RESOLUTION TO AMEND TFIE CITY OF SAINT PAUL'S 2003 CAPITAL IMPROVEMENT
BUDGET FOR THE CITY'S OVI'DOOR PUBLIC FARMERS' MARKFT UPGRADE AT FOURTH
AND WALL STREETS AND FOR ACCEPTANCE OF PRIVATE FUNDS FROM THE FRIENDS OF
THE ST. PAL3L FARMERS' MARKF;T FOR THE PROJECT.
WI�EREAS, in the last year and a half, the Friends' of the St. Paul Fanners' Market ("Friends") have
led a Capital Campaign for the upgrade of the existing public outdoor Market at Fifth and Wall 3treets ("the
ProjecY') , attached in Exhibit A, for the benefit of the citizens of 5aint Paul; and
WI3EREAS, the Friends have received pledges and future pledge conhibutions totaling $1,668,917 of
non-public money for the outdoor market upgrade, including $1,448,900 through June 30, 2003; and
WHEREAS, the Friends, St. Paul Growers Association and the City of St. Paul wish to upgrade the
City's outdoor mazket with current available funding; and '

WIIEREAS, a Neighborhood STAR loan of $600,000 was approved for the Outdoor Farmers' Market;
W�iEREAS, the enrire spending budget for construction of the market will be included the 2003
Capital Pro}ects Fund; and
WHEREAS, the Mayor, pursuant to Section 10.07.1 of the Charter of the City of Saint Paul, does
hereby certify that $2,048,900 in funds are available for appropriation in excess of those estimated in the 2003
Capital Improvement Budget and recommends the following changes to the 2003 Capital Improvement
Budget;

BE IT RESOLVED that the City Council of Saint Paul, Minnesota approves the above budget
authorization and acceptance of private funds and pledges from the Friends; and
BE IT FURTHER RESOLVED that the City of Saint Paul has not violated any Federal, State or local
laws pertaining to fraud, bribery, gra8, kickbacks, collusion, conflict of interest or other unlawful or corrupt
practice; and
BE IT F[JRTHER RESOLVED that the City as Project Manager, subject to the approval Office of Financial
Services, may enter into an agreement with the Friends for the above-referenced project, and that the City
certifies that it will comply with all applicable laws and regulations as stated in all contract agreements; and
BE IT FURTHER RESOLVED, that City of Saint Paul's Department of Plauning and Economic
Development will provide assistance, as requested by the Project Manager, in the implementation of the 2003
construction project and processing of STAR expenditures; and
BE IT FURTHER I2ESOLVED, that the City, subject to the approval of Offices of Financial
Services, hereby authorized to execute such agreements with the Friends as aze necessary to implement the
project on behalf of the City of Saint Paul; and
