PAUL couNCi� NO. ��,�� � OFFICE OF THE CITY CLERK FILE � C UNCIL RESOLUTION—GENERAL FORM � PRESENTED BY COMMISSIONE pTF J WHEREAS, The Council of the City of Saint Paul directed the sale of the City's interest of a portian of St. Peter Street, as more fu11y described in its Resolution C.F. 249765, approved Ju1y 21, 1970, pursuant to Section 87A.01, Subdivision 5, of the Satr�t Paul Legislative Code by requesting b�d proposals; and WHEREAS, The Conmittee on Lands has tabulated the bids su�nitted. pursuant to the above Resolation, and recamnends the sale of the City's interest to West Publtshing Company for the purchase price of $4,712.00; now therefore be it RESOLVED, The Council of the City of Saint Paul does hereby concur in the recommendation of its Coamittee on Lands, and does hereby direct the sale of the City's interest in the following described real property subject to the terms and conditions contained herein: "The southwesterly one-half af St. Peter Street lying between the northerly and southerly lines extended easterly of Lot 1, Block 20, Rice and Irvine's Addition to Saint Paul, except that �triangular portion thereof described as follows: Beginninq at the po�nt ef inter- section of the cent�rline of St. Peter Street and the eactended southerly line of Lot l, B1ack Z�, Rice and Irvine's Add9tion to Saint Paul; thence westerly along said extended southerly line af Lot 1, a distance of 13.0 feet to a point; thence northeasterly along a straight line to a point an the centerline of St. Peter Street 13.5 feet distant northwesterly of point of beginning; thence southeasterly along said centerline of 5t. That a specific easement be retained to protect the existing Northern States Pawer Campany's gas s�rvice. 2. That the purchaser, its heirs and assignees sha11 not disturb the portion af St. Peter Street vacated and sold by the City or develop andlor cQnstruct new improvements thereon or make any structural modifications to the existing building, t�nless they adequately provide for the lateral support of the ad�acent land, public improv�nents and structures, all to the satisfaction of the Commissioner of Public Wartcs and in a manner approved by the Commissioner of Public Works. 3. That a specific permanent sewer easement be retained by the City of St. Paul for the operation and maintenance of the existfng sewers now located within the portion of St. Peter Street described abave; said easement wi11 be between Elevation 93 and minus 5, City of Saint Paul datum.
