This is written in response to the petitions of Philip W. Fitzpatrick to rezone from
"A" to "C" Residence for the purpose of constructing an apartment development properties
on the west side of Arkwright Street extended between East Wheelock Parkway and Soo Line
Railway, and the east side of Edgemont Street between East Wheelock Parkway and East Hoyt
Avenue, and noted in detail by the legal descriptions on file. �j

Zoning File �k6984 was first heard on June 4, 1970, at which time it was laid over
indefinitely in order to obtain additional information. This petition was heard again
on October l, 1970, along with two additional petitions involving adjacent parcels of
land. Before a quorum was present, informal discussion took place on the matters. During
this time, the sufficiency of the petitions was questioned because of the fact that the
land under consideration was divided into three contiguous parcels for petitioning and
processing. The staff reported that a legal opinion has been requested from the Corporation
Counsel. It was decided to act on the petitions and let the City Council settle the question
of sufficiency.
When a quorum was present, the staff report was given. It disclosed that a petition
is pending to vacate East Idaho Avenue from Edgemont Street to Wheelock Parkway, Arkwright
Street from the railroad right.-of-way north to West Idaho Avenue, and the alleys in Blocks
1 and 4, Dawson's 5th Addition. If the vacations are approved, the combined site would
have an area of approximately 140,000 square feet, permitting a development of about 140
units under "C" Residence zoning. The staff noted that the original Comprehensive Plan
recommended low-density for this area but that this recommendation has been reconsidered
because of soil conditions unsuitable for single-family dwellings. The site is vacant
lying 5 feet below the grade of Wheelock Parkway, and 15-20 feet below the grade of the
railroad right-of-way. Multiple-family structures exist several blocks southwest but
single-family houses border the undeveloped area immediately surrounding the subject site.
The report noted that a previous rezoning attempt for this property was denied.
Mr. 0'Toole, attorney for the petitioner, stated that other apartment projects have been
approved for the area and that the soil conditions on the property make the use feasible only
for an apartment development.
In considering the amendments, the Board noted that the Comprehensive Plan's
recommendation for this area had been reconsidered because of the soil conditions.
Subsequently, a motion was made to recommend approval of all three petitions subject to
the conditions that: 1) the petitions are declared sufficient, and 2) the City Council
vacates the streets and alleys. The motion carried unanimously.

A. SUFFICIENCY: In a letter dated 5/7/70, the Co�rsnissioner of Finance declared this
petition sufficient with the ownera of 89% of the frontage of the rezoned property
has signed the petition and the ownera of 12 of a possible 18 descriptions of real
estate within 100 feet having aigned. A cursory review of the petition revealed
an error in the number of parcela eligible and the percentage of frontages signed
for. A recheck by the Department of Finance corrected the figures to read: the
petition is sufficient with the owners of 61% of the frontages to be rezoned
having signed the petition and the owners of 12 of a possible 17 (70%) of the
parcels within the prescribed 100 feet having signed the petition. However, the
petition actually has the same signature as the owner of the necessary frontage
and the owner of the described parcels necessary for a sufficient petition.
B. HISTORY: None for this site.
C. PROPOSED USE: Construction of an apartment building.
D. AREA: The property consists of three parts totaling about 47,000 square feet.
E. AREA ZONING: The immediate area is zoned "A" Residence although the property
across the railroad right-of-way from this site is pending "C" Residence.
Multiple-family zoning exists one-fourth mile and over to the southwest.
r. COMPREIIENSIVE PLAN: The Comprehensive Plan calls for aingle-family use of this
site and the surrounding area.
G. SITE CONDITIONS: The site is vacant and about 5 feet below the grade of
Wheelock Parkway. The railroad right-of-way abutting on the southeast. is
about 15-20 feet above the level of this site.
H. AREA CONDITIONS: Post-war low-density residences exist north of Wheelock
Parkway, along the south edge of the parkway and easterly across the railroad
right=of-way. Multiple-family exists farther to the southwest. This immediate

Mr. Sorenson noted �hat the petitioner does not own all the nroperty that
is included in this rezoning. The Board looked over the pe�ition form.
Mr. Sorenson summarized the stafi report noting that a review of ti�e
petition revealed an error in the numbex of parcels eligible and the

at rezoning. This rezcr�ing, if granted, would conatitute spot zoning.
Mr. Maietta asked wYaether the street w�.il b� graded; Mr, Sorenaon said thst
is always a possib�.lity, alth�ugh xt seems unlikely. Ae noted that the
smallest af the �hxee parcels aa�uld be large en�ugh only for a sfng?e-family

Representing the petirioner was Gerald Qkoneski, whn noted that plans sre
to vacate Idaho Avenue; Cherefore, frontage would be to Wheelock Parkway.
Part of the property is owned by the State of Mfnnesota, but the pet�tioner
wi1Z attempt to acquire that parcei.
Mr. Ames suggested t� the repres�ntative that the petitioner would have a
much better chance of rezoning this propprty if. all these problems are
resolved before the Zoning Iioard has to m�ke a rec�une�dation. Mro Ukoneski
replied that he feels �he vacating of Ydah� Avenue wilL �ave no Uesring on
the frontage since the froat-age is on Wheelock Parkway. Re noted that the
land is not suitable for single-family development since it is a swsmp 1and.

by the City and State were noted and discussed. Subsequently, the Board of Zoning
laid this matter over indefinitely so that more complete information could be
obtained including the adequacy of street frontage to qualify this petition as
sufficient.
We, therefore, request that your office provide further explanation on the
sufficiency of this petition including the use of alleys and streets of less than
30 feet width in determining the required frontage. (See Sections 63.18 and
64.06 of the Legislative Code)

Gentlemen:
The Building Department is hereby submitting its report on the
condition of the structures at the above location.
The owner of record is Harry Doris, and the legal description
of the property is Lot 12, Block 1, Fairbanks Addition.
A recent inspection indicates the following:
Building Classification: Single family frame dwelling.
Exterior: Some evidence of decay is in siding and cornice.
Basement: Appears structurally sound.
First and second floors: Some signs of vand,alism, but in
general in good condition.
Attic: Signs of vandalism.
Plumbing, heating and electrical systems : Intact.
Gara e: In poor condition and presents an attractive nuisance.
The subject property has been boarded up by the city since
September 29, 1970.
A letter received from the owner's attorney on :September 10
indicates that the Housing and Redevelopment Authority is negotiating to purchase
the property. However, Mr. Del Hoppe of HRA stated in a telephone conversation
with Mr. Blue of this office that it would be at least two months before they could.

The attached copy of a petition for rezonin� was suhmitted to the Finance De-
partment for a report o€ sufficiency of signatures, was reported sufficient to
the City Council and referred to the Board of Zoning for further investigation
and report back to the City Council, as provided in Section 64.06 of the Legis-
lative Code.
The Board of Zoning discussed the proposal during which the question arose as to
the legality of the petitioner to request the rezonind of land other than his own,
without the other owners joining in the petition.
As you will see from the attached plan, the petitioner owns and signed for parcel
noted as narcel 1, with parcels designated 2 and 3 being owned by S. A. I�orrig�n
and 0. A. Assen respectively, and not si�ned for in the petition.
If your answer is in tne affirmative, that the procedure followed by the �etitioner
is correct, I will then ask your opinion as to the use of alleys or streets af
less than 30 feet in width in determining frontage. (Sections 63.18 and 64.06 of
the Legislative Code) .
This specific petition is unususl, in that the three parcels are separated from
each other by Idaho Avenue on the north and that portion of platted Arkwright
Street which is 25 feet in width, whereby Section 63.18 defines "street" as being
34 feet or more in width, and the fact that all of the property in the petition
is not signed for.
