Commencing at the northwesterly corner of Block 29, City of St. Paul, according to the recorded
plat thereof, Ramsey County, Minnesota; thence North 34 degrees 36 minutes 00 seconds West,
an assumed beazing, along the northwesterly extension of the southwesterly line of said Lot 29, a
distance of 737 feet; thence South 10 degrees 39 minutes 55 se3conds west, 49.26 feet; thence
South 34 degrees 36 minutes 00 seconds East 12634 feet to the point of beginning of the
following described center line; thence South 55 degrees 15 minutes 57 seconds West 79.84 feet
to the westerly right-of-way of said Sibley Street and there terminating. Sidelines of said skyway
easement are prolonged or shortened to terminate at the easterly and westerly right-of-way of said

The bottom plane of the vertical space contained within said easement sha11 be 726.00 feet (based

Street and Jackson Street, top nut hydrant elevation is 708.20 feet) on the eastern right-of-way
line and 728.00 feet at the western right-of-way line of said Sibley Street; and a top plane
elevation of the vertical plane of said easement sha11 be 32.OQ feet above said elevations cited for
the bottom plane.
BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
Communications, Incorporated, Northern States Power Company, d.b.i. Xcel Energy, District Energy St.
Paul, Incorporated, MCI Worldcom, Comcast, formerly A.T. & T. Broadband, Saint Paul Regional
Water Services, and The Department of Public Works, made a part hereof by this reference and filed in
the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these corporations and
departments, waives the right to the utility easements in the vacated azea described above.

1 BE IT FURTHER RESOLVED, that the said vacation of City interest and release of the said
2 easements shall remain in effect as long as the skyways therein sha11 remain in place. Except that the
3 said skyways may be renovated or removed and replaced without reversion, upon abandonment,
4 demolition or removal of the said skyways the vacated area shall revert to City right-of-way and all
utility easements shall be restored.

7 This vacation shall be subject to the terxns and condition of Chapter 130, codified March 1, 1981, of the
8 Saint Paul Legislarive Code as amended, and to the following conditions:

10 1. That the petitioner's, their successors and assigns shali pay $1,200.00 as an administrative fee for
11 this vacation which is due and payable within 60 days of the effective date of this resolution.

That the vacated area shall be no lower than as provided by the permit for the existing skyway or

accordance with the laws in the State of Minnesota

tmperati�+es which have necessrteted the USPS's decision to construct a second skyway
mnnecting the dodc operation with the mail processing area of our faal'�ty on Ke11og9
gouievard in dowMown St• Paul. It is my unde�standing that you were previously briefed
in detail on this matter at a.luly 22. 2002 meeting in St. Pau1 by Edward Rynne of our
Headquartes Reafty Asset Management Group. The following is provided for your
information. antl as substantiation of the USPS's need for a pertnanent second skyway
strudure to serve its customers in eastem Minnesota and westem Wisconsin.
puting the mid-1970's the present skyway vras censtrueted over Sibley Stteet to
connect the Main Post Office and Pracessing & Distribution Fadlity (MPO and P�DC)
with ffie new dodc (°K-Dxl�) facility. The strudure is approycimately 20 feet wide and
spans a distance of aQproximately 85 feet_ tt is used as a pedestrian aossing irom the
K-Dock to the MPO and PE�DC, as weli as the only access for mechanicati mules,
forklifts and tugs. In a on�week Period approzimately 8,500 eontainers ere pulled irom
the K-Dock to the MPO and PSDC and badc. CuRently, an estimated 889'e of the mail
processed in this faci4ity enters and e�dts from this d��onk�p �e 8 ek� o ume
inherently integral part of the suxess of the doek ope 9 P
periods, the skywaY +s a constant bottlenedc of containers and mechanicat equipment
queuing up to cross.
gince rts construction, use of the skyway has only intens�ed. in addition, several recent
engineering studies commissionsd by the USPS have confirtned the need for major
repairs and renovation. To prevent undue stress on the skyway, its use by tu9s, foriciifts
and mechanical I"rfts has had to be reduced to attemating on�way traffic. and � only
one tug at a time. These movement Iimitations severely fiamper postal operations at
peak times causing delays. Berause these operations must remain uninterrupted, the
repairs that are necessary at this time cannot be acxomplished without a second
skyway. Quite simply. ihere are no other viable altematiyes. The only availabie path
the maii could take would be via a eircuitous route, and entail ihe use of elevators, the
crossing of three lanes of Sibley Street, while employing a mixed carawan of tugs,
fcrklifts, and mechanieal mu�es transporting maif in public automobile and pedestrian
lanes over a distance of approwmatey 2,000 feet.

Most importanUy, the addi6onai skyway is proposed not only as an expedient which
allows for the repair of the currerrt structure, but as the on►y available means to
permanently address its inadequacy with respect to current mail prxessing needs. The
absence of a seoond skyvray will only perpetuate wrrent operationsl conditions which,
over time, fiave forsed inefficiena� in the handling of dispatches within the servire
area. The USPS's initial inclination, for a widening of the existing skyway either to the
south or to the north, has upon detaled study proven not to be feasible, given the
respective constraints associated with an existing expansion joint and Vuck deara�ce
requirements. Accordingly, the USPS again requests your cooperation in ezpedlting the
fortnai vacation process of the air rights associated with this project.

Sorry for the delay in getting back to you on this. I have talked with Martha Fuller, and she has consulted
with the Mayor. Apparently, the Mayor has already approved the skyway in prior discussions with the
USPS. Therefore, PED withdraws its opposition to the second skyway at this time. Sorry for the
confusion; I was not aware of the Mayor's previous discussions with the USPS.
