Butler Commissioner of Finance 113 Court House St. Paul, Minnesota 55102 Dear Mrs. Butler: This letter is written in regard to the nublic hearinq that is to be held on Auqust 20. 1970 at 10:00 a.m. in the Council Chambers of the City Hall an d Court House in St. Paul, on the petition of Llewellyn M. Davis to rezone from an "A" Residence District to a "C" Residence District the property described as follows: Lots 2, 3, 4 and 5, Block 3, except the north 101 feet thereof of Rogers and Hendricks Acre Lots Number 2. The property is located on the west side of Hazelwood Street between Maryland and E. Ivy Avenues. It is our wish to have this letter put on record in opposition to having the district changed from an "p" Residence District to a "C" Residence District for the following reasons: 1) When we purchased our home, knowing that it was zoned an "A" Residence District, we felt we had the protectio� of not being swallowed up by apartment buildings, industry, e c. 2) Recent developments including the housing project and newly constructed apartments have already had a telling effect on residential land values in the area. As property owners and taxpayers directly affected, we would like to express our strenuous opposition to further developments of this type. 3) With the newly constructed apartment buildings that are in the area now, we have already seen the cause of great congestion in the area (traffic, parking problems, population) . 4) Schools in the area are overloaded now to the point that they have needed to add many portables onto the schools such as Hazel Park Jr. High School, etc. 5) This short-sightedness could well create a ghetto in our residential area in a very few years. Davis to rezone from "A" to "C" Residence to construct an apartment building property located on the west side of Hazelwood Street between East Ivy and East Maryland Avenues. This property is further described as: Lots 2, 3, 4, and 5, Block 3, except the north 101 feet thereof, Rogers and Hendricks Acre Lots Number 2. This matter was considered at the July 16, 1970, Board of Zoning meeting. The staff report noted that this site of 2.8 acres has a frontage of 403 feet on Hazelwood Street with a depth of over 300 feet. Apartment totaling over 400 units exist or are under construction in the area across Hazelwood Street and a cemetery abuts to the south. The site is above street grade, rolling and wooded, and is currently occupied by an older single-family structure. Single-family uses are to the north along East Ivy Avenue. Staff conclusions noted that the property as platted does not lend itself to single-family use but that a rezoning to a "C-1" Residence District would provide for a more desirable density. The staff also noted that an apparent "gerrymandered" legal description excludes the northerly 101 feet of this property from the rezoning petition. This area could provide a screen-planted buffer area if the rezoning is granted, but should be assured by an easement to the City. Attorney for the developers, Mr. Terrance 0'Too1e, stated that his clients would be agreeable, noting that the 101 feet would provide a buffer between the apartments and the houses on East Ivy Avenue. He presented a site plan indicating 119 units and 128 parking spaces and noted, in response to a question from the Board, that "C-1" Residence density would not be practical because of costs. � ��,iLu � -�- ( J J u� c� , � , ' Mr. Harry E. M$rshall (continued) August 18, 1970 Seven neighborhood residents spoke in opposition to the rezoning, noting the high number of existing area apartments, poor maintenance, strain on comQnunity facilities, destruction of natural green areas, inadequate off-street parking, and increased traffic problems. After some discussion by the Board, it was moved to recommend approval of the petition because: 1) the rezoning petition is legal; 2) traffic flow would be to East Maryland Avenue; 3) Hazelwood Street is a wide street; 4) the site is next to a cemetery; 5) the land does not lend itself to single-family construction; 6) the best land use would be for multiple-families; and 7) housing is a problem. The motion was seconded and discussion by the Board followed regarding the "buffer" area, the effect on community facilities, the increased cost of City services for the proposed development, and the possibility of amending the petition to a "C-1" Residence District.
