WH�REAS, Centex Multi-Family Upper Landing LLC has submitted for City Council approval the attached
combined plat for subdivision fo properly on Block 4 of the Upper Landing Urban Village, bounded by Spring, Elm,
Mill and Washington streets; and
WHEREAS, the appropriate agencies and City departments have reviewed the plat and found, subject to
recommended conditions, that it meets the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public heazing before the City Council was duly published in the officiai newspaper of the
City, and notices were mailed to each owners of affected property, including all property situated within 350 feet of the
subjectproperiy;and
WH�REAS, the City Council held a public hearing on the proposed plat on Apri123, 2003, where all interested
parties were given the opportunity to be heard, and the Council considered all the facts and recommendafions
concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached combined plat
for Block 4 of the Upper Landing Urban Village (bounded by Spring, Elm, Mill and Washington streets), subject to the
following condirions:
1. The applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County Registrar
of Titles.
2. The applicant shall follow the principles of the Ramsey County Erosion and Sediment Control Handbook to
address short-term erosion concerns such as sediment from construction entering the Mississippi River, erosion
from wind, and tracking of sediment on local roads by construction vehicles. `

outlot. The Council held a public hearing on Apri123, 2003 regarding the application, and passed a motion of

paved streets, alleys and other public improvements; or (3) is previously unplatted land.
§6�.406 provides criteria for review of subdivision applications. These criteria are
addressed below under "Required Findings."
F. HISTORY/DISCUSSION: The City Council approved the first combined piat for the Upper
Landing Urban Vi{lage in June 2002. This plat divided the site into eight blocks, with
� associated streets, to accommodate the construction of almost 600 units of housing, 23,000
square feet of commercial space and a park. The Pianning Commission approved the
Master Site Plan for the new neighborhood in August 2002, which shows Block 4 consisting
of 30 townhomes with tuck-under parking and a small green. Construction on the first 10
townhome units (two buildings with five units each) began in December 2002.

• G. DISTRICT COUNCIL RECOMMENDATION: No recommendation was received prior to
preparation of this staff report.
H. REQUIRED FINDINGS: § 67.406 of the Zoning Code requires that all of the following
findings be made prior to approval of a subdivision:
1. All the applicabie provisions of the Legislative Code are complied with.
This condition is met.
2. The proposed subdivision will not be detrimenta) to the present and potential
surrounding land uses.
This condition is met. The subdivision of Block 4 into 30 residential lots and one outlot
is consistent with the Upper Landing Master Site Plan, approved by the Pianning
Commission on August 23, 2002. Future uses on blocks adjacent to Block 4 will be
residential, and wil� be compatible in scale, massing and use with the townhomes
planned for Biock 4. The townhomes are also being sited to take best advantage of
views, access and proximity to the Mississippi River and Samuel Morgan Regional Trail,
directly south of the block.
3. The area surrounding the subdivision can be planned and developed in
coordination and compatibility with the proposed subdivision.
This condition is met. The area surrounding Block 4 is planned for residential and
commercial uses, all consistent with the Upper Landing Urban Village Master Site Plan.
� 4. The subdivision is in conformance with the Comprehensive Plan.
This condition is met. The subdivision is in conformance with the Land Use chapter of
the Comprehensive Plan, which cails for the development of a mixed-use urban village
on the Upper Landing.
5. The subdivision preserves and incorporates the site's important existing natural
features whenever possible. .
This condition is met. There were no remaining natural features on Block 4 prior to
construction, and the site has since been remediated and raised. The original block
layout was designed to orient new development to the river and to incorporate naturat
stormwater management techniques to the greatest extent possibie.
6. All land intended for building sites can be used safely without endanger6ng
residents by peril from floods, erosion, continuously high water table, severe soil
conditions or other menace. A River Corridor Special Condition Use Permit was
granted for the entire Upper Landing Urban Viliage by the Planning Commission on July
26, 2002 to aliow garages below the regulatory flood protection elevation. On Block 4,
however, the tuck-under garages are 5-6 feet above the regulatory flood protection
elevation. All soii contamination has been remediated.
7. The subdivision can be economicatfy served with public facilities and services.
This condition is met.

above, staff recommends approvai of the combined plat for Block 4 of the Upper Landing
