' Mr. Anderson advised the Board that the appeal for 735 Laurel Ave. would be continued at the next meeting of the Board and that the appeal for 588 Winslow was withdrawno ' Mr. Cohen read a letter dated July 20 , 1970 from Dan Klas , Corpor- ation Counsel to Thomas Anderson indicating that it is an adminis- trative decision of the Board to determine whether or not a "viewing" is considered a "meeting" for purposes of paying Board • members. � , The Board voted unanimously to consider the viewing of the freight elevators at 300 East 4th St. on July 9 , 1970 , a meeting for purposes of pay. 41-70-H 1528 Grantham St. John Bernsten by Mrs. Delmar Gillespie, „ Attorne in Fact b ' Paul A. Nelson Inc. , Realtors , from the Bureau of Health, regarding Housing Code deficiencies on the property located at 1528 Grantham St+. APPEARANCES: Paul A. Hilstad. PROCEEDINGS : Mr. Hilstad explained that since the meeting of June 10 , a new hot water heater had been installed in the premises . . . The estimate of cost to repair electrical deficiencies wou�d be approximately $750 . . . It would take Mr. Bernsten approximately 3 - 4 years to correct all the Housing Code deficiencies which have been noted. . . Presently one woman and three children are living in the house. ACTION: Moved by Cohen to grant an extension of time of 1 year to correct deficiencies numbered 1, 2 and 5 under the heading "General Structure" in the subject� of appeal. Seconded by Tieso. McLean • SUBJECT: Letter dated May 7, 1970 to David McLean, 2273 Brewster from the Bureau of Health, regarding certain Housing Code v�iolations on the property at 2273 Brews�er. . APPEARANCES : David J. McLean. PROCEEDINGS: Mr. Cohen read the appeal dated May 21, 1970 �ahich generally outlined Mr. McLean's financial situation. Mr. McLean elaborated on those facts . . . . He stated that one room was rented out to a student for $50 per month. Mr. McLean explained . the nature of the violations that had been cited. The Board advised him that he could comply with code at a minimum financial expenditure by removing the illegal wiring, properly fusing the boxes , installing a couple of electrical sockets in the bed- ' rooms and installing a handrail to the basement himself. ACTION: Moved by Cohen to grant an extension of time of six months to comply with the Housing Code. Seconded by Sommerdorf. THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdorf, Tieso, Voigt. Virginia An4n Loeffler, 1204 W. Hoyt Ave. from Glenn A. Erickson, Asst. City Architect indicative that the proposed addition to the residence at 1204 W. Hoyt Ave. does not comply with the side yard requirements of the Saint Paul Legislative Code . APPEARANCES : Mrs . Virginia Ann Loeffler. PROCEEDINGS : Mr. Cohen read the subject of appeal and �he appeal dated July 14, 1970 . Mr. Erickson explained that whereas the pro- perty appealed for lay next to the Como Golf Course, there was no objection to the proposed addition by the City. ACTION: Moved by Peake to waive Section 33.04-3 of the Saint Paul Legislative Code pertaining to side yard requirements, to allow an addition to the premises located at 1204 West Hoyt Ave. as requested. Seconded by Voigt. THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdorf, Tieso, Voigt. Nayes : none. Abstentions: none. Motion carried seven (7) to zero (0) . • 63-70-B 1139 Davern St. William H. Waldorf SUBJECT: Letter dated July 22, 1970 to Mr. William H. Waldorf from Glenn A. Erickson, Assistant City Architect indicating that whereas the Building Code requires a minimum ceiling height of 7 '6" , the proposed remodeling a� 1139 Davern St. does not conform to that requirement. APPEARANCES : William H. Waldorf. PROCEEDINGS: Mr. Cohen read the appeal dated July 21, 1970 . Mr. Waldorf explained that his prime concern was to retain the appear- � ance of the house by not having to raise the peak. � ACTION: Moved by Cohen to waive , Section 34.09-16 of the St. Paul Legislative Code to permit remodeling of the second floor level on the property at 1139 Davern St. to include a ceiling height of 7' 2" . Seconded by Grove. . THE VOTE: Ayes: Cohen, Grove, Peake, Rehnberg, Sommerdorf, Tieso, Voigt. Nayes: none. Abstentions : none. Partri ge , SUBJECT: Letter dated July 22, 1970 to Dr. Alexander Cass from Glenn A. Erickson, Assistant City Architect indicating the pro- posed addition to the residence building at 1986 Lower St. Dennis does not comply with the minimum side yard requirement. APPEARANCES: Dr. Alexander Cass , A. F. Partridge. PRO�EDINGS : Mr. Cohen read the subject of appeal and the appeal dated July 21, 1970 . Mr. Partridge showed plans of the proposed addition and a picture indicating where it would be located. Mr. Cass submitted a statement from the owner of the adjoining property indicating that he had no objection to such an addition. ACTION: Moved by Voigt to waive Section 33 .04-3(b) of the Saint Paul Legislative Code pertaining to minimum side yard requirements to allow construction of the addition to the residence located at 1986 Lower St. Dennis Road as proposed. Motion carried seven (7) to zero (0) . � 58-70-B Development Sites C & D Midwest Improvement 59-70-B Summit-University NDP Area Association by Robert Lee Morgan SUBJECT: Letter dated July 22 , �1970 to Robert Lee Morgan, Adkins- Jackels Associates , Inc. from Glenn A. Erickson, Asst. City Architect indicating that the St. Paul Legislative Code does not allow con- struction of frame residence buildings of more than two stories and therefore the proposed buildings at Sites C & D of the Summit- University NDP area do not comply. APPEARANCES : Robert Lee Morgan. � PROCEEDINGS : Mr. Cohen read the, appeal dated July 7, 1970 . Mr. Morgan explained, as did the appeal, that to permit construction of the 3-story apartment units would allow construction of basement storage, laundry and community rooms under the structure. Board members viewed the plans for the project. . . Mr. Morgan stated the Sites "C" and "D" were identical. Mr. Erickson stated that he saw no problem with the proposed construction. Mr. Voigt indicated . his approval of the proposal. e - 4 - • � 7/22/70 , Meeting No. 35 ACTION: Moved by Cohen to grant a variance to Section 4.05 of • the Saint Paul Legislative Code, pertaining to building height limits for wood frame and unprotected metal constructio�, to allow approval of the plans for construction of Development Sites "C" and "D" , Summit-University NDP areas as requested. Seconded by Peake. THE VOTE: Ayes : Cohen, Grove, Peake, Rehnberg, Sommerdorf, Tieso, Voigt. Nayes : none. Abstentions : none. Motion carried seven (7) to zero (0) . 30-70-B 300 East 4th St. ATR Electronics Inc. by Allen Aaron PRIOR HEARING: Special Mtg. , May 20 , 1970. Special Mtg. , July 1, 1970� Viewing, July 9 , 1970� SUBJECT: Letter dated March 31, 1970 to ATR Electronics Inc. , 300 East Fourth Street, from Robert L. Ames , City Architect, Bureau of Public Buildings , concerning an application for a Certificate of Inspection for power driven freight elevators at 300 East Fourth Street. ° . PROCEEDINGS: Mr. Cohen said that an ordinance exists which grandfathers in elevators and yet there is a question of safety . . . The question before the Board, in this case, is wh�ther or not the elevators are safe. Mr. Voigt said he felt the elevators were unsafe - the hoistway doors were flexible, enough to be caught on the floor of the elevator when in motion and the sheet metal would be torn off if rio car door was present; there were no bumpers on the floor of the elevator and the guide rails were loose on the masonry wall o . . Mr. Tieso said the elevators would have to be completely rewired because of their age . . . Mr. Rehnberg said he felt it would be hard to justify a $70 ,000 improvement in a $100 ,000 buildinq . . . Mr. Grove said that to grant a complete . waiver would be a license to fill the building and increase traffic. To grant a variance, the limit switches , doors , and guide rails , would have to be repaired, the elevator speeds and loads would have to be decreased . . . Mr. Cohen said he felt the suggested elevator test was unreasonable . . . It was the finding and general consensus of the Board that the two freight elevators in question, located in the property at 300 East 4th St. were dangerous to life and limb by virtue of their age, deterioration and usage.
