03-299Council File # 03 - ag9 ����!��� Presented By Referred To ,'� RESO TI(�1N 41D�'T,P� , MINNESOTA � "` � ,. xesolution # Green Sheet # 1�. y �,3� 3g Committee: Date 2 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in §293.09, upon a fmding by the City Council that full compliance with Chapter 293 would consfitute an unreasonable hardship on an applicant, other persons or on the community; and 9 WHEREAS, Skinner's Pub, represented by Molly Skinner, Owner, who has been designated as the 10 responsible person on the application, has applied for a variance to allow amplified music at 919 Randolph Avenue, 11 on May 31, 2003; and 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 WHEREAS, applicant is seeking a variance for the hours of 12:00 p.m. to 10:00 p.m. on May 31, 2003; and WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music for its Family Oriented Spring Time Outdoor Party; and WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application and has made recommendations regarding condirions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paui hereby grants a variance to Skinner's Pub, subject to the following conditions: 1) 2) 3) 4) The variance shall be for the hours of 12:00 p.m. to 10:00 p.m. on May 31, 2003. All electronically powered equipment used in conjunction with the event shall not exceed 90 dBA as measured at the closer of the sound mix or at a distance of 50 feet from the front of the stage. The applicant shall provide personnel and equipment who shall provide continuous sound level monitoring behveen 12:00 p.m. and 10:00 p.m. on May 31.
