2 Whereas, the Council of the City of Saint Paul, in Council File No. 03-246 dated March
3 12, 2003 adopted a resolution memorializing the Council's decision to grant an appeal by the
4 Saint Anthony Park Community Council and others from a decision of the planning commission
5 upholding a decision of the zoning administrator as set forth in planning commission resolution
6 No. 02-79: and
8 Whereas, the said council file, under its second "resolved" paragraph set forth at page 6,
9 lines 14 and 15 stating that the appeal of the Saint Anthony Park Community Council and others

is denied is erroneous as demonstrated by the immediately preceding "resolved" paragraph set
forth at page 6, lines 7 through 11 which states that the appeal of the Saint Anthony Park
Community Council and others is granted; and
Whereas the city attorney's office has reviewed the official minutes of the council's
December 11, 2002 session where the matter of the said appeal was discussed and voted upon
and that these minutes show that the counciPs intent was to grant the Saint Anthony Park
Community Council's appeal; Now, Therefore,
Be It Resolved, so as to comport with the actions of the council in this matter, that page 6
of Council File No. 03-246 as adopted on March 12, 2003, is hereby amended to read as follows:
"WHEREAS, the Council, having heard the statements made, and having
considered the application, the report of staff, the record, minutes and resolution
of the conunittee and of the commission, with respect to the advertising sign at the
Northeast corner of Raymond Avenue and Raymond Place does hereby;
RESOLVE, that the Council of the City of Saint Paul hereby grants the
appeal of Saint Anthony Pazk Community Council, Scenic Minnesota and Jay
Dregni finding error in the commission's finding in this matter that the
prohibitions against structural replacement found in the Saint Anthony Park
Special Sign District are inconsistent with the intent of the maintenance and repair
clause of state law. The Council finds that the prohibitions aeainst shuctural
replacement found in the Saint Anthony Pazk Special Sign District aze not
inconsistent with the intent of the maintenance and repair clause of state law; and
