WHEREAS, the City of Saint Paul and the Chicago, Milwaukee,
St. Paul and Pacific Railroad Company have entered into an agreement
whereby the City, with the cooperation of said railroad company,
would construct a sidewalk and pedestrian bridge across the railroad' s
Ford Spur Track mpproximately 600 feet west of Edgecumbe Road, and
which agreement provides that the �ailroad dedicate to the City an
easement for bridge and sidewalk purposes� now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does
hereby accept dedication of an easement for bridge purposes and also
an easement for sidewalk purposes as more fully described in the said
easement deed, a copy of which is attached hereto and ineorporated
herein by reference, and the Corporation Counsel is hereby directed
to record the original deed in the office of the Register of Deeds in
and for Ramsey County, Mi�aesota.

� EASEMENT
CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD COMPANY, a Wiscon
sin corporation, Grantor, for and in consideration of the sum of ONE DOLLAR
($1 .00) a�d other good and vatuable consideration, the receipt and sufficienc
whereof are hereby acknowledged, does hereby grant unto CITY OF SAINT PAUL, a
municipal corporation, of Ramsey County, Minnesota, Grantee, an easement for
bridge purposes, in, on, over, and across the following described real estate
situated and being in Ramsey County, Minnesota, to-wit:
That part of the NE� NW'� Section 21 , Township 2�
North, Range 23 West, described as follows;
A strip of land 20.00 feet wide, lying 10.00 feet
on each side of the following described line;
Commencing at the intersection of the south right-
� of-way line of the C.M.St.P.�P. R.R. Company's
� 150.00 foot right-of-way and the west line of
Edgecumbe Road, thence westerly along said south
right-of-way line 596,56 feet to the point of
beginning of the line to be described; thence
northerly along said line parallel to the west line
of Edgcumbe Road to the north line of the C.M.St.P.�
P. R.R. Company's 150.00 foot right-of-way.
Excepting therefrom, the north 10.00 feet of said
strip. Containing•2,800 square feet.
There is hereby further granted unto the Grantee, an easement for
sidewaik purposes, in, on, over, and across the following described real
' estate, to-wit:
That part of the NE� NW,'-w Section 21 , Township 28 North,
Range 23 West, described as foilows;
The north 10.00 feet of the C.M.St.P.�P. R.R. Company's
� 150.00 foot right-of-way lying between the west line of .
Edgcumbe Road and the centerline of Prior Avenue.
' Containing 12,638 square feet.
RESERVING unto Grantor, its successors and assigns, in each of the
hereinbefore described easemenc grants, ihe right nnt oniy to cc�htinue fihe us
and operation of all existing railroad facilities now located on the said reat
estate, but .the right to construct and maintain such additional facilities as
it may desire, in addition to those now existing, PROVIDED that the same wall
not interfere with the use and enjoyment of the easement herein granted.
These grants are subject to the superior title of the Grantor to
said real estate and to all other outstanding and superior rights, if any,
and the Grantee shall not by reason of the right hereby granted acquire or as rt
title to said real estate adverse to the title of the Grantor. Upon the

abandonment of the use of said real estate for the purpose herein authorized,
the title thereto shall remain in the Grantor, its successors and assigns,
free and clear of ali rights or claims of the Grantee.
