SUBJECT OF APPEAL : Letter dated November 25 , 1968 from Henry J. Streich, Supervisor - Housing Code Division, Bureau of Health to Eugene Ii. LaClair, 530 E. Larpenteur St, concerning improvements needed to bring the property at 530 E. Larpenteur into compliance with the Housing Code . APPEARANCES : Ronald P. Stein PROCEEDINGS : Mr. Cohen read a letter dated January 27 , 1970 from Daniel A. Klas , Corporation Counsel , Legal Department , City of St . Paul to Mr. Henry J. Streich, Supervisor, Housing Code Section, Bureau of Health which in essence stated that the Bureau o£ Health would be authorized to require the install�.tion of water and sewer tc eith�r St . Paul or Maplewood systems or an approved private system. Mr. Stein explained that he had been unable to get a plumber to estimate the cost to hook up to a city water and sewer system. He also reiterated that the cost to do so , based on a prior estimate would be prohibitive at this time . Representatives of the I3ureau of Ilealth EXHIBIT "A" S 3/l.1/70 � Meeting No. 27 and the Bureau of Public Buildings stated that they felt his private water and sewer system was presently approvable. ACTION: Mr. -Cohen moved that the requirement that the property at 530 E. Larpenteur be hooked up to a city water and sewer system be waived for as long as the present water and sewer system at 530 E. Larpenteur is considered approvable by the Bureau of f�ealth and the Bureau of Public Buildings . Mr. Cohen further moved that an extension of time be granted until July 1 , 1970 to either repair and paint the garage or raze the garage at 530 E. Larpenteur. Seconded by Voigt . Bolin SUBJECT OF APPEAL : Letter dated December 9 , 1969 from Daniel P. McLaughlin, License Inspector, Department of Public Safety to Harold N. Bolin requesting him to apply for a rooming house license for 1854 Roblyn Avenue. Letter dated January 8 , 1970 from Thomas A. Strohkirch, Iiealth Sanitarian, Bureau of Health to Mr. Harold Bolin indicating violations at 1854 Roblyn Ave. which would have to be corrected before a Rooming House license could be issued. Letter dated February 3 , 1970 from N. Turi , Pire Inspector, Department of Public Safety to Harold Bolin requesting that certain things be done to the property at 1854 Roblyn Ave . in connection with license No. 001269 . APPEARANCES : Mr. and Mrs . Harold N. Bolin PROCEEDINGS : Mr. Cohen read the letters which were the subjects of appeal and Mr. Bolin' s appeal dated February 11 , 1970. Mr. Bolin explained that there was one occupant in the basement , four on the first floor, three on the second floor, and two on the third floor. He stated that it would work a financial hardship to vacate the third floor and basement dwelling units . He said the premises had recently been reinspected by the Fire Department . ACTION : Mr. Tieso moved that the matter be carried ov��r until the March 25 , 1970 Board meeting in order that Mr. Bolin be all.owed to obtain an estimate o£ cost to install a stairway from the third floor to the grouiid level and also to get a copy of thc most recent inspection report by the Firc: l�c�iartment . - 2 - ' 3/11/70 � , Meeting No , 27 Seconded by Cohen. Potter b tan ey wanson SUBJECT OF APPEAL : Letter dated January 7 , 1970 from Raymond P. Ciagne , Sanitarian II , Bureau of Health to Mrs . K. V. Potter in- dicating that approval of a rooming house license for 1567� University Ave . would be considered upon corrections of indicated violations . APPEARANCES : Mrs . Violet K. Potter, Stanley A. Swanson. PROCEEDINGS : Mr. Cohen read the letter which was the subject of appeal and also the appeal of Stanley A. Swanson dated February 3 , 1970 on behalf of Mrs . Potter. Mrs. Potter stated that she had no complaints from roomers concerning either the lack of adequate bath facilities or the lack of an adequate number of electrical outlets in the rooms . She stated that she had two separate bath- rooms , one of which lacked a tub. ACTION: Mr. Cohen moved that a variance be granted from the require- ments of items numbered 1 and 2 in the letter of January 7 , 1970 , the subject of appeal , as long as the appellant , Violet K. Potter, is the licensee for the rooming house at 1567� University Ave. Seconded by Voigt . TIiE VOTE : Ayes : Cohen, Peake, Sommerdorf, Tieso , Voigt . Nayes : none. Abstentions : none. Ames , City Architect to Mrs . Mary F. Noltimier regarding a Certificate of Occupancy for 444 W. Lynnhurst Ave. APPEARANCES : Mary F. Noltimier, Patrick H. Doherty. PROCEEDINGS : Mr. Cohen read the subject of appeal . dated October 17 , 1969 and the appeal by Patrick H. Doherty dated January 7 , 197'� . ACTION: Mr. Doherty stated that only items numbered 3 ancl 4 in the subject of appeal dated October 17 , 1969 were being appealed in order to allow occupancy of the basement unit at 444 W. Lynnhurst Avc . lie said that a financial hardship would be worked upon Mrs . Noltimier `�' if she were not able to rent out the basement dwelling unit . - 3 - - 3/11/70 " Meeting No . 27 Mr. Cohen moved that a waiver be granted of item number 3 in - the letter dated October 17 , 1969, the subject of appeal on the con- dition that adequate ventilation be provided for the basement and first floor bathrooms at 444 W. Lynnhurst Ave and furthermore that all other items in the letter dated October 17 , 1969 be compliea with. Such waiver is to be granted for as long as Mary F. Noltimier is the owner and occupant of the property at 444 W. Lynnhurst Ave. and that upon the sale of said property or the transfer of ownership of said property that the waiver be nullified, the basement occupancy be vacated, and all Building, Housing, and Fire Prevention Code standards be complied with. Wilder Foundation y arig r. SUBJECT OF APPEAL : Letter dated February 9 , 1970 from Robert Ames , City Architect , Bureau of Public Buildings to the Amherst Wilder Foundation, attention F. M. Rarig Jr. , concerning the enclosure of stairways at 355 Washington St . APPEARANCES : F. M. Rarig Jr. PROCEEDINGS : Mr . Cohen read the subject of appeal dated February 9 , 1970 and the appeal dated February 12 , 1970 as filed by F. M. Rarig Jr. Mr. Rarig said that this matter had been going on for approximately 30 years . He said that the building in question had four floors and a basement with approximately 40 people on the fourth floor, 15 on the third floor and 25 on the second floor. He stated that the office building contained an elevator and one stairway and that there was no fire escape on the building. Mr . Cohen stated that he was bothered by the fact that there was only one stairway in the building. ACTION : Mr. Cohen moved that a life-safety inspection be conducted by the Fire Department at 355 Washington St . and that the results of said inspection be presented to the Board for consideration. He further moved that Mr. Anderson inquire into the possibility that the Civic Center Authority might acquire the property at 355 Wash- ington St . Seconded by Voigt . THE VOTE : Ayes : Cohen, Peake, Sommerdorf, Tieso, Voi �t . Nayus : none . Abstentions : none . Motion carried five (5) to zero (0) . - 4 - �� 3/11/70 ' . Meeting No. 27 . . .� Stanley Fishman Mr. Fishman presented to the Board, for consideration the plans for the E1 Torres de San Miguel homes to be constructed to provide low and moderate income housing. A total of 232 units are to be pro- vided. He stated that this was the same as the Hanover project by the housing authority. He said that the plans as presented to the Board were at variance with the St . Paul Building Code in two areas : 1 . The residential units are to be three stories in height whereas the Building Code limits wood frame residential structures to two stories in height . 2 . Tliere is a question as to whether or not the exits onto the concrete terrace at the second floor level would be considered appropriate as fire exits . He stated that the height from the second floor concrete terrace to grade would vary from 5 ' to 9 ' . Mr. Cohen advised him to present the appeal in writing and that the Board would act formally on the appeal at the next regular meeting of the Board following his submission. A poll of Board members indicated no objection to granting a variance as requested, based - on the facts as presented. Meeting adjourned at 4 : 45 p.m. . '�.�•w...•. �1A, Thomas W.
