An ordinance amending Chapter 9 of the Saint Paul
Legislative Code - General Construction Requirements ;�
THE COUNCIL OF THE CITY OF SAINT PAUL DOFS ORDAIN:
Section 1
Chapter 9 of the Saint Paul Legislative Code pertaining to
General Construction Requirements is hereby amended by adding
the following:
Section 9.03 (A) - Excavation for other than Construction Purposes
1. Permits Required
No person shall do any grading except for that excavation required
for a structure authorized by a valid building permit without first
having obtained a grading permit from the Commissioner of Public
Buildings as required by Section 1.09 of this code.
2. Hazardous Conditions .
Whenever the Commissioner of Public Buildings determines that
an existing excavation or embankment has become hazardous to life,
limb or endangers property, or adversely affects the safety, use
or stability of a public way, the owner of the property upon which
the excavation or fill is located, or other person or agent that
controls said property, upon receipt of notice in writing from the
Commissioner of Public Buildings shall within the period specified,
repair or eliminate such excavation or embankment so as to eliminate
the hazard and be in conforma.nce with the requirements of this
sect ion.
3. Plans and Specifications
With each application for a grading permit and when required by the Commis-
sioner of Public Buildings, two sets of plans and specifications shall be
submitted except for excavations (a) less than two (2) feet in depth or (b)
which do not create a cut slope greater than five (5) feet in height and steeper
; than two horizontal to one vertical. The plan shall be prepared and signed by a
registered professional engineer, licensed in the 5tate of Minnesota and shall
show the following:
� (1) A vicinity sketch 'adequately -indicating the site location.
(2) Property lines of the property in which the work is to be
performed.
(3) Location of any buildings or strr�ctures on the property.
(4) Contour showing the topography of the existing ground.

(5) Elevations, dimensions, locations and slopes of all proposed
grading.
(6) Certification or estimate of the quantity of excavation involved
and estima.ted starting and completion dates.
(7) Detailed plans of all drainage devices, walls, cribbings,
dams or protective devices to be constructed with or as a part
of the proposed work.
(8) Any additional plans, drawings or calculations required by
the Commissioner of Public Buildings.
4. Soils Engineering Reports
The Commissioner of Public Buildings may require a soils engineering
investigation based on the most recent grading plan. Sueh report
shall include data regarding nature, distribution and strength
of existing soils, conclusions and recommendations for grading
procedures, and design criteria for corrective measures.
5. Time Limit
A permitee sha�l.l fully perform and complete all work required
to be done pur�uant to the grading permit within the time limit
specified. If no_time limit is specified, a permitee shall complete
the work within 180 days after date of issuance of the grading
permit. If the permitee is unable to complete the work within the
specified time, he shall, prior to the expiration of the permit,
present in writing a request for an extension of time setting forth
the reason for the requested extension. If such an extension is
warranted in the opinion of the Commissioner of Public Buildings,
he may grant additional time for the completion of the work.
6. Storm Damage Precautions
All persons performing any grading operations shall �ut into
effect all safety precautions which are necessary in the opinion
of the Commissioner of Public Buildings, and shall remove all
loose dirt from the grading site and provide adequate anti-erosion
and drainage devices or other safety devices to protect private
and public property from damage of any kind.
7. Liability
Neither the issuance of a permit nor the compliance with provisions
of this section or with any conditions imposed in the permit
. issued hereunder shall relieve any person from responSibility for
� damage to other persons or property or impose any liability upon
the city for damage to other persons or property.

8. Bond Required 504
A permit shall not be issued for more than �;Oflfl� cubic yards
unless the permit�e shall first post a bond executed by the
�wner and a corporate surety authorized to do business in this
state as a surety in amounts sufficient to cover the cost of the
project, including the corrective work necessary to eliminate hazards.
The bond shall include a penalty provision on a form approved
by the Corporation Counsel for failure to complete the work on
schedule. The term of each bond shall begin on the date of filing
and shall remain in effect until completion of the work to the
satisfaction of the Commissioner of Public Buildings. In the
event of failure to complete the work and failure to comply with
conditions and terms of the permit, the Commissioner may order
the work required by the permit to be completed to his satisfaction.
The surety executing such bond shall continue to be firmly bound
by continuing obligation for payment of all necessary costs and
expenses incurred or expended by the Department of Parks,
Recreation and Public Buildings in causing any and all such required
work to be done.
9. Design Standards
(l) Maximum Slope. The cut shall not be steeper in slope
than��-�orizontal to 1 vertical unless the owner furnishes a
soils engineering report certifying the site has been investigated
and indicating that the proposed deviation will not enc7.anger any
private property or result in deposition of debris on any public
way or interfere with any existing drainage course. The
Commissioner of Public Buildings may require the�e�cavation to
be made with the cut face flatter in sloped than ��horizontal
to 1 vertical if necessary for stability and safety.
(2) Drainage Terraces Cut slopes exceeding 40 feet in
vertical height shall be terraced at their approximate mid-height.
Drainage terraces are to be a minimum of 6 feet wide, pa�c� and
carry water to a safe disposal area. Terraces shall be cut every
30 feet vertically except that where only one terrace is required
it shall be at mid-height.
10. Setbacks
Cuts shall be set back from property lines and buildings shall
be set back from cut slopes in accordance with figure No. 1.
The required setback may be reduced by the use of retaining walls
when approved by the Commissioner of Public Buildings. Building
foundations shall be set back from the top of the slope a minimum
distance of 6 feet for all sbpes steeper than 2 horizontal to
1 vertical. Setbacks given in this section are minimum and may
be increased if considered necessary for safety or stability.

11. Drainage
(1) Disposal - All drainage facilities shall be designed
to carry surface water to the nearest practical street, storm
drain or natural water course. At least a 2 per cent grade
toward the approved disposal area will be required for building
pads . Adequate provision shall be ma.de to prevent any surface
water from damaging the face of an excavation, All slopes shall
be protected from surface water run-off from above by berms or
swalES.
12. Planting
The face of all cut slopes shall be planted and ma.intained with
a ground cover approved by the Commissioner of Public Buildings
to protect the slope against erosion as soon as practical and
prior to final approval of the grading. Where cut slopes are
not subject to erosion due to rocky character, this requirement
ma.y be waived by the Commissioner of Public Buildings.
13. Completion of Work
(1) Final Report - Upon completion of the work, the Commissioner
of Public Buildings may require the following reports:
a. The Supervising Engineer shall certify that all
grading, lot drainage and drainage facilities have
been completed in conformance with approved plans
and shall furnish a final contour ma.p of completed work.
b. The permiifee or his agent shall notify the
Commissioner of Public Buildings when the grading
operation is ready for final inspection. Final
approval shall not be given until all work including
installation of drainage structures and their protective
d�vices has been completed and the final contour map
- and required reports have been submitted.
- Section 2
This ordinance shall take effect and be in force 30 (thirty)
days from and after `its passac��, approval and publication.
