WIIEREAS, the State of Minnesota Department of Natural Resources through its
Outdoor Recreation Grant Program has made funding available to assist local governments in
acquiring parkland and developing or redeveloping outdoor recreation facilities; and
4 WHEREAS, the City of Saint Paul is an eligible applicant and desires to submit an
5 application to the Depar[ment of Natural Resources on Mazch 31, 2003, in the amount of
6 $190,000 for the Homecroft Recreation Center Play Area and Site Development project; and

WHEREAS, Independent School District $625 owns the property on which Homecroft
Recreation Center is located; and
WHEREAS, a Lease and 7oint Use Operating Agreement between Independent School
District $625 and the City of Saint Paul allows the City to renovate or replace the recreational
facilities on site; and
WIIEREAS, the construction of a new play azea and related site work including safety
surfacing, site furnishings and landscaping is needed at this site; and
14 WHEREAS, the City of Saint Paul has the legal authority to apply for financial
15 assistance, and the insfitutional, managerial, and financial capability to ensure adequate
16 construction, operation, maintenance and replacement of the proposed project for its design life;

WHEREAS, the City of Saint Paul has not incurred any costs or entered into any written
agreements to purchase property related to the above-referenced project; and
WHEREAS, the City of Saint Paul has not violated any Federal, State or Local laws
pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawfitl or
corrupt practice; and
23 WHEREAS, upon approval of its application by the State, the City of Saint Paul may
24 enter into an agreement with the State of Minnesota for the above-referenced project, and the
25 City of Saint Paul certifies that it will comply with all applicable laws and regulations stated in
26 the contract agreement and described in the Compliance section of the Outdoor Recreation Grant
27 Program application; now, therefore,

28 BE IT RESOLVED, that the City of Saint Paul act as legal sponsor far the Homecroft
29 Recreation Center Play Area and Site Work project contained in the Outdoor Recreation Grant
30 Program application to be submltted on Mazch 31, 2003, and that the Mayor and proper City
31 officials aze hereby authorized to apply to the Department of Natural Resources for funding of
32 this project in the amount of $190,000 on behalf of the City of Saint Paul; and

33 BE IT FURTHER RESOLVED, that the Mayor and proper o�cials of the City of Saint
34 Paul are hereby authorized to execute such agreements as are necessary to implement the project
35 on behalf of the City.
