1 WI�REAS, the State of Minnesota Department of Natural Resources through its
2 Outdoor Recreation Crrant Program has made funding available to assist local governments in
3 acquiring parkland and developing or redeveloping outdoor recreation facilities; and
4 WHEREAS, the City of Saint Paul is an eligible applicant and desires to submit an
5 application to the Department of Natural Resources on March 31, 2003, in the amount of
6 $250,000 for the North Dale Recreation Center Play Area and Site Development project; and
7 WHEREAS, the City of Saint Paul owns the property on which North Dale Recreation
Center is located; and
9 WHEREAS, site development wark following building construction, including a
10 children's play azea, parking, lighting, court azeas, fencing and landscaping, is needed at this site;

12 WHEREAS, the City of Saint Paul has the legal authority to apply for financial
13 assistance, and the institutional, managerial, and financial capability to ensure adequate
14 construction, operation, maintenance and replacement of the proposed project for its design life;

WHEREAS, the City of Saint Paul has not incurred any costs or entered into any written
agreements to purchase property related to the above-referenced project; and
18 WHEREAS, the City of Saint Paul has not violated any Federal, State or Local laws
19 pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or
20 corrupt practice;and
21 WHEREAS, upon approval of its application by the State, the CiTy of Saint Paul may
22 enter into an agreement with the State of Minnesota for the above-referenced project, and the
23 City of 5aint Paul certifies that it will comply with all applicable laws and regulations stated in
24 the contract agreement and described in the Compliance section of the Outdoor Recreation Grant
25 Program application; now, therefore,

2� t\����� �ESOLVED, that the City of Saint Paul act as legal sponsor for the North Dale
27 Recreation Center Play Area and Site Work project contained in the Outdoar Recreation Grant
28 Program application to be submitted on March 31, 2003 and that the Mayor and proper City
29 officials are hereby authorized to apply to the Deparhnent of Natural Resources for funding of
30 this project in the amount of $250,000 on behalf of the City of Saint Paul; and

31 BE IT FURTHER RESOLVED, that the Mayor and proper officials of the City of Saint
32 Paul are hereby authorized to execute such agreements as aze necessary to implement the project
33 on behalf of the City.
