TO THE HONORABLE MAYOR AND COUNCTL OF THE CITY OF SAINT PAUL:
1. We, the undersigned, are the resident owners of the following
property situated in Portland Terrace Addition to the City of Saint
Paul, according to the plat thereof filed July 27, 1920 , in Volume
37 of Plats at page 20 , to-wit:
Robert B. and Priscilla G. Farnham Lot 1
Mary S. Plowman Lot 2
Vicenta C. Donnelly Lot 3
Donald Z. and Paula C. Woods Lot 4
Halene W. Moore Lot 5
2. The lineal frontage owned by the undersigned along the proposed
improvements contained in the above designated Preliminary Orders
is as follows:
Lot 1 - 41.8 feet
Lot 2 - 20.48 feet
Lot 3 - 20.48 feet
Lot 4 - 20.75 feet
Lot 5 - 21.92 feet
The total lineal foot frontage represented by this Petition is 125.43

Gentlemen:
Herewith enclosed a certified copy of the death certificate of
the late Charles W. Plowman, formerly of 550 Portland Avenue ,
Saint Paul.
Inasmuch as this certificate also establishes Mrs. Plowman as
an informant , therefore survivor, then by operation of law
the �oint tenancy registration of title immediately passed to
the survivor, Mrs. Plowman, on the date of death. As I under-
stand it , the petition of' remonstrance was complete in all
respects except for this proof of death. If it is not now
complete and in order, kindly inform me . The hearing is
scheduled before the City Council on the 13th of August , 1970.

Gentlemen;
For more than a decade I have made my home at 552 Portland Avenue
(Lot 3, Portland Terrace) . One of the two trees proposed to be
cut down is in my back yard. The other is upon the property of
my next door neighbor, Mrs. C. William Plowman.
Filed in opposition to the Preliminary Orders is a Petition signed
in my presence by the owners of the five residences situated north
of the proposed project. These same tive residences are a single
building and constitute a row-house. They are sometimes called
collectively the "Bookstaver House" , and are included within the
published report of the Saint Paul City Planning Board entitled
Historic St. Paul Buildin s. The report states the building
" is ot a p easant and well-kept example of Cass Gilbert's
. . .
work. . . "
I mention this to highlight the tradition and pride these people
have in the condition and in the vintage of their homes.
As a concomitant to the row-house design is a three foot wide
sidewalk designed to provide access to the rear portions of the
row-house, as well as the rear portions of the property adjacent
and south. The sidewalk was dedicated to the public and under
Section 2.01 (c) of the City Legislative Code it is a public alley.
This sidewalk, constructed long ago, is designed of concrete slabs
approximately two feet square. Until June of 1969 , it was service-
able and in good condition. At that time the neighbor to the south
(who I believe has originated this proposal) dismantled nearly
fifteen feet of pavement and the conc�ete slabs are still leaning
against his back fence. I am not aware whether he had a permit to
do this.
It now appears he wishes the City to repair this damage, to assess
the cost to his neighbors and furthermore to require the destruction

. � and removal of two venerable elm trees. Each elm has some root
growth upon and beneath the alley, but they are otherwise situated
- entirely upon, and are, the property of Mrs. Plowman and myself.
A forester employed by the City estimated to me these elms are from
60 to 80 years of age and are healthy. They cas� their shade upon
our building, adding to the comfort of those living within it. They
are large, stately and beautiful as anyone of you who would visit us
could see for yourself.
We who own these elms as well as all who can see them would be
losers were they cut down to save a few inches of public alley.
I understand this matter is vested in your discretion. I most
respectfully request that you decide to leave these trees alone.
