RESOLVED, That the Council hereby ratifies and approves the
action of the Saint Paul Board of Appeals and Review for the Housing,
Building and Fire Prevention Codes pertaining to the following
listed properties and as shown by the official minutes of said
Board of Appeals dated August 26, 1970, a copy of which, marked
EXHIBIT "A" is attached hereto and made a part hereof by reference.

PRIOR HEARING: Meeting No. 36 , August 12, 1970 .
SUBJECT: Letter dated April 22, 1970 , Order to Vacate dated
July 29 , 1970 from the Bureau of Health to Mr. James Boyd and per-
taining to the property located at 796 Capitol Heights .
APPEARANCES: James H. Boyd, Raymond T. Engle.
PROCEEDINGS: Mr. Boyd made a summary statement saying the property
had been acquired 50 years ago. He himself had lived there and
was the caretaker for some time. He managed the property for
several years . Pres�ntly Clapp-Thc�mssen manages the property.
A couple of years ago a new heatinq system and aluminum windows
were installed at a cost of about $2 ,500 . R�nts are approximatel.y
35� below the current market. Outyo averages $550 mare than in
come during the last 4 years. . . ?nspectors have not been pro-

perly instructed in the limitations of their powers , The placard
should be removed immediately. There is no threat to public health,
safety or welfare. Plans. to meet bathroom requirements wer.e started
a year ago. Two-thirds of this is comnleted. . . . An extension of
time is needed to correct remaining deficiencies . . What re-
mains to be done is to convert two remaining units �to 5 and 6
room apartments . . . Windows are now operatina in the bathrooms ,
Items have been done which were not required by the Bureau of �
Health . . . Good faith has been shown and an extension of time
is warranted. Mr. Engle said the 6-room apartments rent for $100
per month. Others rent for $45 and $55 per month. Insuranc� on
the building is $600 per year. Taxes last year were $924 ,04 .
ACTION: Moved by Cohen that based upon the testimony af the City,
of Mr. Boyd and Mr. Engle and based upon the viewing of the pro-
perty, that in the best interest of public health, safety and
welfare that the appeal be denied.
Seconded by Voigt.

SUBJECT: Letter dated May 14 , 1970 and letter dated July 28, 1970
from the Bureau of Health to Mr. Robert King indicating Housing Code
deficiencies on the property located at 267 Thomas Ave.
APPEARANCES : Robert M. King.
PROCEEDINGS: Mr. King explained that there were two duplexes on
the same lot . . . He is only appealing the requirement that a hand-
sink be installed in the bathroom of dwellin_q unit #l, In that unit,
there is presently one family which includes three children. The
bathroom is only 7 ' x 3-1/2 ' and there is no way to accommodate a
sink there.
ACTION: Moved by Grove to grant a variance to Section 54 .11 (3)
of the Saint Paul Legislative Code, requiring that a sink be in-
stalled in the bathroom of unit #1 at 267 Thomas Ave.
Seconded by Rehnberg.
THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdorf, Voigt.

SUBJECT: Letter dated March 13 , 1970 from the Bureau of Health
to Gertrude J. Hays indicating Housing Code deficiencies on the
property located at 2347 Chilcombe Ave.
APPEARANCES : Gertrude J. Hays .
PROCEEDINGS : Mr. Cohen read the appeal dated July 4 , 1970 in which
Mrs. Hays indicates that .it would be a financial hardship to repair
the roof and plumb the garage or remove it. Any long term loan
would deplete what savings she has .
Mrs . Hays said that an estimate of cost to repair her roof was
$1,800 . She and her son presently live in the home, however, her
son is about to go away to school. The water heater conductor
pipe has been fixed.
ACTION: Moved by Cohen to grant an extension of time, for 12
months , to comply with the Housing Code . Further moved that the
matter be reheard after that time . Finally moved that the filing
fee be waived.
Seconded by Sommerdorf.
THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdorf, Voigt.
Nayes : none. Abstentions : none. Motion carried six (6) to

72-70-H 1408 Hythe St. Maude L. Goodrich
SUBJECT: Letter dated October 29 , 1969 from the Bureau of Health
to Mrs . Maude Goodrich indicating that either a window or mechanical
ventilating system be installed in unit #9 of the property located
at 1408 Hythe St.
APPEARANCES: Maude L. Goodrich.
PROCEEDINGS: Mr. Cohen read the appeal dated August 11, 1970 in-
dicating that the cost to install �. ventilating system in the
bathroom located in the basement would be too costly.
Mrs. Goodrich said she presently gets $77 per month for rent of
the basement apartment. No more than twa people use the bathroom
there.
Dr. Cox said he felt thexe would be no problem in granting a
variance to this requirement.

ACTION: Moved by Peake to grant a variance of Section 54 . 14 (7) of
The Saint Paul Legislative Code requiring ventilation by either
a window or mechanical means for the bathroom of unit #9 at the
property located at 1408 Hythe St.
Seconded by Sommerdorf.
THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdorf, Voigt .

74-70-H 507 Petit Michael Bundy
SUBJECT : Letter dated August 3, 1970 from the Bureau of I�iealth
to Michael Bundy, 911 East 21st St. , Minneapolis, indicating certain
Housing Code deficiencies on the property located at 507 Petit and
granting a period of 6 manths to correct said deficiencies .
Letter dated August 14, 1970 from the Bureau of Health to Michael
Bundy amending the time period to correct Housing Code deficiencies
from 6 months to September 14 , 1970 .
APPEARANCES : Michael Bundy.
PROCEEDINGS: Mr. Bundy said that he was not appealing the recom-
mendations of the Bureau of Health but rather the fact that the
time limit in which to comply was reduced from six months to one
month with no apparent reason.
A letter dated August 7, 1970 from Charles P , McCarty to Frank
Staffenson was introduced. It requested the Bureau of Health to
take necessary steps to clear up the situation at 507 Petit.
Mr. Staffenson said that a 6 month extension of time is normally
granted within which to comply with the Housing Code. He said
that in this case a hot water safety valve should be installed
immediately.
Mr. Bundy said that he had had troul�le with some of the renters
but that they had moved out.
Mr. Cohen said that the action of the Bureau of Health appears to
be normal and not out of the ordinary and that there appears to bP
no reason for reducing the time allotted to comply in this case.
ACTION: Moved by Cohen to reinstate the original 6 month extension
of time from and after August 3 , 1970 to a11ow time within which
to correct all Housing Code deficiencies at 507 Petit .

PRIOR HEARING: Meeting No. 36 , August 12 , 1970 .
SUBJECT: Letter dated June 4 , 1970 to Dwayne Rasmussen, 4880 -
106th Ave. N. E. , Minneapolis from the Bureau of Health, regarding
an illegal third floor occupancy at 330 South Exchange.
APPEARANCES: Dwayne Rasmussen, Charles Jahn.
PROCEEDINGS: Mr. Cohen read the inspection of the Building Depart-
ment dated August 19 , 1970 . Copies of an inspection report dated
August 17, 1970 , by the Bureau of Health, were distributed.
Mr. Rasmussen stated that they intend to comply in all respects
with the Housing and Building Codes as soon as possible.
ACTION: Moved by Rehnberg to wa.ive Section 54 . 15 (3) of the St.
Paul Legislative Code that no wood frame dwelling be occupied
above the second floor for the property located at 330 South Ex-
change. Such waiver is to be granted on condition that the two
stairways providing exit from the third floor be enclosed in a
manner so as to conform with requirements of the St. Paul Building
Code. Further moved that no more than two individuals be allowed
to occupy the third floor occupancy at any one time . Finally
moved that said waiver be granted for as long as Dwayne Rasmussen
and Charles Jahn own the property located at 330 South Exchange
and that the waiver be nullified upon the sale or transfer of
ownership of the property.

concerning code deficiencies on the property located at 753 Lafond

PROCEEDINGS : Mr. Cohen read the appeal dated August 25, 1970 .
Mr. Griemann said that until the deficiencies as listed were corrected
he would be unable to get an appraisal of the property by F.H.A. or
V.A. He said the owner was moving out of the Thomas-Dale project
area and was in the middle of transferring this property when the
list of deficiencies was received. . . To make these improvements at
this time would be very costly. . . The selling price of the h�use
would be jacked up accordingly and the possibility of the deal
falling through is great. The home is presently valued at about
$14 ,500 .
Mr. Rehnberg said he felt that �onsideration should be given to the
possibility of escrowing funds to be used for code compliance in
such a situation.
ACTION: Board members agreed that there was not much they could
do in this specific instance but that they would work to find a
solution to this type of problem. The Board unanimously agreed
to waive the filing fee for this matter.
