The Council of the City of Saint Paul has conducted a public hearing
upon the above improvement, due notice thereof having been given as
prescribed by the City Charter; and
WHEREAS, The Council has heard all persons, objections and
recommendations pertaining to said proposed improvement and has fully
considered the same; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does hereby order
that the above-described improvement be made, and the proper City officers
are hereby directed and authorizecl to proceed with the improvement; and be it
FURTHER RESOLVED, That upon the completion of said improvement, the
proper City officers shall calculate all expenses incurred therein and shall
report the same to the City Council in accordance with Chapter 14 of the City
Charter.

PROJECT
Construct Livingston Avenue between Plato Boulevard and Fairfield Street as a new
bituminous surfaced street with concrete curb and gutter, sanitary sewer, water main and
all other work necessary to complete said project.
PROJECT BAGKGROUND
It is proposed to construct Livingston in accordance with the West Side Flats Master Plan
which was adopted by the City Council on December 19, 2001. The development
agreement for the US Bank site requires that the City complete construction of Livingston
between Plato Boulevard and Fairfield Street by the end of 2003.
RIGHT OF WAY
The right of way for the street will be 60' wide and located as per the West Side Flats
Master Plan. The right of way will be dedicated to the City by JLT Group as per the
development agreement between the St. Paul HRA and the JLT Group. The proposed
Livingston right of way will be 30' west of vacated Livingston as shown on attached map.
EXISTING CONDITIONS
There is no rbadway in the proposed Livingston right-of-way. The area consists of
compacted soil with some construction debris. There are a few brush trees on the east
side of the right-of-way. An existing 20-24" water main in the vacated Livingston right of
way will be relocated into new Livingston right of way. There is no sanitary sewer in the
Livingston. The street is currently served by storm sewer.
PROPOSEDIMPROVEMENTS
The new 38 ft. roadway will be a bituminous surfaced street with concrete curb and gutter,
and sodded boulevards. The right of way will be graded to provide for future sidewalks.
Parking will be allowed on both sides of the street. Sanitary sewer and water main will be
constructed. Sanitary sewer, and water services will be constructed if requested by
adjacent property owners.
Sidewalk, lantern style street lighting, and boulevard trees will be constructed at a later
date in conjunction with planned development in the area.

POSITIVE BENEFITS
Construction of street and utilities will provide access and services to adjacent properties.
Construction of Livingston Avenue between Plato Boulevard and Fairfield Street will
mitigate traffic impacts resulting from the US Bank development and future development of
the West Side Flats.
ADVERSE EFFECTS
There is a possibility of soil contamination in said right-of-way which may need to be
remediated. There will also be the normal problems associated with construction such as
noise, dust, temporary reduced access to the neighborhood and general disruption will be
present.
TIME SCHEDULE
The project will begin in the late summer of 2003 and will be substantially complete by fall
of 2003.

The Council of the City of Saint Paul having received the report of the
Mayor upon the above improvement, and having considered said report, hereby
resolves:
l. That the said report and the same is hereby approve with no
alternatives, and that the estimated cost thereof is $389,889.00, £inanced by
assessments and Regional Water Services Aid.
2. That a public hearing be had on said improvement on the 28nd dav of
Mav, 2003, at 5:30 o'clock p m, in the Council Chambers of the City Hall and
Court House Building in the City of Saint Paul.
3. That notice of said public hearing be given to the persons and in the
manner provided by the Charter, stating the time and place of hearing, the
nature of the improvement and the total cost thereof as estimated.
