Dear Sir:
This is written in response to the petition of Virgil A. Doerfler
to rezone from "A" to "C-1" Residence to construct an apartment build-
ing property located on the northwest corner of North Hazel Street and
Wilson Avenue. This property is further described as:
Lots 4 and 5, Block 3,
Hudson Road Gardens Addition.
This matter was considered at the July 16, 1970, Board of Zoning
meeting. The staff report noted that this 1.6-acre property fronts
on two unimproved streets and is in an area of several recent rezonings
to this "C-1" Residential district. The site, if rezoned, would allow
a maximum of 42 units. The staff concluded that the site does not seem
suitable or desirable for single-family development and that the
proposed "C-1" density is in conformance with previous staff and Zoning
Board recommendations and City Council action.
Mr. R. William Reilly, attorney for the petitioner, stated that if
this rezoning was successful, the property would be developed with that
adjacent to the north which has been previously rezoned. He noted that
property is swampy on both sides of Wilson Avenue and that the petitioner
would attempt to get a private road installed.
Several neighborhood residents spoke in opposition to the rezoning,
noting apartment developments presently existing and the effect develop-
ment would have on the wildlife and trees.
After some discussion on this matter and a similar petition to
rezone the property abutting to the west, the Board of Zoning voted 4-1
to recommend approval of this petition to rezone from "A" to "C-1"
Residence.

A. SUFFICIENCY: The Commissioner of Finance, in a letter dated 6/9/70, found the
petition sufficient with the owners of 8 of a possible 11 (72.7%) tracts having
signed the petition.
B. HISTORY: None for this property.
C. PROPOSED USE: To develop the property with an apartment house.
D. FRONTAGE AND AREA: The property has a frontage of 297.31 feet along Wilson Avenue
and 235 feet along Hazel Street with an area of 69,867.85 square feet whictl allows
42 units at "C-1" Residence.
E. AREA ZONING: Adjoining on the west is property being considered for rezoning to
"C-1" classification; north and east is "C-1" Residence zoning and to the south
is "A" Residence.
F. COMPREHENSIVE PLAN: The Comprehensive Plan had recommended low-density class-
ification for the area but recent rezoning in the area suggests a re-evaluation
of the plan in this area.
G. SITE CONDITIONS: The aite is generally lower than the surrounding street grades
and appears to be marshy or a ponding area.
H. AREA CONDITIONS: Wilson Avenue between Van Dyke to Hazel is unimproved. Hazel
Street between Conway and Wilson Avenues is unimproved. Work is being done on
Van Dyke in this area--the work is either sewer or grading.
