As you know, each year for the past three years the above named corporation
has been licerlsed ta operate a drive-in motion picture theater operation on
the site located at the Northwest quadrant of the intersection of �laryland
� Avenue and Interstate Highu�ay 35E. While they have been authorized to operate
such a facility, they have never in fact conducted any operation on the subject
property. Hou�ever, each year the corporation has paid the license fee amount-
ing to $573.00 per year for a total of $1,719.00.
In addition, the City af St. Paul granted the appropriate permits to E. �I.
�iaisell � Associates for the operation of a K-(�art Discount Department Store
on the subject site, and it �aill therefore be impossible for the theater Ss
earlier planned to be coastructed thereon. Certainly, f�aryland - 35E, Ine.
does not ob,fect to the K-qiart operation on their site and these facts are only
mentioned to make it absolutely clear that it n►ill nom not be possible for the
operation of the drive-in movie theater.
In light of the above, I , on behalf on said corporation, am requesting a refund
of the license fees which have bsen paid over the last three years to the Citq
of St. Paul. Needless to say, it was the intention of maryland - 35E, Inc. to
locate a theater on the subject site. However, because of the money market
-- during the three year period it became very difficult to proceed with construction.
