03-445council File # 03� y� ��i�i��,� RESOLUTION CITY OF Presented By Referred To Committee: Date S� WHEREAS, Chapter 293 of the Saint Paul L,egislarive Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hazdship on an applicant, other persons or on the community; and 9 WHEREAS, The Saint Paul Saints, represented by Bill Fanning, Executive Vice PresidenUGeneral 10 Manager, who has been designated as the responsible person on the applicarion, has applied for a variance to allow 11 amplified music at Midways Stadium at 1771 Energy Park Drive, on June 15, 2003; and 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 WHEREAS, applicant is seeking a variance for the hours of 12:00 pm. to 830 p.m. on June 15, 2003; and WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music for its Live Music Concert featuring the band "Kansas" plus up to five additional acts; and WHEREAS, the Office of License, Inspections, and Environxnental Protection has reviewed the application and has made recommendations regarding conditions for the variance; now, therefare, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to The Saint Paul Saints, subject to the following conditions: 1) 2) 3) 4) The variance shall be for the hours of 12:00 pm. to 830 p.m. on June 15, 2003. All electronically powered equipment used in conjunction with the event shall not exceed 100 dBA as measured at the closer of the sound mix or at a distance of 100 feet from the front of the stage. The applicant shall provide personnel and equipment who shall provide continuous sound level monitoring between 12:00 p.m. and 8:30 pm, on June 15, 2003. All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned off no later than 8:30 p.m. on June 15, 2003.
