RSS�LVED, That the proper officers of the City of St. Faul are hereby
suthorized to pay to F. Morettini Cc�nstruction Co�pany on Fartial Estimate
No. 2, Contract No. L-7323, City Froject No. 70-5-1276A, for the construction
of the JA?!ES-MILTON STORM SEfiSR, said esti�ate being psid for the period of
October 1, 1970 to October 31, 1970, and such other partial estimates on said
contract thst ,ay be presented subsequentlq by said Contractor and approved
by the City Engineer, it being the understanding of this Council that such
partial payuent or paq�eents on peatial e�timate or esti�ates on said Contract
in no way are to be conatrued as an act by the City or any of its age�ts,
servsnt� or employees extending the time specified for the co�pletion or in
any way changing the terss of said contract, plans or specifications thereof,
nor in any way nor by any means shall this resolution or paq�ent, or payments
made under authority of this resolution be construed as s waiver of any of
the rights of said City under said contract, and pre�vided tbat prior to pay-
ment of anq of the aforesaid partial estimate or esti�oates, said Contraetor
by its duly suthorized agents or corporatte officers, shall file with the Citq
Comptroll�r in a forn� approved by the Corporation Counsel an acceptance of
the conditions of pay�sent 8s her�inbefore set forth, and
BE IT FUBTHffit RSSOLVBD, That in the absence of said acceptance being filed
with the City Comptroller, no paqment or payments as aforeaa� shell be �ade.
