1 WHEREAS, The Board of Water Commissioners of the City of Saint Paul has received petitions
2 for the installation of a public water main in Carver Avenue and Point Douglas Road; and

4 WHEREAS, Water Board Staff recommended to the Board the installation of said public water
5 main in Carver Avenue and Point Douglas Road; that the petitioners be pernvtted to install water
6 service connections as part of the improvement and have the scheduled cost of same levied as a
7 special assessment; and that the properiy be assessed only at the tune of connection; and said
8 water main and service connection improvements to be coordinated with the installation of
9 sanitary sewer; and

WHEREAS, The total estimated cost for said water main improvements, including construction,
engineering, inspecrion and administration is $608,59938 and the rate per assessable foot is
$67.00 and the estimated financing is $353,745.63 from assessments and $254,853.75 from
SPRWS Aid; and
WHEREAS, The Board of Water Commissioners recommends the installation of a public water
main and its appurtenances in Carver Avenue and Point Douglas Road, said improvements to be
coordinated with sanitary sewer installation, and requested a public hearing be held before the
City Council of Saint Paul to request approval of said project and assessment of benefits; and
WHEREAS, The Boazd of Water Commissioners recommends to the Saint Paul Ciry Council
that installation and payment far the said water main improvements, in whole or in part by means
of a special assessment, be assessed immediately, and be deemed a local improvement and be
ordered and made in accordance with provisions of Chapter 13 of the City Charter; and
WHEREAS, The CiTy Council recognizes that some property owners in the azea currentiy
receive water supply from their own private wells and may wish to continue doing so; and
WHEREAS, The City Council desires to allow properry owners the right to continue use of their
private water supply, and to delay the cost of connecting to the public water main until such time
as they desire to implement and pay for such connection.
NOW, TI�EREFORE, BE IT RESOLVED, that the Saint Paul City Council adopts the
recommendations of the staff of Board of Water Commissioners to the extent that the
assessments for water service connections be delayed until a property owner elects to connect to
the public water main, at which rime the special assessment will be levied; and

BE IT FL7RTFIER RESOLVED, that said delayed assessments shall be deemed transferable to
future property owners and will not become a lien upon such property unless and until a property
owner elects to connect to the public water main, at which time an assessment will be levied; and
BE IT FURTHER RESOLVED, that current and future properiy owners shall continue to have
the right to maintain, repair, improve or replace their existing private water systems and sha11 not
be compelled to connect to the public water main; and
BE IT FINALLY RESOLVED, that those properties that abut two streets and cannot be split
under RLL zoning and seek one hook up to the water and sewer main shall be assessed for the
street upon which the hook up is located only. However, if the present lot boundaries aze
modified in any manner, and the properry owner of the lot with the new boundaries requests a
hook up, that new portion shall be assessed at the prevailing rate.

Suminary of Engineering Recommendations
Project
Construction of water main and service connections in Carver Avenue and Point Douglas Road.
Existing Conditions
The project area is presently served by individual wells. The Fire Department is concerned about
the lack of water mains and fire hydrants, for fire protection in the area. Problems with wells
have been reported.
Proposed Improvements
Construct a water main in Carver Avenue, from McKnight Rd to Point Douglas Road, and in
Point Douglas Road, from Carver Avenue to 3550' south on Point Douglas Road. The water
main construction would be coordinated with the sanitary sewer construction project in Point
Dougias Road..
Alternative
To provide fire protection, the Fire Department would need to bring in water by tanker, or by
running hoses. Property owners would need to repair or replace existing wells.
Positive Benefits
City Water will be available to properties served by individual wells. Fire hydrants would be
installed at usual spacing, for fire protection.

The Council of the City of Saint Paul having received the report of the Mayor
upon the above improvement, and having considered said report, hereby resolves:

That the said report and the same is hereby approved with no alternatives, and
that the estimated cost thereof is $608,599.38 financed by SPRwS Aid
$254,853.75 and Assessments $353,745.63.
That a public hearing be had on said improvement on the 23rd dav of April.
2003, at 5:30 o'clock P.M. in the Council Chambers of the City Hall and Court
House Building in the City of Saint Paul.
That notice of said public hearing be given to the persons and in the manner
provided by the Charter, stating the time and place of hearing, the nature of
the improvement and the total cost thereof as estimated.
