RESOLVED, that the Council hereby ratifies and approves the action
of the Saint Paul Board of Appeals and Review for the Housing, Building
and Fire Prevention Codes at its meeting of March 26 , 1969 , pertaining
to the property located at 764 Dayton Avenue, owned by Markus Dardine
and described as: ,
West 1/2 of Lot 6 , all of Lot 7 , Block 6 , Nininger and
Donnelly' s Addition;
waiving the requirement of Sections 34. 01, 54.07 and 54.13 (4) of the
Saint Paul Legislative Code that no space in any cellar be used for
sleeping purposes; Sections of the 5aint Paul Legislative Code 34. 01
and 54.14 (1) that minimum window area in habitable rooms be at least
10% of the floor area; Section 5.02 (1)b of the Saint Paul Legislative
Code that habitable rooms shall have a clear height of not less than
7 ' 6" ; and Pamphlet 101, Chapter 11-6212 of the Life Safety Code,
adopted by reference by the Council of the City of Saint Paul that
every sleeping room, unless it has two doors providing separate ways
of escape, or has a door leading outside of the building directly,
shall have at least one outside window which can be opened from the
inside without the use of tools to provide a clear opening of not 'less
than sixteen inches in least dimension and four hundred square inches
in area, with the bottom of the opening not more than four feet above
the floor; and be it
FURTHER RESOLVED, that such waiver be granted on condition that
the basement contain one occupancy only, that Markus Dardine occupy
said occupancy and that a period of sixty days be granted to comply
with said condition; and be it

FURTHER RESOLVED, that such waiver be granted until such time as
the property at 764 Dayton Avenue be sold or the ownership be trans-
ferred at which time said waiver be nullified; and be it
FINALLY RESOLVED, that the City Clerk is hereby authorized and
directed to transmit a copy of this resolution to the Ramsey County
Register of Deeds.
