THE COUNCIL OF THE CITY OF SAINT PAUL. DOES ORDAIN: Section l . That Section 308.23 of the Saint Paul Legislative Code be and the same is hereby amended by deleting therefrom subsection 5 and adopting and inserting therein the following in lieu and in place thereof: (5) No person under twenty-one (21) years of age shall be employed in an.y rooms constituting the place in which intoxicating liquors are sold "on sale". Section 2. As you know, Saint Paul has an ordinance prohibiting women bartenders, except under certain circumstances, which ordinance reads as follows: " (5) No person under twenty-one (21) years of age shall be employed in any rooms constituting the place in which intoxicating liquors are sold 'on sale. ' � No woman except a licensee or wife of a licensee, or the manager of the establishment if the licensee is in the armed forces, shall dispense liquors behind a bar or counter in an establishment in which intoxi- cating liquors are sold 'on sale. "' The City of Minneapolis has a similar provision which was recently held to be invalid by the Hennepin County District Court. It is my feeling that this provision in our Liquor Code should be repealed, and I am submitting the draft of an ordinance which would accomplish this.
