Dear Sir:
This is written in response to the appeal of Peter A. Olsen to relax the
frontage requirement for a duplex on property located on the south side
of Wilson Avenue between Maple and Forest Streets, and noted in detail
by the legal description on file.
This matter was heard by the Board of Zoning at its July 15, 1971 public
hearing at which time the written staff report was read. It was noted that
the applicant proposes to build a duplex if allowed or else a single-family
home but that an appeal is necessary for either. The staff said that
favoring the appeal is the fact that the subject lot has more than enough
area for a duplex and the fact that the character of the neighborhood is
that of greater density than some other neighborhoods. Opposing the appeal
is the proposal's effect of reducing the area allotted to the adjoining
legal non-conforming four-plex and the fact that the hardship is self-
produced. Also opposing the appeal is the fact that allowing substandard
lots exaberates crowded conditions and the possible need for a driveway
on the �lot since no alley services the 1ot.
The appeal was represented by Mr. Thomas Burke who stated that the applicant
has planned to provide parking space in a garage under the house directly
off the street.
Several persons appeared in opposition. They questioned the adequacy of
the parking provisions, feared that adjoining houses would be deprived
of sun light and residents in the adjoining apartments would be deprived
of open-space.
In considering this matter the Board noted that three off-street parking
spaces are required for a duplex. They considered the probable width of a
driveway on the lot. It was mentioned that a variance for a single-family
home would be favorable but not for a duplex.
Subsequently, the Board heard a motion to reco�end denial because of the
area that would be subtracted from the adjoining four-plex. The seconding

motion noted that dividing the lots in this way is not in accord with
the Zoning Code. The motion received a vote of 2 in favor and 2 against.
The chairman declared the matter would go to the Council simply as having
received a tie vote before the Board.

Need of appeal - appeal is necessary because requirement of
40 feet frontage cannot be met
The property lines and dimensions are as above described and as shown by
the enclosed plat of survey of Tract C. The lot now has a bank approximately
3 feet high but after construction, if permitted, the grade will be leveled
because it is proposed to provide parking by street level under building
garages which will be entered from Wilson Street. The location and size of
the buildings proposed will be in conformance with City Code and will depend
on whether the City will permit first the relaxation of the 40 foot requirement
and then will permit either a duplex, which is preferred, or a single family
dwelling to be erected on these premises. At that time, in connection with
the application for the building permits, the proper documents will be submitted
and the City is assured that the construction and location will be in accordance
with the ordinances and codes of the City of Saint Paul.

C. NF.ED FOR APPEAL: The frontage of this lot is 37 feet.
D. PRESENT STANDARD: In a "B" Residence District, the Zoning Code requires a frontage
of 40 feet and a lot width at the front legal setback of 40 feet for a single-family
home. The Code requires a frontage of 40 feet and a lot width at the front legal
setback of 50 feet for a duplex.
