1 WHEREAS, adverse action was initiated against the licenses held by SD Ray Inc., d/b/a

WHEREAS, Licensee had initially requested a hearing on the allegations before an

Administrative Law Judge; and
WHEREAS, the Saint Paui City Council imposed a sixty day suspension of the licenses
held by SD Ray, Inc., d/b/a ScotY s Place under Council File #03-207 for subsequent violations
which were not contested by the Licensee; and
WHEREAS, Licensee is now willing to admit to the violations contained in the
December 20, 2002 Notice of Violation on the understanding that the Office of LIEP
recommends an additional fifteen-day suspension of the licenses, to be added to the end of the
current suspension period, which would result in a total closure of seventy-five days; and
WHEREAS, the Council agrees that this is an appropriate penalty for the three violations,
which pre-date the matters covered in Councii File #03-207 and accepts the Stipulation of
Settlement of Adverse Action dated March 13, 2003, a copy of which is incorporated herein by
reference; now therefore be it

for a period of fifteen (15) days. Said closure shall immediately follow the current suspension

STIPULATION OF SETTLEMENT OF
ADVERSE ACTION
WHEREAS, adverse acrion was iniUated against the licenses held by SD Ray, Inc., d/b/a
Scott's Place (License ID#: 19990001984) by Notice of Violation dated December 20, 2002,
alleging violations of the conditions placed on the license from dates of November 4, 2002,
November 10, 2002 and November 25, 2002; and
WI�REAS, the licensee had requested a hearing before an Administrative Law Judge on
the violations, and that hearing was scheduled for March 11, 2003; and
WHEREAS, the licensee received two other Notices of Violations, dated January 8, 2003,
and January 29, 2003, which contained allegations of other violations of conditions after the
3ates listed above, ar.d to which he never responded; and
WHEREAS, the City Council imposed a sixty day suspension of the licenses for the later
violations under Council File #03-207, which is to run from 12:01 a.m. on March 19, 2003
through 11:59 p.m. on Saturday, May 17, 2003; and
WHEREAS, Licensee does not intend to reopen his business and is in the process of
selling it, but does wish to prevent the license from being revoked; and
WHEREAS, Licensee is willing to admit to the violations contained in the December
20, 2002 Notice of Violation in retum for which the Office of LIEP would recommend an
additional fifteen-day suspension of the licenses, to be added to the end of the cunent suspension
period, which would result in a total closure of seventy-five days; and
WHEREAS, parties wish to resolve this matter as set forth, but agree that if the Council
wishes to depart from the recommendation that Licensee would be entitled to a hearing to dispute
the violations and the appropriateness of the penalty; now, therefore, parties agree as follows:
1) That the Licensee admits to the violations listed in the Notice of Violation dated
December 20, 2002, specifically that 1) on November 4, 2002, patrons entered the premises at
:2:53 a.m. ir. violatiar. af a condition on the license which prohibits people from entering after
12:30 am.; 2) on November 10, 2002, patrons were allowed to enter without being wanded or
searched, contrary to a condition on the license which required a metal-detecting device to be
used; and 3) on November 25, 2002, patrons were observe entering the premises without being
wanded or searched, in violation of the condition on the license.
2) That the Office of LSEP recommends that the licenses held by SD Ray, Inc., d/b/a
ScotYs Place, be suspended for a period of fifteen days, said suspension to be served in addition
to the license suspension imposed under Council File #-03-207.
3) That the Licensee agrees to the attached resolution being placed on the Council's next
available consent agenda, at which no public discussion would be aliowed, to impose the a�'eed

upon penalty on the licenses held by SD Ray, Inc., d/b/a Scott's Place.
4) That in the event the Saint Paul City Council will not accept the Settlement
Stipulation that Licensee shall be entitled to a hearing on the violations before an AIJ and/or a

Please take notice that this matter has now been set on the Consent Agenda for the
Council meeting scheduled for 3:30 p.m., Wednesday, April 2, 2003 in the City Council
Chambers, Third Floor, Saint Paul City Hall and Ramsey County Courthouse.
Enclosed aze copies of the proposed resolution and other documents which will be
presented to the City Council for their consideration. This is an uncontested matter in that the
facts concerning the failure to abide by the license conditions on November 4, 2002, November
10, 2002, and again on November 25, 2002, have been admitted to. This matter has been placed
on the consent agenda portion of the City Council meeting, during which no public discussion is
allowed. As agreed upon between you and the license office, the recommendation of the license
office will be for an additional 15 days suspension of your licenses to be added to the end of the
current 60 day suspension of your licenses.

with thirty (30) of the days stayed for a period of eighteen (18) months on the condition that there

Dear Sir/Madam:
The Office of License Inspections and Environmental Protection has recommended
adverse action against the licenses held by SD Ray Inc., d/b/a ScotYs Place for the premises
located at 1178 Arcade Street in Saint Paul. The basis for the recommendation is as follows:
On November 4, 2002, a Saint Paul police officer was
monitoring Scott's Place, located at 1178 Arcade Street in Saint
Paul. At approximately 12:40 a.m. the officer observed three
people entering the premises, through the rear door. These
people remained in the bar. Another individual entered at
12:53 a.m.. Other patrons were seen leaving the premises and
then re-entering after 12:30 a.m.. There is a condition on the
license which prohibits patrons from entering after 12:30 a.m.
and from re-entering after that time once they have left.
On November 10, 2002, Saint Paul police officers performed a
premises check at Scott's Place. Officers observed that patrons
�vere entering the premises without being wanded or being
searched, despite the fact that there is a condition on the
license that requires metal-detecting devices to be used.

On November 25, 2002, Saint Paul police officers performed
another premises check at Scott's Place. Again, officers
observed that patrons were entering the premises �r
being wanded or being searched, despite the condition on the
license that requires metal-detecting devices to be used.
Additionally, while writing a report, one of the officers
observed a person entering the esfablishment at 1:11 a.m.
although another condition on the license prohibits patrons
from entering after 12:30 a.m.

If you do not dispute the above facts please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the St. Paul City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear and speak on
your own behalf, or to have someone appear there for you.
On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary
hearing before an Administrative Law Judge (ALJ). If you wish to have such a hearing, please
send me a letter stating that you are contesting the facts. You will then be sent a"Notice of
Hearing," so you will know when and where to appear, and what the basis for the hearing will be.
In either case, ptease let me know in writing no later than Monday, December 30,
2002, how you would like to proceed. If I have not heard from you by that date, I will
assume that you are not contesting the facts. The matter will then be scheduled for the
hearing before the St. Paul City Council.

1. The license holder will employ properly trained security personnei, who wiil be on duty every day from 9:OOpm until Gasing. The security guard(s)will
adhere to the following guidelines:
a) The security guards will not socialize with patrons and will not be allowed to drink alcoholic beverages while on duty.
b) Security will wear Geariy identifiabie dothing.
c) Security will conduct outside sweeps or walk-arounds at least hvice an hourwhile on duty, weather pertnitting, to disperse or discourage people from
loitering.
2. Licensee will use metal detecfing devices to prevent the introducGOn of weapons into the establishment.
3. Interior and exterior video surveillance came2s must be in operation during all hours the establishment is open. Tapes must be saved for a period of at
least 30 days, and the tlates and times of recording must be accurate and visibie on the videotapes. Tapes will be maintained on the premises and matle
available to police or LIEP inspection staff immediately upon request.
4. Licensee will provide copies of State Drivers License or State IDs of all employee and sewrity personnel to LIEP for purposes of backgrountl checks.
LIEP must be nofified of changes in personnel and this infortnation will be supplied for all new employees prior to their start date.
5. Licensee must comply with the limitations on the existing Entertainment A licerse. Noise levels will be monitored so as not to disturb neighbors by loud
music.
6. Licensee must maintain a list of patrons who have been banned from the establishment for assaultive, disorderly or disruptive behavior. The list must at
a minimum, contain a name and description of the banned patron, as well as the date they were banned. No persons who are on the list shail be permitted
to be in the establishment or remain on the grounds. This list shall be submitted to LIEP monthly.
7. Loitering in fhe parking Iot shall not be permitted The parking lot must be regularly patrolled to insure compliance with this condiGOn.
8. Litter on and around the premise is to be picked up daily.
9. There are to be no patrons admitted to the estabiishment aker 12:30a.m. and patrons who have left are not to re-enter after that time.
10. All windows and doors must have a clear view into and out of the establishment by October 31, 2002.
71. Roll-off dumpsters must be removed Rom the parking lot by November 15, 2002.

Squad 333 (MDunaski/JReginek) conducted an investigatory stop at Maryland/Arcade on a Male. info report to
LIEP made.
NARRATIVE
Squad 333 (MDunaski/JReginek) conducted an investigatory stop on a B/M (ID'D AS DERRICK
DUSEAN PHILLIPS, DOB 9-09-76, 1325 WESTMINSTER STREET #205) at Maryland/Arcade.
Stop time 0151 hours on 11-10-02.
While on routine patrol we saw PHILLIPS walking NB on Arcade south of Maryland Ave. We have
had previous dealing with PHILLIPS (SECURITY GUARD AT SCOTT'S BAR, 1178 ARCADE
STREE� in the past. We then stopped and talked to PHILLIPS.
After a brief conversation Officer Reginek asked PHILLIPS if he had been tlrinking (OFFICER
REGINEK SMELT THE ODOR OF AN ALCOHOLIC BEVERAGE ON PHILLIPS BREATH) and if he
was all right to continue walking home. PHILLIPS told us that he had two Corona beers and 1 shot
of Brandy at the Bar (SCOTTS BAR) 6ut he felt he was ok to make it home, i asked PHILLIPS if he
was drinking with Bar patrons and he said, "No, 1 was drinking after hours with the clean-up crew".
PHILLIPS indicated that he just finished his drinks (AT APPROX 0145 HOURS) and was now
walking to his girlfriends house.
We asked PHILLIPS if he was working security at the bar tonight and he told us that he was.
PHILLIPS told us that he was the only Security guard on duty on 1 110 9/02-1 1 /1 0/02 and he
stationetl himself at the back door with the metal detecting wand.
Since iYs a violation of City licensing to drink in a licensed bar after hours we issued PHILLIPS a PBT
(ALCO SENSOR, #042860, USER- OFFICER P. MURPHI�. PHILLIPS registered at .061 BAC level
on the PBT. PHILLIPS indicated that he was all right to waik home and departed the scene.

Sq. 398 (P.MurphylSack) went to Scott's Place, 1178 Arcade, to assist Sq. 302 ( Sgt.McNamara)
with a premise check.
W hile we were inside the bar I was watching the rear door that faces the parking lot. I saw a male
walk in the rear door stop and shake hands with the security guard and walk into the bar without
being scanned with the metal detector, I continued the watch the male for approximately three
minutes before he left the bar out the front door. I watched the male to make sure he was not and
employee of the bar. Ffe walked to he southwest corner of the bar and taiked with a female then left
wiih her out the front door. I did noi see him talk to any other employees of the bar while he was
inside.
At 0040 when I was leaving the bar I saw three females walk into the rear door past security and
walked up to the bar. The three female ordered and stood by the bar.

Please take notice that a hearing will be held at the following time, date and place concerning all
licenses for the premises identified above:

The Councii of the City of Saint Paul has the authority to provide for hearings conceming licensed
premises and for adverse action against such licenses, under Chapter 310, including sections 310.05
and 310.06, of the Saint Paul Legisiative Code. In the case of licenses for intoxicating and non-
intoxicating liquor, authority is also conveyed by Minnesota Statutes section 340A.415. Adverse
action may include revocation, suspension, fines and other penalties or conditions.
Evidence will be presented to the judge which may lead to adverse action against all the licenses you
hold at the above premises as follows:
On November 4, 2002, a Saint Paul police of£cer was monitoring
Scott's Place, located at 1178 Arcade Street in Saint Paul. At
approximately 12:40 a.m. the officer observed three people
entering the premises, through the rear door. These people
remained in the bar. Another individual entered at 12:53 a.m..
Other patrons were seen leaving the premises and then re-
entering after i2:30 a.m.. 'i'nere is a cou�iiiar, un the 8ice�se
which prohibits patrons from entering after 12:30 a.m. and from
re-entering after that time once they have left.
On November 10, 2002, Saint Paul police officers performed a
premises check at Scott's Place, Officers observed that patrons
were entering the premises without being wanded or being
searched, despite the fact that there is a condition on the license
that requires metal-detecting devices to be used.
On November 25, 2002, Saint Paul police of�cers performed
another premises check at Scott's Place. Again, officers
observed that patrons were entering the premises without being
wanded or being searched, despite the condition on the ticense
that requires metal-detecting devices to be used. Additionally,
while writing a report, one of the officers observed a person
entering the establishment at 1:11 a.m. although another
condition on the license prohibits patrons from entering after
12:30 a.m.
You have the right to be represented by an attorney before and during the hearing or you can
represent yoursel£ You may also have a person of your choice represent you, to the extent not
prohibited as unauthorized practice of law.
The hearing will be conducted in accordance with the requirements of Minnesota Statutes sections
14.57 to 14.62 and such parts of the procedures under section 310.05 of the Saint Paul Legislative
Code as may be applicable.
At the hearing, the Administrative Law Judge will have all parties identify themselves for the record.
The City will then present its witnesses and evidence, each of whom the licensee or attorney may
cross-examine. The licensee may then offer in rebuttal any witnesses or evidence it may « to
present, each of whom the City's attorney may cross-examine. The Administrative Law Judse may

in addition heaz relevant and material testunony from persons not presented as witnesses by either
pazty who have a substantial interest in the outcome of the proceeding; for example, the owners or
occupants of property located in close proximity to the licensed premises may have substantial
interest in the outcome of the proceeding. Concluding arguments may be made by the garties.
Following the hearing, the 7udge will prepare Findings of Fact, Conclusions of Law, and a specific
recommendation for action to be taken by the City Council.
You should bring to the hearing all documents, records and witnesses you wi?1 or may need to
support your position. Subpoenas may be available to compel the attendance of witnesses or the
production of documents in conformity with Minnesota Rules, part 1400.7000.
If you think that this matter can be resolved or settled without a formal hearing, please contact or
have your attomey contact the undersigned. If a stipulation or agreement can be reached as to tha
facts, that stipulation will be presented to the Administrative Law Judge for incorporation into his
or her recommendation for Council action.
