Whereas, The Couneil of' the City of Saint A�ul has duly
canvassed the returns of the votes cast at the City Special Election
held in said City on the 3rd day of Novemb�er, 1970, upon the
ratification or rejection of an Amendment to the City Charter
providing for reorganization of City government and separation of the
powers of ma.yor and counciZ effective June 6, 1972, and
Whereas, It appears from said returns and the canvass thereof
that 50,1l�.2 voted in favor of the adoption of' said Amendment to the
City Charter and 34,420 voted against the adoption thereof, and
Whereas, Minnesota Statut�s, Section 410.12, provides that
such �xnendment to the City Charter must be approved by a. 51� vo�e of
those_ lawfully voting thereon, and 59.29� .x�f those lawfully voting
thereon voted in favor of such approval, therefore, be it
Resolved, That said Amendment to the City Charter is hereby�
declared to have received in excess of 51� favorable vote� of tha
votes cast at the said City Special �lection, and to have been
adopted, and be it
Resolved Further, that a certified copy of the Amendment
and a eertified copy of this resolution, signed by the Mayor and the r--
City Clerk, shall be filed with the Secretarg of State of the State
o� Minnesota, and a certified copy of the Amendment and a certified
copy of this resolution, signed by �he Mayor and t he City Clerk, be
recorded with the Register of Deeds of Ramsey County, State of
Minnesota.

The annexed is a draft of proposed amendment to be made to
the Charter of the City of Saint Paul , made, framed and adopted
by the Charter Commission of the City of Saint Paul , appointed
pursuant to Section 4, Article 11 , of the Constitution of the
State of Minnesota, and the laws and statutes enacted pursuant
thereto; and said draft of said proposed amendment is hereby trans-
mitted to you as Chief Executive of the City of Saint Paul, signed
by the undersigned majority of said Charter Commission, to be
submitted to the qualified voters of said City for ratification
in the manner provided by law.

CHAPTER 1
NAM� AND GENERAL POWERS
Sec . 1 . 01 . Name and Boundaries. The City of Saint Paul in
� the County of Ramsey and State of Minnesota, contained within the
limits and boundaries hereinafter described, shall continue to be
a inunicipal corporation under the name, City of Saint Paul , with
the existing boundaries as follows :
Beginning at the northeast corner of section twenty-three,
township twenty-nine north, range twenty-two �vest (Sec. 23, T. 29 -
N. , R. 22 W. ) of the Fourth Principal Meridian, thence west seven
and one-half ('72) miles to the northwest corner of the northeast
quarter of section twenty-two, township twenty-nine north, range
twenty-three west (N. E. 4 Sec. 22 , T. 29 N. , R. 23 W. ) ; thence
south one-quarter (4) mile to the northeast corner of the southeast
quarter of the northwest quarter of section twenty-two (S. E. 4

Sec. 1 .02. ��1ards. The council may, by ordinance, provide for

the establishment of wards , def!ine or change their boundaries, and
inciease or elimi_nate the number of wards in the city; but no change, '

Sec. 1 . 03. Potiaers . The city shall have all powers which it
may no�,� or hereafter be possible for a municipal corporation in this
state to exerc�se in harmony with the constitution of 1;he State of
Minnesota and of the United States . I�t is the intention of this
ch.�rter �tliat every poiver which the people of �he city might latafully

Sec. 1 .04. Di_stribution of Po��Ters. Except as other�4�ise provided
� in this charter or by la�a, the po�aers of the city shall be vested �
in an elective chief executive, the mayor, and an elective legislative
body, the council . Tlle mayor shall exercise all powers and per�orm
all executive duties given to the office of mayor by i;his charter, �
the ordinances of the city and the las��s of the state. The council
shall exercise the legislative powers.
Sec. 1 .05. Charter a Public Act. This charter shall be a
public act and need ilot be pleaded or proved.

CHAPTER 2 �
ELECTIVE OFrICIAL5
Sec. 2. 01 . Elective O�ficials . There shall be a mayor and �
seven councilmen, elected by the voters of the city at large, and
such judges and other officials as are provided by statute, elected
as provided therein.
� Sec. 2.02. Terms. The mayor and each councilman shall hold
o�fice for a teim of two years commencing on the first Tuesday in
June next succeeding their election, and until a successor is elected
and qualifies.
Sec. 2.03. Time Devoted to Duties . No employee or officer
of the city shall , duiing the hours of his employment, perform any.
service or do any work except for the city, and shall , during such �
hours, devote all his effor�;s and time to said city.
Sec. 2.04. Vacancy. An elective office becomes vacant when
the incumbent dies , resigns by a writing filed with the city clerk,
is convic'ced of a felony, ceases to reside in the city, or is adjudged
incompetent by a court of competent jurisdiction.
Sec. 2.05. Fillin� of Vacancies . If an elective office becomes
vacant, the council shall elect a qualified voter of the city to
fill the same for the remainder of the unexpired term. If a tie
vote occurs in the filling of a vacancy in the office of councilman,
the mayor shall vote to break the tie.
Sec. 2.06. Judge of �`ualifications. The council shall judge
the qualifications of the mayor and of its own members to take office,
and shall be the judge of the election returns .

Sec . 2.07. Compensation. The annual salaries of the mayor
shall be �15 , 200, and of each councilman �14,000, payable in
installments as the council shall direct. `

THE NIAYOR
Sec. 3.01 . Powers and Duties. The. executive power shall be
vested in the mayor. Subject to the provisions of this charter
and the ordinances , he shall control and direct the administration
of the city' s affairs. Without limiting the generality of the fore-
going, he shall have the follo�aing powers and duties:
Sec. 3.01 . 1 . He shal.l see that this charter and the laws and
ord��,nces are enforced.
Sec. 3.01 . 2. He shall have the right to attend and particip�,te
in counci_1 meetings with the right to take part in the discussion,
but shall not vote except as otherwise provided herein. He sYiall ,
. make recommendations to the council and deliver messages to the
council and the people, including a comprehensive message on the
state of the city as soon after the beginiiing of his term as practicable.
Sec. 3.01 . 3. He shall appoint, with the advice and consent
of the council , the city attorney, the city cZerk, the fire chief,
and all heads of executive departments, who sliall serve at his pleasure,
except as provided in Section 9.02.
Sec. 3.01 . 4. He sha, ll direct and supervise the adminis�tration
of all departments , offices , and agencies of the city, except as
otherwise expressly provided herein.
Sec. 3.OI . 5. He shall prepare and recommend to the counci].
the budgets as provided in Section 10.03.
Sec. 3.01 .6. With the consent of the council, he shall appoint
and may remove a secretary and such professional assistants as the
council may provide; and he slzall ap��oint and may remove , subject
to applicable civil service provisions , such ottier employees in ,

the mayor' s office as are provided �or by the couiicil .
Sec. 3. 01 .�. He shall approve or veto ordinances and resolutions
as provided herein. " �
Sec. 3. 01. 8. He shall , with the advice axid consent of the
council , appoint members of boards and commissions and such advisory
committees as are established by him or by the council , who shall
be removable as provided in the instrument establishing sucli board,
commission, or• committee.
Sec. 3. 02. Actin� Ma,yor. The mayor shall designate, with the
advice and consent of the council , an appointive officer or employee
of the city to serve as acting mayor during the absence or disability
of the mayor, subject al�aays to the mayor ' s control and direction. "
If a vacancy occurs in the office of mayor, the person so designated
shall exercise th'e po��ers and perform the duties of the office until
a successor is elected by the council .

� . TIiL COUATCIL
Sec. 4 Ol . Legi.slative Power. The legislative pozver shall
be vested in the council , �vhich shall be composed of seven council-
men.
Sec. 4. 02. Quorum and Rules . A majoi•ity of �;he council shall
cons�;itute a quorum, but a smaller number may adjouin from time
to time and compel the attendance oi' absent itiembers under such terms
and penalties as tlie council may prescribe. The council shall
determine its own rules and order of business and shall keep a
journal of its proceedings. T11e journal sha11 be a public record.
Sec. 4.03. Or�ailization�l Tieetin� and Olficei s. At the first
' meeting after takii�g of�ice, or as soon theieafter as practicable,
the council shall elect from its members a president and a vice- .
president. At the same time, the council shall elect a secretary -
o� �;he council , who shall not be a mem���er of the council , or it may
designate t11e city clerk or otlier officer or employee to act as
secretary. Tlie officers �of the council and the seci etary of the .
council shall ser��e .at the pleasure of tlie council .
Sec. 4. 04. Business Meetin�s. The council shall hold regulai
meetings at the city hall 10: 00 a.m. on at least four (4) separate -
days each week. The president of the council may call special
meetings of the council , and the secretary of the council shall
do so on written request signed by four councilmen. Special meetings
may be held anytiahere within tYie ci1;y. Notice of the time and place
of special meetings shall Ue served upon each member of the council
and the mayor in a manner prescribed by the council . The business
conducted at the special meeti_ngs sha_il be confined to that stated
in the notice. 8

Sec. 4. 05. rleetin�s and I�ecords Public. Al1 meetings of the
council , boards , committees and officer. s, whe�i;her elected, appointed
or employed, shall be opeil to �Lhe �public under regulai;ions fiaed
by administrative ordinance. Al1 proceedings, records, and documents
belonging to the city shall Ue accessible to the public undei
restrictions fi�ed by ordinance. All such proceedi_ngs , recoids,
and documents shall be prima �acie evideilce of the facts therein
stated and copies, tahen certified by the person entitled to the official
custody theieo�, shall be received in evidence in al1 courts tvith
the same force and effect as the original .
Sec. 4. 06. Employees of the Council . The council may provide
by administrative ordinance for positions it deems necessary for
the performance of its duties.
Sec. 4.07. In�resti�ations . The couilcil may make iiivestigations
into the affairs of the city and the conduct � of any departmeizt, of�ice,
or agency and for this purpose shall have the powei to administer
� oaths and require the presence of witnesses and production of evidence
� by subpoenas obtained by order fronz the District Court on api�lica�ion
from the council . ' .
Sec. 4. 08. Indepenclent Audit. The council shall provide �or
an annual indepeiident audit of all city accounts and may p.rovide
�oi such additional audits as it �deems necessary. Any audi_t of

or other s�;ate o�ficei c3esignai�ed Uy la�•r shall be deemed an
independent audit.

CHAPTER 5.
TH� CITY ATTORN�Y
Sec. 5 .01 . Appointments and Qualifications . The city attorney
shall be appointed and removed as provided in Section 3. 01 . 3. Prior
to his appointment he shall be admitted to practice before the
Supreme Court� of the State of Minnesota.
Sec. 5.U2. Poi,�ers and Duties. The city attorne3= shall repr�sen�i;
the city in all causes in ���hich the city is interested and shall
( have �ull and complete charge of the legal business of the city.
No officer of the city may retain or �ee any otlie�� attainey, provided
that in an3T case of special oi unusual ciicumstances or in any case
where the city attorney by reason of iilterest cannot represent the
'city, the council , upon the request of the city attorney, may by
resolution appoin�; special counsel and fia liis compensation.
Sec. 5. 03. Staf�. The city attorney may appoin�; tt��o deputy
assistan�s and such other assistants as �in his judgment are needed
to carry on the legal business of the city. The deputy assi_stants
and othei assistants shall be in the unclassi�ied service. The
deputy assistants shall 11o1d office at the �leasure of the city
attorney, and the other assistants shall be removable at pleasure •
during their i'irst year of service, but shall no� thereafter be

Sec. 6.06. Emer�ency Ordinances. To meet a sudden or unforeseen

not levy taxes, authoi ize �;he issuance of bonds , giant, reneta, or

the form aizd manner prescribed for ordizlances geiieially except that

All oidinances other than emergency orclinances shall become efi'ective
thirty da3Ts after passage, approval , and publication once in the
official newspaper unless a later date is specii'ied therein.
� Sec. 6. 12. Codification. Tlie council shall provide for �;lze
compilation of legislative ordinances in a legislative code and

CHAPTER 9 �
�XECUTIVE DEPAHTMENTS
Sec. 9.01 . Execut;i.ve Departments . There shall be an office �
of the mayor, office of the city attorney, office o� the city clerk
and such additional executive departments, not to exceed si�, as
may be estaUlished by ordinance. �ach executive department so
established shall have such functions as are prescribed by ordinancea
and its head, .who shall be appoirited and removed as provided by
Sec. 3.01. 3, shall have such educational and professional qualifica�;ions
as may be prescribed by ordinance. Every office, agency, or function
of city government not otherwise assigned by this charter or by -
ordinance shall be included in the office oi' the mayor; and no power
or duty confeired by this charter upon a particular office or agency

Sec. 9.02 . Tel°ms of Officers in iJnc.lassified Service. The
fire chief shall serve for a term of two years concuirent with that

in advance. The council may revise the budgets but may not reduce
the appropriation� for deb�i; service and for meeting any e�isting

� Sec. 13. 03. 3. Passa�e of Title--Deposit.
1 . Should the council deem i�; necessaig� it may after
the date of the "final order, " direct by reso�ution the payment
of a sum of money into the Distriet Court to secure compensation
to the o�aner of the property or iiiterest in property being condemned,

Sec. 18.08. Eff.ective Dates. This cha,tter shall become effective
as follo�as :
Sec . 18. 08 . 1 . At �he 1972 city election there shall be elected
a maS�or and seven councilmen. Otherwise, such election shall be
colzducted in accordance with law and charter as it exi.sts at tlie
time of suclz election, except that no comptroller shall be elected.
Sec. 18.08. 2. The mayor and council rnay exeicise the potaers
con�erred by Sec . 18.09. 1 immediately upon the adoptioii of this
charter by the voters.
Sec. 18. 08. 3. All other provisions of this charter shal.l
become effective Jun.e 6, 1972.
Sec� 18.08. 1f. Except as provided in Sec. 18.09. 2, the chaiter
of the city of Sain� Paul as it existed June 5 , 1972, is repeal.ed

Sec. 18.09. Transition. The transition fiom the present char�;er
of city of Saint Paul to this chaiter shall be accomplished as follows:

June 6, 1972, estaUlish executive departments , prescribe their functions,
and provide for the qualficatioils , salaries, and po�aers of department

poweis and duti_es as they existed under the previous charter of the

All other o�fices and agencies of the city sti�hich existed June 5 ,
1972, shall become part of the office of the mayor.
Sec. 18:09. 3. Until ordiiiances are adopted fixin� the salaries
and qualifications of department heads , the niayor shall , with the
advice and consent of the council , designate from among �;he employe�s
of the city persons to serve as acting heads of the r. espective
depar�;ments , who shall retain throughout such service their positions ,
if any, in the classified service , and return thereto when removed
as acting depaz°tment heads.
Sec. 18. 10. The of�ices of Comptroller and o� tYie Commissioners
of the respective departments as th.ey e�isted on June 5 , 1972, shall
cease to exist June 6, 19'72. Thereafter, where any law imposes any
power or duty speci�ically upon any official of the city of Saint Paul
whose positioii shall have ceased to exist by reason of the adoption
of this charter, such power or duty shall be exercised or perf'ormed
by such officers and employees of i;he city as the mayTor, with the
advice and consent of the council , may froni time tp time designate .
