RESOLUTION CITY OF SAINT PAUL, MINNESOTA � Committee: Date Preliminary and Final Plat Approval for West Side Community Health Addition � 6 WHEREAS, West Side Community Health Services has submitted for City Council approval the 7 attached preliminary and final plat for subdivision of property at 153 Concord Avenue to consolidate 8 underlying lots to ailow expansion of the existing service institution; and 10 WHEREAS, staff in appropriate City departments have reviewed the proposed plat and have found that 11 it can meet the requirements set forth in Saint Paul Legislarive Code Chapter 67 provided that certain 12 conditions recommended by staff are incorporated into the plat; and 13 14 15 16 17 18 19 20 21 WHEREAS, notice of a public hearing on the proposed plat to be held before the City Council was duly published in the official newspaper of the City, and notices of the public hearing were also mailed to each owner of affected property including all property situated within 350 feet of the subject property; and WHEREAS, the City Council conducted a public hearing on the proposed plat on December 18, 2002, where all interested parties were given the opporhxnity to be heard and the Council considered all the facts and recommendations concerning the plat; 22 NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached 23 preliminary and final plat for West Side Community Health Addition, to consolidate underlying lots to allow 24 expansion of the existing service institution at 153 Concord Avenue, subject to the following conditions that 25 the applicant and developer shall: 26 27 1. REQUIRED FINDINGS: § 67.406 of the Zoning Code requires that all of the following findings shall be made prior to approval of a subdivision: 1. All the applicable provisions of the Legislative Code are compiied with. The proposed subdivision will not be detrimental to the present and potential surrounding land uses. The proposed plat is consistent with the surrounding land uses, and wiil not be detrimental to present and future use of surrounding land. 3. The area surrounding the subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The area surrounding the proposed plat is already developed and compatible with the proposed piat. 4. The subdivision is in conformance with the comprehensive plan. This plat is in conformance with the comprehensive pian which supports the development of institutions that serve neighborhood residents. 5. The subdivision preserves and incorporates the site's important existing natural features whenever possible. This subdivision wiil preserve the existing natural features. 6. All land intended for building sites can be used safety without endangering residents by peril from floods, erosion, continuously high water table, severe soil conditions or offier menace. The site is a relatively flat, fully developed area with no flooding, high water tabie or soil condition probiems. The Ramsey County Soil and Water Conservation District has forwarded a recommendation that the applicant comply with the erosion control guidelines set forth in the Ramsev Countv Erosion and Sediment Control Handbook during construction. This is to ensure short term measures for erosion controi are properly managed. The site is flat and does not have long-term erosion issues. 7.
