Faving WARNER ROAD from the Reserve Street bridge to T.H. #61, City Froject
No. 68-F-0358B1, Tower Asphalt, Ine., Contractor, the specified date of com-
pletion is July 1, 1970, and
S�ttHEREAS, Due to conditions beyond the Contractor's control he was not able
to complete the contraet by said date of completion, therefore be it
RSSOLVBD� That the prop�r City Officials be and they �e hereby authorized
and directed to exeeute an amend�ent to said contract extending the time of
completion to September 25, 1970, provided however, that this resolution shsll
have no force or effect unless the sureties on the Contractor's bond consent
�� thereto and file such consent in writing with the City Comptroller, and be it
�; i✓ � .
FURTHER R&SOLVED, That the City of Saint �aul hereby waives all claim for
liquidated damages and that no engineering and inspection costs on this project
will be charged to the Contractor for such extended period.
