Fitzpatrick to rezone from "A" to "C" Residence for the purpose of constructing an apartment development properties on the west side of Arkwright Street extended between East Wheelock Parkway and Soo Line Railway, and the east side of Edgemont Street between East Wheelock Parkway and East Hoyt Avenue, and noted in detail by the legal descriptions on file. �j �����V Zoning File �k6984 was first heard on June 4, 1970, at which time it was laid over indefinitely in order to obtain additional information. This petition was heard again on October l, 1970, along with two additional petitions involving adjacent parcels of land. Before a quorum was present, informal discussion took place on the matters. During this time, the sufficiency of the petitions was questioned because of the fact that the land under consideration was divided into three contiguous parcels for petitioning and processing. The staff reported that a legal opinion has been requested from the Corporation Counsel. It was decided to act on the petitions and let the City Council settle the question of sufficiency. When a quorum was present, the staff report was given. It disclosed that a petition is pending to vacate East Idaho Avenue from Edgemont Street to Wheelock Parkway, Arkwright Street from the railroad right.-of-way north to West Idaho Avenue, and the alleys in Blocks 1 and 4, Dawson's 5th Addition. If the vacations are approved, the combined site would have an area of approximately 140,000 square feet, permitting a development of about 140 units under "C" Residence zoning. The staff noted that the original Comprehensive Plan recommended low-density for this area but that this recommendation has been reconsidered because of soil conditions unsuitable for single-family dwellings. The site is vacant lying 5 feet below the grade of Wheelock Parkway, and 15-20 feet below the grade of the railroad right-of-way. Multiple-family structures exist several blocks southwest but single-family houses border the undeveloped area immediately surrounding the subject site. The report noted that a previous rezoning attempt for this property was denied. Mr. 0'Toole, attorney for the petitioner, stated that other apartment projects have been approved for the area and that the soil conditions on the property make the use feasible only for an apartment development. In considering the amendments, the Board noted that the Comprehensive Plan's recommendation for this area had been reconsidered because of the soil conditions. Subsequently, a motion was made to recommend approval of all three petitions subject to the conditions that: 1) the petitions are declared sufficient, and 2) the City Council vacates the streets and alleys. Resulting problems including the need for street vacations, traffic access, final street frontage for any proposed development, and the use of lands presently owned by the City and State were noted and discussed. The owner of record is Harry Doris, and the legal description of the property is Lot 12, Block 1, Fairbanks Addition. A recent inspection indicates the following: Building Classification: Single family frame dwelling. Exterior: Some evidence of decay is in siding and cornice. Basement: Appears structurally sound. First and second floors: Some signs of vand,alism, but in general in good condition. Attic: Signs of vandalism. Plumbing, heating and electrical systems : Intact. Gara e: In poor condition and presents an attractive nuisance. The subject property has been boarded up by the city since September 29, 1970. A letter received from the owner's attorney on :September 10 indicates that the Housing and Redevelopment Authority is negotiating to purchase the property.
