WHEREAS, Pursua.nt to Resolution, C. F. 249952, approved August 4, 1970, a public hearing was duly held on Tuesday, August 18, 1970� before the Council of the City of Saint Paul, said hear- ing pertaining to the condition of the building and garage located at 454 Str�ker, Saint Paul, Minnesota; and WHEREAS, Upon the facts presented at the said hearing, con- sisting of photographs, inspection reports and the recommendation of the City Architect, it is found and determined by the City Council tha.t according to the records and files in the office of the Register of Deeds, the last record owner is Hi'3�degard A. Tank; Currell Realty Company is an unrecorded contract purcha.ser; and tha.t there are no other lien holders of record; tha.t it is further determined tha.t the above=described dwelling and garage constitute hazardous buildings within the definition of Minnesota Statutes, � Section 463.15, for the following reasons: a. The building is standing vacant, abandoned, and is subject to entry by unauthorized persons and to van- dalism; b. The interior of the dwelling is dilapidated with floors sagging, plaster cracking and missing, plumbing removed, the electricity disconnected, walls not plumb, and doors and windows broken; d. The detached garage is deteriorated and sagging and beyond reasona.ble repair; e. The dwelling is unfit for huma.n ha.bitation in its present condition and must be corrected so as to comply with the Saint Paul Building Code and Housing Code; and f. The dwelling and garage constitute a hazardous building, a nuisance and a ha.zard to the public peace, health, safety and welfare because of their physical damage, dilapidation and abandonment and inadequa.te ma.intena.nce; now, therefore, be it RESOLVED, Tha.t in accordance with Minnesota Statutes, Sections 463. 15 through 463.26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER `� ,', . 1. The owner of the above-described dwelling and garage sha.11 ma.ke the same safe and not detrimental to the public peace, health, safety and welfare by ha.ving the said dwelling and garage razed and the ma.terials therefrom removed from the premises within twenty (20) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with this Order or an answer served upon the City of Saint Paul and filed in the office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order, a Motion for Siasrrcnary Enforcement of this Order to raze and remove the said building will be made to the Ramsey County District Court; 3. The owner of record is Hildegard A. Tank, Fee Owner. Currell Realty is contract purchaser. The legal description of the property is Lot 5, Block 56, Town of West 5aint Paul. Concrete walls deteriorating, roof of frame construction is deteriorated and sagging. Garage doors very dilapidated.. The basic structure of both d.welling and garage is unsound. and. appear far too dilapidated for repairs. Mc Carty and Members of the City Council -2- August 17, 1970 If it is the opinion of the owners of this property that it can be rehabilitated, it will be necessary that they submit the list of corrections which they propose regarding the structural cond.itions of the building as well as the electrical, plumbing and heating systems, with a schedule for the completion of the rehabilitatian program, along with the application for permits. Inasmuch as such a schedule has not been submitted by the owners and no attempt has been made to repair the damage despite our warnings, it is the recommendation of this Bureau that this matter be referred to the City Attorney's office for razing and removal through District Court procedures. er trul Robert L.
