03-37RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By Referred to Committee: Date 1 WI3EREA5, the City of Saint Paul has sponsored a family ice fishing event for a number 2 of years, and is planning such an event for February 1, 2003, at Round Lake, located in the City 3 of Maplewood, Ramsey County; and 4 WHEREAS, the Ramsey County Sheriffls Office has jurisdiction over the County's lakes 5 and waters, and is willing to permit the use of Round Lake for such an event on the condition that 6 the City of Saint Paul indemnify and hold hannless the County; and 7 WHEREAS, the Saint Paul City Council finds that a family ice fishing event has a 8 legitimate public purpose; and 9 WHEREAS, the expenditure of public fixnds, which includes the promise of 10 indemnification and defense, £or such a purpose will facilitate and enable the event to take place; 11 12 13 14 15 16 now, therefore, be it FURTHER RESOLVED, that the faregoing defense and indemnification does not cover: 1) any occurrences or events which are not part of the ice-fishing event and which do not occur or take place at Round Lake during the course of the event. 2) injuries or damages which arise from hidden traps or conditions exisring on the grounds surrounding Round Lake of which the county had actual or constructive notice.
