WHEREAS, on January 22, 2003 Council approved CF#03-57, which vacated the City's interest in
the North half of Pullman Avenue from White Bear Avenue to 140 feet East; and
WHEREAS, after discussions with the vacation petitioner, a revision to the property description is
necessary;so
THEREFORE BE IT RE50LVED, that CF#03-57, which approved the above mentioned vacation,
is hereby rescinded; and
FURTAER RESOLVED, that a replacement resolution with the xevised property description be
presented to the City Council for considerafion.

BE TT RESOLYED,-that, upon the petition of Todd Daddari.o, as documentetl in Real Estate Division
File Number 2002-14, public properties hereinafter described are hereby vacated and discontinued as
public property: The property to be vacated is described as fallows:
The North '/z of Pullman Avenue from the Easf line of White Bear Avenne to 140 feef Eask
This vacation shall be sub}ect to the terms and condition of Chapter 13Q, codified March 1,1981, of the
Saint Paui L,egislative Code as aznended, and to the following conditions:

fihat the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacauon which is due and payable within 60 days of the effective date of this resolution.
That a permanent utality easement shall be retained within ihe vacated area to protect the interest
of Qwest Communications, Inc.
T`hat a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the City of Saint Paul> Department of Public Works to reserve the right of the City to
maintain and operate auy sewer in or upon said easement and to enter upon said easement or auy
portion thereof at any time and fzom time to rime, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereof. Any
developznent or use of the property shali be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit nonmal access to utality facilities for maintenance purposes
wi11 be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be aliowed by obtaining written permission from the
Depaztment of Pnblic Works Sewer Division with the understanding that ihe restoration
and costs of such improvements shall be the sole responsibility of the petiuoner, its
successors and assigns m ihe event the City exercises its reserved easement rights.

No change in surfacing within the easement azea will be permitted without written
permission from the Deparunent of Public Works.

grade_ Any work to change the grade of tIie existing manhole must be done by a licensed
house drain contractor
