1 WFIEREAS, the City of Saint Paul, Deparunent of Public Works and the City of Maplewood are
2 working in cooperafion to consuuct a sanitary sewer through a portion of Phalen Golf Course, a
3 permanent easement, as shown in Exhibit "A", is needed to complete this sanitary sewer; and

5 WHEREAS, the City of St. Paul, Department of Pazks (Parks) is the owner of the above mentioned
6 property described in Exhibit "A" as stated in the St. Paul Parks and Recreauon Commission's
7 Resolution Numbered 03-11, considered by the Commission April9th, 2003, and

9 WHEREAS, Parks concurs, as stated in the above Parks Resolution, that it is necessary to have the
10 permanent easement for sanitary sewer purposes and just compensauon is to be determined by an
11 independent appraiser; so

13 THEREFORE BE IT RESOLVED, that the proper City officials are hereby autharized and directed
14 to enter into a permanent easement agreement with�xrks for the purpose of constructing and

17 FURTHER RESOLVED, that just compensation for said permanent easement be deposited into
18 the Parkland Replacement Fund and held in reserve for purchase of Park properues as required in
19 Chapter 13.01.1 of the City Charter and any other costs incuired be paid as part of the project to
20 acquire the necessary easement and construct the sanitary sewer.
