1 WHEREAS, the State of Minnesota Department of Natural Resources through its
2 Outdoor Recreation Grant Program has made funding available to assist local governments in
3 acquiring parkland and developing or redeveloping outdoor recreation facilities; and
4 WHEREAS, the City of Saint Paul is an eligible applicant and desires to submit an
5 application to the Department of Natural Resources on March 31, 2003, in the amount of
6 $420,000 for the Jimmy Lee Recreation Center Play Area and Site Development project; and

WHEREAS, the City of Saint Paul owns the property on which Jimmy Lee Recreation
Center is located; and
WHEREAS, site development work including installation of a new children's play area,

court areas, lighting, landscaping and other amenities, is needed at this site; and
11 WHEREAS, the City of Saint Paul has the legal authority to apply for financial
12 assistance, and the institutional, managerial, and financial capability to ensure adequate
13 construction, operation, maintenance and replacement of the proposed project for its design life;

WHEREAS, the City of Saint Paul has not incurred any costs or entered into any written
agreements to purchase property related to the above-referenced project; and
WHEREAS, the City of Saint Paul has not violated any Federal, State or Local laws
pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or
corrupt practice; and
20 WHEREAS, upon approval of its application by the State, the City of Saint Paul may
21 enter into an agreement with the State of Minnesota for the above-referenced project, and the
22 City of Saint Paul certifies that it will comply with all applicable laws and regulations stated in
23 the contract agreement and described in the Compliance section of the Outdoor Recreation Grant
24 Program application; now, therefore,

Recreation Center Play Area and Site Development project contained in the Outdoor Recreation
Crrant Program application to be submitted on March 31, 2003, and that the Mayor and proper
City officials aze hereby authorized to apply to the Department of Natural Resources for funding
of this project in the amount of $420,000 on behalf of the City of Saint Paul; and
BE IT FURTHER RESOLVED, that the Mayor and proper officials of the City of Saint
Paul are hereby authorized to execute such agreements as aze necessary to unplement the project
on behalf of the City.
