WHEREAS, Chapter 293 of the Saint Paul L,egislarive Code was enacted to regulate the subject of noise in
the City of Saint Paul; and
WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
§293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
unreasonable hazdship on an applicant, other persons or on the community; and
9 WHEREAS, The Saint Paul Saints, represented by Bill Fanning, Executive Vice PresidenUGeneral
10 Manager, who has been designated as the responsible person on the applicarion, has applied for a variance to allow
11 amplified music at Midways Stadium at 1771 Energy Park Drive, on June 15, 2003; and

WHEREAS, applicant is seeking a variance for the hours of 12:00 pm. to 830 p.m. on June 15, 2003; and
WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music for its
Live Music Concert featuring the band "Kansas" plus up to five additional acts; and
WHEREAS, the Office of License, Inspections, and Environxnental Protection has reviewed the application
and has made recommendations regarding conditions for the variance; now, therefare, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to The Saint Paul Saints,
subject to the following conditions:

The variance shall be for the hours of 12:00 pm. to 830 p.m. on June 15, 2003.
All electronically powered equipment used in conjunction with the event shall not
exceed 100 dBA as measured at the closer of the sound mix or at a distance of 100
feet from the front of the stage.
The applicant shall provide personnel and equipment who shall provide continuous
sound level monitoring between 12:00 p.m. and 8:30 pm, on June 15, 2003.
All electronically powered equipment, PA systems, loudspeakers or similar devices
shall be turned off no later than 8:30 p.m. on June 15, 2003.

The St. Paul Saints Professional Baseball Club, Inc. has requested a sound
level variance for a live music concert at Midway Stadium, 1771 Energy
Park Drive. The concert is scheduled on June 15, 2003 from 12:00 noon to
8:30 p.m..

Attached is a sound level variance application from Bill Fanning, Executive Vice
President/General Manager of the St. Paul Saints Baseball Club, for an amplified music
concert featuring the band "Kansas" plus up to 5 additional acts, to be held on June 15,
2003 from 12:00 noon to 8:30 p.m..
Enclosed is the copy of the Public Hearing Notice sent to property owners within 200 feet
of 1771 Energy Park Drive.

Ordinance (Chapter 293 of the St. Paul Legislative Code) has been received and is being

A public hearing before the City Council will be held on May 7, 2003 at 530 p.m., 3rd floor City
Hall Council Chambers, at the Saint Paul City Hall/Ramsey County Courthouse, 15 West
Kellogg Boulevard, Saint Paul, MN 55102.
You should be present at the hearing to respond to questions that the City Council may have.
After the public hearing the Council may by resolution grant, deny, or modify the variance
request.
