WHEREAS, The Federal Trade Commission on December 29, 1g69,
entered a Consent Decree against the Nashua Corporation requiring
said corporation to reimburse customers who had to pay a higher
price for its copy products as a result of the failure of the
dealer to perform on certain supply contracts for Toner for Xerox
Copiers; and
WHEREAS, The Purchasing Agent of the City of Saint Paul ,
through the State of Minnesota Contract M-83'76, purchased on behalf
of the City, Ramsey County and the Welf are Department 68 cartons of
Toner for Xerox Copiers between the dates of December 18, 1968, and
December 31, 196g; and
WHEREAS, By reason of the illegal action of the Nashua
Corporation, the City and County were required to pay �2.06 per
carton more by reason of the failure of the Nashua Corporation to
make its discount available, such damage amounting to a total of
�140.08;
NOW, THER�FORE, BE IT RESOLVED� That the Purchasing Agent is
hereby authorized to acknowledge receipt from the Nashua Corporation
of �140.08 and the Comptroller' s Office is authorized to pay the
proportionate amount of such recovery to the County as its share of
the rebate on the original purchase.
