The minutes of the meeting of September 23, 1970 were approved
as mailed.
69-69-H 103-105 Wilkin James Lyman, cont.
The letter from James Lyman dated September 26, 1970 was
read. It indicated his intent to remodel and redecqrate the
building at 103-105 Wilkin to bring the property up to city code.
ACTION: Moved by Cohen to deny the original appeal to allow
sharing of bathrooms at 103-105 Wilkin.

PROCEEDINGS: Mr. Staffenson reported that a reinspection of the
property located at 1026 E. Lawson on October 14, 1970 indicated
� that all Housing Code deficiencies had been corrected and there-
fore the file was being closed.
The matter before the board was consequently closed.

PRIOR HEARING: Meeting No. 39 - September 23, 1970 .
SUBJECT: Letter dated August 26, 1970 from Daniel P. McLaughlin,
License Inspector, to H. T. Jacobsen Inc. , 673-679 Lincoln Ave. ,
indicating that an application for a Rooming and Boarding House
License for 673-679 Lincoln Ave. was denied on the basis of a
recommendation of the Fire Prevention Bureau.
APPEARANCES: H. T. Jacobsen, E. C. Meisinger Jr. , Mr. Schwartz,
Ramsey County Welfare Dept.
PROCEEDINGS : Mr. Erickson said the old building permits indicate the
structures were built as two stories and attic. It was the opinion
� of Mr. Lauer, Building Inspector, that the third floors were
finished and occupied since 1894 . . The buildings were boarding
or lodging houses in 1909 . . . It is Mr. Erickson' s impression
that the buildings are in reasonable shape . . . There is ,one
interior and one exterior stairway from the third floor . .
It was the building inspector's recommendation that a manual
fire alarm system and exit lighting be provided . . . The Health
Department recommended that a handrail be provided for the rear
staircase. ...
Mr. Jacobsen explained that the corporation was presently trying
to achieve the status of a non-profit organization in order to
receive federal grants . If this is not possible, it may sell �
the buildings to a non-profit organization.
ACTION: Moved by Cohen to waive Section 54 .17 (3) .of the Saint
Paul Legislative Code that no wood frame dwelling unit be occu- .
pied above the second floor for living or sleeping purposes except �
where the original constr•uction provided for such occupancy� to
allow continued occupancy �of the third floor of the half-way -

house located at 673-679 Lincoln Ave. Such waiver is to be
granted for as long as said property be used as a half-way house
or a similar type of public service.

SUBJECT : Letter dated January 28, 1969 from Robert Ames, City
Architect, to Davis and Lagerman and �letter dated April 11, 1969
from Richard A. Schnarr, Assistant City Architect, to Davis and
Lagerman Inc. - both letters regarding a Certificate of Occupancy
for 242-260 East Sth St.
APPEARANCES : None.
PROCEEDINGS: Mr. Erickson stated that the matter had been suc-
cessfully resolved between Mr. Bernick and th�e Building Department.
Mr. Bernick intends to remove all occupants from the third floor
of the building and extend the fire escape, located on the second
floor, to ground level. The property would then comply with all
Building Code requirements .
ACTION: Moved by Tieso to dismiss the appeal on the basi$ of
Mr. Erickson's information.

SUBJECT: Letter dated September 9 , 1970 from Robert Ames, City
Architect, to Robert Schwebel, Route #3, Box 590, Mound, Minnesota .
indicating that a certain. number of bathrooms were being shared,
in variance of the Housing Code, at 611 Ashland Ave.

PROCEEDINGS : Mr. Cohen read the appeal dated September 14, 1970
requesting a waiver of the requirement that each dwelling unit
have its own bathroom. Mr. Schwebel explained that the property
is possibly to be acquired by either the Housing Authority or
the Highway Department within the near future. He felt the ex-
penditures necessary to comply with the Code would be unwarranted.
. . . Presently three individuals share one bathroom on the second
floor. The third floor is now vacated. . . . The building was
purchased in 1951.
ACTION: Moved by Cohen to waive Section 54 .11 paragraphs 1-3 that
each dwelling unit have its own bathroom facilities �or the pro-
perty located at 611 Ashland Ave. Such waiver is to be granted for
a period of one year.
Seconded by Sommerdorf.
THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdorf, Tieso,

SUBJECT: Letter dated September 16 , 1970 from Robert Ames, City
Architect, to Mr. Stephen L. Pistner, 1711 Highland Parkway, indi-
cating that Section 34 .01-1(b) of the St. Paul Legislative Code
requires a clear ceiling height of not less than 7 '6" for at
least 60 square feet �of the floor area.
APPEARANCES: Mrs . Stephen L. Pistner, Barney Sigel.
PROCEEDINGS: Mr. Sigel explained that the dormer was being con-
structed to accommodate a family ,of six individuals. . . '. He
presented a plan of the proposed dormer which was to be located
on the rear of the house. It is to be a 16 ' center section of
� the roof. The proposed ceiling height, which would be in variance
of the Building Code, would be 7 ' high at the center ridge and
taper to 6 ' high on the outside wall.
ACTION: Moved by Cohen to waive Section 34.01-1(b) of the Saint
Paul Legislative Code requiring a clear ceiling height of not �
less than 7 '6" for at least sixty square feet of the floor area.
Such waiver is granted to allow construction of a dormer at the
rear of the house located at 1711 Highland Parkway according to
the plan as submitted. �

SUBJECT: Letter dated October 13 , 1970 from Glenn A. Erickson,
Assistant City Architect, to B. T. & A. Construction Co. , Com-
merce Building, advising that Se ction 4 .05 of the St. Paul Legis-
lative Code limits the height of residence wood frame buildings
of wood frame construction to not over two stories or 35 ' from
grade.
APPEARANCES : Albert Levin, George Kolinsky.
PROCEEDINGS : The project began three or fot�r years ago. At that
time nine buildings were proposed. Six of the nine have been con-
structed and are now occupied. The first six were constructed
according to code, including fireproof wood framing. The type
of construction now being asked is permitted by the Uniform
Building Code. The units would be 28 ' high. All units will be
above grade. There will be sixty units in each of the three
buildings. The exterior walls are to be well fire protected.
Space between buildings is to be adeguate to provide recreational
areas and open space. . . . Plans of the proposed construction
were submitted.
ACTION: Moved by Peake to waive Section 4.05 of the Saint Paul
Legislative Code which limits the height of residence buildings
of wood frame construction to not over two stories or 35 feet
from grade. Such waiver is granted to allow construction' of the
three apartment buildings, located at 165-167-169 McKnight Road
as proposed.
