THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. Blees to rezone from "B" to "C" Residence to continue operating as a tri-plex property located on the southwest corner of Burr Street and Case Avenue, and more fully described as: North 10 feet of the east 98 feet of Lot 11, and the east 98 feet of Lot 12, Block 9, Edmund Rice�s - ,, . ��irst �ddition. - This matter was considered at the August 20, 1970, Board of Zoning meeting. The staff report noted that the City Architect, in a letter dated June 6, 1969, notified the petitioner that the structure, with one apartment on the first floor and two on the second, is in violation of the Zoning Code. The property, with frontages of 98 feet on Case Avenue and 46 feet on Burr Street result in an area of about 4,500 square feet. The surrounding area is zoned "B" Residence except for this intersection which has one lot zoned Commercial and another lot that is used as a gas station. Staff conclusions noted that the structure, although basically sound, may be detrimental to the area because of deteriorating conditions, age, and extreme high density. The potential for other conversions in the area is high, and if this rezoning is granted, an appeal of the density standards with a 35 percent variance would still be required to legalize the use. The staff noted that if the rezoning is to be granted, that a negative easement be attached restricting the "C" Residence use to the life of the present structure, the occupancy of the present owner, and should be conditioned on continuous compliance of all City codes. The petitioner and his wife, Mr. and Mrs. Frederick J. Blees, noted that the house was converted in 1937 and in 1942 bathrooms were installed, as well as gas and electrical service with no restrictions . They reported that nobody has ever complained, and that the neighborhood considers this an apartment building. Mr. Blees felt that the City has an obligation to tell citizens when a conversion should not be made, and that he feels that density is not a factor. Mrs . Blees stated that they bought the home in 1961 and were not told by the attorney or real estate man that it was in violation. The petitioners presented a letter from the Phalen Area Neighborhood Improvement Program which noted no opposition to the rezoning. The Board, in discussing this matter, noted that the City will undoubtedly receive more petitions like this during the course of inspections by the Building Department. �� ��1 -1- � � O , . Mr. Harry E. Marshall (continued) September 9, 1970 It was noted that the petitioner could have up to five sleeping rooms with a duplex under the present zoning. The intense hardship to the present owner of this type of structure was again noted, as was the drastic density relaxation that would be required if the use is to continue. It was noted that the requirements of the Zoning Code are fair and reasonable, and that this use is incompatible with the rest of the neighborhood. Subsequently, it was moved and seconded to recommend denial of this petition to rezone to "C" Residence. The motion passed by a 4-1 vote. Very truly yours, PETER J. Mr, Sorenson sumna�ized the sea£f r�port, a part of the file, and noted the following conclusians: this structure, �lthough basically sound, may be detrimental to the �,area bec��ase of age, deteriorating conditions, and estreme high density. The 'potenti�l for other convers�ons in the area ia high, but would prob�bly not �e a problem without a houaing shortage. This property is 357. short of the', minimum are� required by 4:he Code, even if rezoned. Adequate parking ext�sta for only two cars. The property has owner occapancy, and if this is apprQved, ttae use should be restricted to the life of the present atructure, �he occupsncy o£ the preaene own.er, and should be conditiaued on cont�auous compl.iance to all Code requi.rements.
