WHEREAS, The City of Saint Paul' s Committee on La.nds has
recommended tha.t the City purcha.se Lots 29 and 30 in Block 6 in
Como Prospect Addition for the sum of $11,750.00, the land to be
used by the City for the Loeb La.ke Development; and
WHEREAS, The owners of the property agree to the said purcha.se,
but there presently exists a title deficiency which the sellers
will correct prior to the date tha.t the City will acquire the prop-
erty and pay the compensation to the owners; and
WHEREAS, The sellers wish to give permission to the City to
enter upon the property for the purpose of removing the existing
dwelling at the City' s expense prior to the transfer of title, and
this is concurred in by the City' s Committee on La.nds; now, therefore,
be it
RESOLVED, Tha.t the Council of the City of Saint Paul does hereby
authorize purcha.se agreement of Lots 29 and 30 in Block 6 in Como
Prospect Addition, and the proper City officers are hereby authorized
to execute the said purchase agreement on behalf of the City, a copy
of which purcha.se agreement is attached hereto.

hereinafter referred to as "Sellers" ,
WI'1:NESSETH: �
WHEREAS , City is desirous of purchasing Lot.s 29 and 30 in
Block 6 in Como PrasPect Addii�ion, City of- Saint Paul, County of
Ramseys State of Minnesota, City and Sel]_ers agree that compensa-
� t� on for the purchase of �he r_eal_ estatc� shall Ue the sum of.
Eleven Thousand Seven Hundred Fiity Dollars ($11, �ISG.00) ; and
WHEREAS, The Sellers agree to sell the above-describ�d real
estai�e to the City ancl wi11 take whatev�r action is necessary to
perfect title thereto, and it is the ini:ention of the Parties to
set forth below terms and conditions of the purchase by the City;
now, therefore, it is .
AGREED, By and Between City and Sellers as follows:

Prospect Addition for the mutually agreed-upon consideration of
the sum o� Eleven Thousarid Seven Hundred Fifty Dollars ($1]_, 750. 00) <
. 2 . The abo�Te consideration shall be paid to the Sellers by the
City upon delivery to the City of marketable title and warra��ty
deecl ar�d probate deed, as the case may be, conveying fee simple absolute
title to the above�-described real estate free a�.zd clear of all en-
cu.mbrances� and it is agreed that the ta�:es payable in 1970 shall
be paid by Sell�rs , and the City agrees to pay a11 real esi�at,e
taaes which shall become due and payable in the year 1971 and .
thereafter.
3. lhe Sellers do hereby grant pexmission a.nd autizori�y Lo
the City to enter upon the above�described real estate for the pur�
pose of removing the existing dwelling at the expense of i�he City,
and the City agr�es to assume and will bear the risk of loss to the
dwelling caused by fire or vandalism between the date of the execu�
tion of this Agreemeni� and the delivery of marketable title therei�o
by and on behalf of the Sellers as pr.ovided above. �
4. � Sellers shall rema.in in possession of the land until de-
livery of marlcetable title thereto to the Ci_ty and payment of the
consideration by the City to Sellers, suUject, ho�aever, to the
right of the City to enter on the property and wreck and remove �
the existing dwelling as provided above . In the. event Sel.lers are
not able to convey rr►arlcetable title within one (1) year from the

date of the execution of this Agreement, it is understood by
and between the Parties that the City will proceed to obtain
title to the said real estate through eminent domain proceedings
� and the � City agrees that it shall not object to the entry of an
award in said proceedings in the amount of Eleven Thousand
Seven Hundred Fifty Dollars ($11 ,750 .00) , it being understood ;
- that the consideration stated herein includes the present
dwelling situated upon said property, which the City desires
to remove, as provided in paragraph 3 hereof. '

Gentlemen and Madam:
The City of Saint Paul, acting through its Valuation En�ineer, has
negotiated a purchase agreement to purchase certain property described
as follows;
Lots twenty-nine (29) and thirty (30) in Block six (6) in
Como Prospect Addition
The owners, Clara Maude Carter, Sylvester G. Caxter, Franklin T. Carter,
and Wright Ratcliff, have accepted an offer tendered them by the City in
the amount of $11,750.00, as compensation for the sale of the land to the
City.
This property, including land and buildings, is needed by the City of
Saint Paul for I,oeb Lake Park. In view of the reasonable price for
which it can be purchased, said price being the appraised fair and
reasonable market value therefore, we, the Committee on Lands, do
recommend to the Council of the City of Saint Pa.ul that it authorize
the purchase of said land in lieu of condemnation proceedings at the
price of $11,750.00, and authorize the proper city officials to execute
the said purchase agre�nent.
