An ordinance amending the Zoning Code, Chapters
60 to 64, inclusive, of the Saint Paul Legislative
Code, pertaining to Use Districts, Height Districts
and Rezoning of certain properties in the City of
Saint Paul, as amended.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64, inclusive,
of the Saint Paul Legislative Code, pertaining to Use Districts,
Height Districts, and Rezoning of certain properties in the City
of Saint Paul, as amended, be and the same is hereby further amended
so as to rezone the following described property from "B" Residence
District to "C" Residence District, to-wit:
North 10 feet of the east g8 feet of Lot
11, and the east 98 feet of Lot 12, Block
9, Edmund Rices first addition to St. Paul;
situate on property located on the southwest corner of Burr Street
and Case Avenue in the City of Saint Paul.
Section 2. This ordinance shall take effect and be in force
thirty (30) days from and after its passage, approval and publication.

This is written in response to the petition of Frederick J. Blees to rezone
from "B" to "C" Residence to continue operating as a tri-plex property located
on the southwest corner of Burr Street and Case Avenue, and more fully described as:
North 10 feet of the east 98 feet of Lot 11, and
the east 98 feet of Lot 12, Block 9, Edmund Rice�s

This matter was considered at the August 20, 1970, Board of Zoning meeting.
The staff report noted that the City Architect, in a letter dated June 6, 1969,
notified the petitioner that the structure, with one apartment on the first floor
and two on the second, is in violation of the Zoning Code. The property, with
frontages of 98 feet on Case Avenue and 46 feet on Burr Street result in an area
of about 4,500 square feet. The surrounding area is zoned "B" Residence except
for this intersection which has one lot zoned Commercial and another lot that is
used as a gas station. Staff conclusions noted that the structure, although
basically sound, may be detrimental to the area because of deteriorating conditions,
age, and extreme high density. The potential for other conversions in the area is
high, and if this rezoning is granted, an appeal of the density standards with a
35 percent variance would still be required to legalize the use. The staff noted
that if the rezoning is to be granted, that a negative easement be attached
restricting the "C" Residence use to the life of the present structure, the
occupancy of the present owner, and should be conditioned on continuous compliance
of all City codes.
The petitioner and his wife, Mr. and Mrs. Frederick J. Blees, noted that the
house was converted in 1937 and in 1942 bathrooms were installed, as well as gas
and electrical service with no restrictions . They reported that nobody has ever
complained, and that the neighborhood considers this an apartment building.
Mr. Blees felt that the City has an obligation to tell citizens when a conversion
should not be made, and that he feels that density is not a factor. Mrs . Blees
stated that they bought the home in 1961 and were not told by the attorney or
real estate man that it was in violation. The petitioners presented a letter from
the Phalen Area Neighborhood Improvement Program which noted no opposition to the
rezoning.
The Board, in discussing this matter, noted that the City will undoubtedly
receive more petitions like this during the course of inspections by the Building
Department.

It was noted that the petitioner could have up to five sleeping rooms
with a duplex under the present zoning. The intense hardship to the present
owner of this type of structure was again noted, as was the drastic density
relaxation that would be required if the use is to continue. It was noted
that the requirements of the Zoning Code are fair and reasonable, and that
this use is incompatible with the rest of the neighborhood.
Subsequently, it was moved and seconded to recommend denial of this
petition to rezone to "C" Residence. The motion passed by a 4-1 vote.

A. SUFFICIENCY: The Commissioner of Finance, in a letter dated March 5, 1970,
declared the petition sufficient with 10 of 15 (66 2/3%) of the parcels
represented by signature.
B. HISTORY: No previous zoning files on this site. The City Architect, in a
letter dated June 6, 1969, to the owner noted that there exists one
apartment on the first floor and two on the second in violation of the
Zoning Code.
C. PROPOSED USE: The petition proposes to continue the three-plex use, if rezoned .
D. FRONTAGE AND AREA: The property has frontages of 98 feet on Case Avenue and
46 feet on Burr Street, reaulting in an area of 4,508 square feet.
E. AREA ZONING: The surrounding area is also zoned "B" Residence except for one
lot zoned Commercial across Burr Street on the southwest corner of the
intersection.
F. COMPREHENSIVE PLAN: The plan calls for residential use including single-family,
duplex, town and row houses at a maximum density of 15 dwellings per acre.
G. SITE CONDITIONS: The site is level and 2-3 feet above the grade of adjacent
streets and is occupied by an older two-story brick structure.
H. AREA CONDITIONS: The surrounding area is occupied by primarily one and two-
family residential uses. Retail commercial uses exist across Burr Street
and a new consolidated elementary school site is one block to the northwest.

FRSDERIGK J. BLEES* A petitio�x ta rezone from "B" to "C" Residence to a11ow
continuation of a tri-plex on property located on the southweet corner of
Burr Street and Case Avenue.
Mr, Sorenson sumna�ized the sea£f r�port, a part of the file, and noted the
following conclusians: this structure, �lthough basically sound, may be
detrimental to the �,area bec��ase of age, deteriorating conditions, and estreme
high density. The 'potenti�l for other convers�ons in the area ia high, but
would prob�bly not �e a problem without a houaing shortage. This property
is 357. short of the', minimum are� required by 4:he Code, even if rezoned.
Adequate parking ext�sta for only two cars. The property has owner occapancy,
and if this is apprQved, ttae use should be restricted to the life of the
present atructure, �he occupsncy o£ the preaene own.er, and should be
conditiaued on cont�auous compl.iance to all Code requi.rements. If this
rezoning is granted,; an appeal would fs�llow since there is a 357a variance.
FoZlowing a qu�stiori £rom the Soard, Mr. Sorenson noted that a legel opinion
would be needed Co d��etermiae wheCher 3 ar 5 parking spaces would be required,
The petitioner, Mr. �'rederick .J, Bleea, noted that the house wasa't buiYt
this way; it was con�erted in 1937. In 1942 bathrooms were installed; a
gas meter mnd electrical meter were installed with na reatrictiona. He
noted that nobody ha$ ever complained; the neighborliood has considered this
an apaxtment buildin�. I� ts his beli�e£ that the Cftq has an obligation to
tell citizeas when e conversion shuuAd not be made. He noted thst a �+-plex
was made aut of g duplex near�y since others already existed in the neighborhaode
He stated he daesn't 'feel density ia a factor. Mr. Soreason explained the
difference between overcrowding of a strucCure and �overcrowding of the eite
es conCrolled by the Zoning Code.
The petitionez's wif� noeed f,t w�sn't their faalt sinc� they purchas�ed it the
way it is.
Mr. Blees said 4 or 5 �,people occupy the apar�ment units. He pxesented a letter
from Mr, Hsrold S� YannareLly, Projec� Sup�rvisor of the Phalen Ares Neighborhood
Improvemeat Program, w�ho noted no opposftion to th.e rezoning.
Mrs. Bleea ststQd thep' bought the �ome in 1�61 snd were not told by the attorney
or real es�aCe men that it w�s in violation. The titl.e was brought up-to-date
in 1951.
Mr. Gauger noted that �he Zaning Board will �nao����a�y rece�tve more petitioas
like this when other h�m�s are inspec�ed B�y the Buitdiag Department.

Upon a �uestion by Mro Doody, Mr. 5orenson noted that this structure could
be a duplex, plus could conCa�� up to five sleeping r�ocna.
Mr, McPartlin moved for deniel af t�e petitio�, noting that � drastic densiCy
relaxation is required which is absvintely incomp�tible �ith the rest of the
neighboxhood. He stated Che Zoning Code fs fair �nd reasonable, and fails
to see any hardahip in Chis case. The motion was s�conded by �Sr, Gadler,
and carri�d by a 4-1 vote. Mr. Doody voted in �pposition stating it was not
the �ault af these people �nd that he would like to eee the asa maintsined.
