1 WHEREAS, the City of Saint Paul has plans to improve Fillmore Avenue between Livingston
2 Street and Wabasha Street in conjunction with the U.S. Bank and West Side Flats Developments; and

5 WHEREAS, the improvement of Fillmore Avenue includes establishment of a railroad grade crossing
6 on Fillmore Avenue 425' east of Wabasha Street where Fillmore Avenue crosses the Union
7 Pacific Railroad track; and

9 WHEREAS, the City desires to enter into an agreement with the Union Pacific Railroad which
10 defines engineering, administration, construction and cost participation responsibilities for
11 establishment of the railroad grade crossing; Now therefore be it,
12
13 RESOLVED, that we hereby authorize the proper city officials to sign the agreement.
