of the Public Works Department be invited in order to explain why they have been unable to hook the property at 970 Prosperity up to the city sewer system. He further moved that the vacate order be suspended until final action by the Board. Seconded by Tieso. THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdor£, Tieso Voigt. Nayes : none. Abstentions : none. Motion carried seven (7) to zero (0) . ACTION: Mr. Cohen moved that the filing fee be waived for Case No. 35-70-H, 970 Prosperity. Seconded by Sommerdorf. March 25, 1970 SUBJECT: Letter dated March 4 , 1970 from Glenn A. Erickson, Assistant City Architect, to Mr. Tom Anderson, Board of Appeals, regarding a proposed third floor occupancy at 107 Virginia. Other letters introduced by the Bureau of Public Buildings dated July 20, 1966 and April 14, 1966 concerning a third floor occupancy on the property at 107 Virginia. APPEAR.ANCES: Mrs. Mary Sulikowski, Hyman H. Cohen. PROCEEDINGS: Chairman Cohen read the Bureau of Public Buildings, May 8 , 1970 reinspection report for 107 Virginia Ave. He then re- viewed the May 7 , 1970 inspection report of the Bureau of Health for 107 Virginia. Hyman Cohen said that considerable remodeling of the premises at 107 Virginia Ave. had been carried out since the March 25, 1970 meeting of the Board of Appeals. Mrs. Sulikowski said there were five tenants on the first floor with one private bath and four tenants sharing one half a bath. She said there are five tenants on the second floor with one private bath and four others sharing a full bath. She said there was one full bathroom located on the third floor. ACTION: Chairman Cohen requested, that due to the supposed recent and numerous improvements which had been carried out at 107 Virginia that a reinspection of the premises be conducted by the Bureau of Health and the Bureau of Public Buildings and that their findings be reported at the next regular meeting of the Board. 17-70-H 2258 - 2260 Scudder Ave. James P. Waddick, cont'd. PRIOR HEARING: Mtg. No. 30. April 22, 1970. SUBJECT: Letter dated January 7, 1970 to James Waddick, 3507 Emerson No. , Minneapolis from Henry J. Streich, Supervisor - Housing Code Section, Bureau of Health, regarding Housing Code violations at 2256 - 2260 Scudder Ave. APPEARANCES: James P. Waddick PROCEEDINGS: Mr. Waddick explained that city regulations did not permit him to do his own electrical work at 2256 - 2260 Scudder - 4 - , � 5/13/70 �. ' Meeting No. 31 as he was not a resident there. He said an estimate of $1,400 was quoted him to do the necessary electrical work at the premises. ACTION: Mr. Cohen moved that a 90 day extension of time be granted to correct the ele�trical violations of 2256 - 2260 Scudder Ave. Seconded by Rehnberg. Kellogg Blvd. was read. 31-70-B 241 South Western Edward Weger PRIOR HEARING: Mtg. No. 30. April' 22, 1970. SUBJECT: Letter dated March 18, 1970 to Ed. Weger, 1276 Randolph, from Harold J. Yannarelly, Supervisor - Housing Code Section, Bureau of Health, concerning Housing Code violations at 241 South Western. APPEARANCES: Mr. & Mrs. Edward Weger PROCEEDINGS: Mrs. Weger said her husband had to leave the meeting and that she would rather not have the appeal be heard without him present. ACTION: Mr. Cohen requested that the matter be scheduled first on the agenda for the next regular meeting of the Board. 32-70-B 2550 West 7th St. The Manor Inc. by Glenn Triviski, cont'd. PRIOR HEARING: Mtg. No. 30. April 22, 1970 . SUBJECT: Letter dated March 7, 1969 to Glenn Triviski, 2550 W. 7th 5t. from Robert L. Ames, City Architect, Bureau of Public Buildings regarding a ".�rtificate of Occupancy for 2550 W. 7th St. which could not be issued as Building Code violations were present. PROCEEDINGS: Mr. Blue explained that Mr. Triviski had submitted a verbal plan of compliance with the orders of the City Architect which seemed to be satisfactory. ACTION: Mr. Cohen moved that a waiver of Building Code requirements be granted according to a written plan to comply with orders of the letter of the City Architect dated March 7 , 1970 and upon approval of said plans by the Bureau of Public Buildings that a Certificate of Occupancy be granted when compliance is reached. Ames, City Architect stating that permission to move a garage to Lot 5 , Palmer Place could not be granted as there is no residence on said property. APPEARANCES: Henry M. Buescher. ACTION: Mr. Cohen requested that the matter be continued to the next regular meeting of the Board and that all members view the lot in question if possible. 16-70-B 160 E. Kellogg Blvd. , Farwell, Ozmun, Kirk & Co. y D. H. Beaudette SUBJECT: Letter dated February 24, 1970 to Farwell, Ozmun, Kirk & Co. , 160 E. Kellogg Blvd. , attention Mr. David Beaudette from Robert L. Ames , City Architect, concerning elevators not currently certified at 160 E. Kellogg Blvd. APPEARANCES : Patrick Leighton, Robert Larson. PROCEEDINGS : Mr. Leighton stated that the elevators were curr�ntly being used for freight only. He said it would cost about $40 ,000 per elevator to bring them up to Building Code standard. He said that in the summer and fall of 1969 the building was being acquired by American Hoist. At that time American Hoist said the F.O.K. should repla��� the building. He sai� that closing the elevators - 6 - . - , 5/13/70 ,� Meetinq No. 31 , ' , . could put the company out of business. He stated that within 48 hours a contract is to be entered into for the construction of a new facility which is to be ready by May 1, 1971. Fie said that the current problem would be solved by the prospective purchasEr of the building who would either tear it down or revuild the elevators . Art Pream, City Elevator Inspector, testified as to the immediate danger the current elevators presented. Mr. Larson said the building was totally inadequate for their purposes . Mr. Cohen said he would like to know what percent of freiqht is carried by new elevators and what percent is carried by old elevators. ACTION: Mr. Cohen moved that the matter be carried over to the next regular meeting of the Board to allow F.O.K. time to attempt to work out a plan to solve the immediate hazard which seems to exist.
