WHEREAS,Stephen Scallen made application for the in-
stallation of a 104-car parking lot to be used in conjunction
with a proposed 102-unit apartment building located on the
south side of Wilson Avenue between English Street and Johnson
Parkway; and
WHEREAS� the Zoning Board duly considered said appli�ca-
tion on September 18, 1g69, and recommended denial of plaintiff' s
application, and subsequently, on October 22, 1g69, the Council
of the City of Saint Paul considered said application and denied
the same ; and
WHEREAS, on October 24, 1g6g, the City of Saint Paul was
served with legal summons contesting the action of the gouncil
in said matter and the matter was duly litigated before the
Honorable John W. Graff, Judge of the District Court for Ramsey
County, who made, entered and filed the Court's Findings of
Fact, Conclusions of Law and Order for Judgment therein; and
WHEREAS, pursuant to said Order and on May 22, 19'70,
Judgment in favor of the plaintif�, Campus Realty Corporation,
and against the City of Saint Paul� was entered ordering,
among other things , the Ci�y and this Council to forthwith -
� grant to the plaintiff a permit to establish and mai.nt�ain
a 104-space special purpose off-street parking facility, in
accordance with plans heretofore submitted to this Qauncil,

This is written in response to the application of Stephen Scallen for a permit
to install a 104-car parking lot to be used in conjunction with a proposed 102-unit
apartment building. The site is located on the south side of Wilson Avenue between
English Street and Johnson Parkway, and is further described as:
Al1 that part of Lindley Heights, Ramsey County, Minn. described as
follows: Lots 4, 23, 24, & 25, Block 2; and Lots 2-7, Block 1; and
alI that part of Lots 5-7, 21-22, Block 2; and that part of vacated
Wakefield Ave. lying East of the following described line: Beginning
at the SW corner of said Lot 7, Block 1; thence N 0 degrees, 21 min.
W along the W line of said Lot 7, to the center line of said vacated
Wakefield Ave. ; thence E of said Lot 7, to the center line of said
vacated Wakefield Ave. ; thence E 50.00' along the center line of
said vacated Wakefield Ave. to a point of intersection with the center
line of said vacated Wakefield Ave. and the S 'ly extension of the W

This matter was considered at the September 18, 1969, Board of Zoning meeting.
The staff reported that this site, with a larger area, was rezoned from "A" Residence
to Commercial 10/13/62. Previous petitions to rezone were denied and withdrawn
earlier that year. In 1968 a petition to rezone land adjacent to the west to "C"
Residence received a recommendation of denial from the Board of Zoning but was with-
drawn after consideration by Gouncil but prior to final action. At the time of the
rezoning of this site the petitioner agreed to screen plant the 200-foot buffer area
and provide a 5-foot screen fence along the west property line. This has not been
done to date nor does this application include these provisions. The site, with a .
frontage of 90 feet along Wilson Avenue and an area of about 103,700 square feet, is
vacant with irregular terrain and undergrowth. This area has experienced substantial
new construction within the last few years. An 187-unit elderly high-rise adjoins
to the east, new apartments are to the northeast, vacant land and duplexes to the
north, and vacant Zand immediately to the west. The staff noted that revised plans,
with minor changes, will meet required design standards . However, minimum off-street
parking (104 spaces for 102 units) as we11 as a lacic of open green space are significant
undesirable features of the proposed development.

The Traffic Engineer has withheld his recommendation of approval because of
the inadequacy of off-street parking. He notes that existing apartments have
created heavy on-street parking.
Staff conclusions also noted that the site would seem to lend itself to more
creative development providing the same number of units, more open green space,
and more parking by utilizing a five or six-story building.
Mr. Stephen Scallen, speaking in behalf of his application, said that the
project was designed to meet the code. He felt that the balcony space, as well
as the roof over the room containing the swimming pool, should be considered as
open space. He said that studies have indicated that with one-bedroom apartments
such as he proposes that a ratio of 1-1 parking is sufficient. He also noted
that they were not aware of the conditions on the zoning, and that only the day
of the Zoning Board meeting he heard of the 200-foot buffer requirement and the
5-foot fence. He would prefer a planting buffer along the west boundary.
Mr. Morelli, 418 Johnson Parkway, read the Council minutes relative to the
original rezoning. (i.e. 200-foot buffer, screening, etc.) Mr. Morelli spoke in
opposition to the proposal as did Mrs. Riley of 408 Johnson Parkway, Mrs. Continenza
of 400 Johnson Parkway, and Mrs. Marchek of 417 Johnson Parkway. The question of
drainage was discussed and Mr. Scallen said he thought the drainage problem would
be solved if an alley were put in back of the residences on Johnson Parkway.
Further discussion followed concerning the inadequacy of off-street parking,
the lack of available on-street parking, and the applicant's statements that he
would start a suit against the City for any delay. -
Subsequently, it was the finding of the Board of Zoning that this permit
� should not be granted and voted 3-0, with one abstention, to recommend denial of
the application.
