RE: James J. Perry Resolution
DATE: Augttst 18 , 1970
James J. Perry, Jr. , a Public Works employee, injured both
legs when a sweeper truck ran over him. His left leg was crushed
and mangled, while his right leg was fractured.
The City ha.s paid compensation benefits for the time that
Mr. Perry lost because of the injury. At the present time, the
Department of Public Works refuses to take Mr. Perry back, and
he is working part-time as a cab driver. No permanent partial
disability has been aid for either of the injured legs . On
July 14, 1970, Perry s attorney requested that our office pay Mr.
Perry for a 40% permanent partial disability to the left leg
which would constitute final settlement. Since Mr. Perry was
injured so severely and since the City was not required to pay
any disability for the right leg, it was concluded tha.t Mr. Perry
should be paid for 40% to the left leg, which rating he received
from the treating physician. Also, the fact that the City was not
required to pay any additional disability payments far time lost
by Mr. Perry was considered in making this settlement.
